HOUSTON, Texas (KTRK) -- A medical examiner has officially ruled 2-year-old Maliyah Bass' death a homicide.

The ruling came down two months after the Houston girl's body was found in Brays Bayou, and more than a month after Houston police arrested the girl's mother and the mom's boyfriend as suspects in the case.

Sahara Ervin and Travion Thompson, both 21, were each charged with tampering with evidence and injury to a child. So far, following the medical examiner's ruling, Ervin and Thompson's charges have not been upgraded.

Ervin is next due in court on Dec. 16. Thompson's next appearance is scheduled for Dec. 17.

Both remain in jail, with Ervin's bond at $175,000 and Thompson's at $150,000.

I would imagine they are trying to get one of them to tell the truth. What happens if they both point the finger at each other?

Not sure if Texas is one of them, but some states have the legal mechanism "accomplice liability," which means that you may still be charged with murder even if you weren't the person who actually ended an individual's life. If LE can prove you were there and participating in part of a crime against that person (like child abuse), you can be charged with murder as well if that ends up being the outcome.

Edited to add: I imagine this statute is what LE is threatening to use on both of them to attempt to get the truth out of one of them.

Thanks! Your post was spot on, see below. This makes me feel better about the possibilities for convicting these two. I'm still fuming over their failed attempt to cover-up her murder, terrible actors.

Accomplice liability in Texas is harsh. ... However, case law shows that if the person had a duty to act and did not act then that person can be liable as an accomplice and would therefore be subject to the same punishment as the principal.

Has anybody checked the court records to see what's going in this case? I don't know how to do it but I thought there was supposed to be a court date yesterday or today.

I thought I read that both Irvin and Thompson were indicted by the Grand Jury but I don't know how to link it.

Has anybody else seen any news of this?

Investigators, in a search warrant filed this month, outlined the contradicting statements that the girl’s mother, Sahara Ervin, and her boyfriend, Travion Thompson, during the initial search for little Maliyah and the statements shared following the discovery of her body, including where Thompson was when the girl reportedly vanished. The couple took exception to a police tracking dog in their Alief-area apartment complex.

Records show the warrant was aimed at Facebook so the investigator could obtain access to Ervin’s social media accounts.

More at the link. Wow, the perps said they didn't want the tracking dog and even tried to lead the handler away from a nearby field. An upstairs neighbor was outside smoking and never saw Maliyah. Nor did surveillance footage show her. The footage did show Thompson carrying a large trash can though.

It's a little confusing. Looks like there's a hearing tomorrow (17th). Both cases went to the Grand Jury on December 14. No word on an indictment that I could find but I bet the DA is asking for murder charges.

Thanks for posting all that. Yes, I read the article that described Thompson as trying to discourage the dog handler while the dogs searched a field near the apartments, and he said something like, "What about going door to door?" No wonder he tried to draw attention away from the search dogs, claiming they were old and two of them "passed out." He knew they must have picked up a scent near the location where he dumped the body.

I haven't heard anything about murder charges, but there was probably enough evidence to indict both with the current charges based on the evidence and Thompson's confession. I wonder if Ervin will continue to remain silent or if she will turn on him.

They may not have enough evidence to charge them with murder, but both are facing 5-99 years for Injury to a Child and 2-10 years for Tampering with Evidence.

If the prosecution can prove intent to cause harm or injury, they may both be in prison for life.

According to the warrant, on the day Ervin called 911 (Aug. 22, 2020) from her neighbor's phone to report Maliyah missing, neither she nor Thompson was "engaged in searching for" Maliyah.

The warrant also revealed that the child had not been on the playground that morning and Ervin and Thompson were not seen searching for the child.

During interviews, according to the warrant, the couple made several inconsistent statements about what they were doing when the girl went missing. Thompson said he was playing video games and sweeping while Ervin said she was alone with Thompson and he was sleeping, the warrant says.

Maliyah was last seen alive on video about 57 hours before she was reported missing, according to the warrant. After that, Ervin and Thomson were seen on video going to and from stores and also lingering outside of the apartment complex, the warrant says.

Thank you for the news!

20 years feel way too little given that she’ll probably get out in way fewer years. But if that’s the only way to get the boyfriend in prison too then I guess it’s better than nothing.

I’ll never forget the act both of them put on - mom falling to the ground and boyfriend running in circles with his stupid pants falling down. Searchers could only look at each other and shake their heads.
 
Hideous. I just saw this. We spend so much money on incarnation and prisons, judicial system in this country. I am not sure of the solution, but our "Prison Complex" is a staggering sum of money, that could be far better spent, on Healthcare, education, or infrastructure.

What is wrong with people?

I read the other day that the US has 22% of the world's incarcerated individuals. That is a staggering amount of inmates. I don't know how many of those inmates are recidivist but it the numbers are significant then perhaps the focus of incarceration should be on rehabilitation rather than punishment.

I don't know if they can be rehabilitated. But 22% of the world's incarcerated aren't baby killers. Many are in prison for crimes against property and drug possession and drug-related crimes. Forty percent of violent crimes in the US are related to alcohol; crimes such as rape, aggravated assault, sexual assault and robbery. If you could rehabilitate a great number of those individuals freeing up prison space, perhaps even closing some prisons, then someone like Sahara Ervin would be spending more than 20 years in prison for killing her own child.
