Here is another case of citizen intervention that was not needed (no threat to life of another) and then went very bad.

Like many such cases, there are a lot of undisputed facts. Nobody disputes that the defendant initiated an encounter with the deceased. Nobody disputes that the defendant was struck, nor that he caused the death of Hernandez. The difference, however, is in the spins put on those facts: Well intentioned citizen gets overwhelmed by the situation vs "Regulator" who started an incident- then takes it too far.

After a deadlock, the defendants are being re-tried for the murder of John Hernandez. The first trial got off to a rocky start for the prosecution as the jury came very close to a not guilty verdict on the Second Degree murder charge and only showed tepid support for a conviction on several lesser charges. For this trial, the Houston County DA has assigned new, experienced prosecutors and plans to introduce new evidence.

Given the totality, I would support a Manslaughter conviction, but not a Second Degree Murder unless the prosecution could show that the defendant had a pre-conceived intent to go on say, “regulator” patrols and confront those engaged in poor social conduct. Regardless of who pushed who first, TT initiated the confrontation, and then had total physical control over Hernandez, yet continued to maintain a chokehold after being repeatedly told that it was endangering the victim’s life.

As a side note, Terry Thompson was also acting under the guidance of his wife, a Houston deputy. Given how the “arrest” was so botched, my guess is that she was not a patrol deputy and had very little or no real world law enforcement experience.

Opening statements were made in the trial of Terry Thompson. The defense did not offer one. Evidently some defense attorneys pass on the opening statement and concentrate on their later rebuttal.

For those who do not know the background, the high profile trial is centered on a death occurring after an individual confronted another person committing minor criminal acts (publically intoxicated, urinating in public). Needless to say, the defense and the prosecution have two very different spins on what led John Hernandez’s death.

Another article stated that in the prosecutions closing arguments, a prosecutor remained still and silent for the entire 3(+) minutes that the defendant kept the choke hold applied after the deceased stopped resisting.

As a personal opinion, I was wavering between supporting a Murder or Manslaughter conviction. That three (+) minutes of silence combined with a dim view of self appointed "regulators", "posse members", "vigilantes", or "block wardens" could move me to supporting a murder conviction.

A free society needs one source of lawful authority that his appointed by the people as a whole. With the exception of extreme emergencies, allowing private citizens to act as say, "regulators" over other private citizens goes down hill fast. Best to nip it in the bud with a stiff punishment.

A conviction for murder is a distinct turn around from the near acquittal and points towards the skills of the experienced prosecutors.

The sentence should take into consideration that the physical confrontation did not occur in a complete vacuum. Rather, the defendant was hit by the deceased, In addition, the deceased had a history of violence and had threatened to fight and shoot another person that same evening.

In the end, however, the conviction was justified. In addition, some citizens acting as ‘regulators’, ‘vigilantes’ or ‘block wardens’ over others cannot be tolerated and goes downhill fast.
