At the end of this morning, Marks claimed Powell not only lied and used deception in his investigation, Marks said Powell is lying in front of the jury.

In the afternoon, Marks received numerous objections by the state for his questions over relevancy, hearsay, and speculation to soon lash out at the judge.

Outside the presence of the jury, Marks told Judge Steve Duskie, “You should be ashamed of yourself. You shouldn’t even be a judge in a hot dog eating contest.”

Hearing this, Judge Duskie immediately called for a 15 minute break.

Marks claimed Powell intimidated, deceived, and lied to illicit what Ginell said in her interview.

For Maxwell’s interview, Marks claimed Powell guided Maxwell to provide different details to support his narrative.

In Marks’ own recorded interview with Powell, Marks insinuated Powell allowed Marks to speak in an unhealthy mental state.

Marks kept bringing up how he believed Powell intimidated and threatened multiple witnesses while implanting details and unnecessary deceit to get alleged confessions.

"You are not an honest cop, are you?" Marks asked Powell.

Marks then insinuated Powell has a history of not being honest in previous testimony with a jury trial in June of 2008, and argued it's only fair for the jury to know how credible of a source he can be.

Powell testified he was given warning in counseling because of previous testimony, but Bell County District Attorney, Henry Garza, confirmed Powell was never convicted of this.

"You're going to hide to the jury that you have wrongfully convicted," Marks said.
Marks then had a very emotional outburst to Duskie.

"Are you afraid of Garza?" Marks asked. "You have shown bias throughout this whole trial. You should be ashamed. You should not even be a judge in a hot dog eating contest. It's no surprise no cameras are in here."

Outside the presence of the jury, Marks also raised his voice at Duskie saying every tool has been taken out of his hand.

Powell was able to finish up testimony on Wednesday but is subject to recall.

MAY 18, 2023 - DAY TWENTY-FOUR

CEDRIC MARKS TRIAL DAY 24 | Digital forensic investigator and Texas Ranger, Jarod Browne, is next on the witness stand. Browne performed physical extractions on the cell phones of Marks, Maxwell, Adney and McDonough. He collected over six terabytes worth of data.

Using the softwares Axiom and Cellebrite, Browne concluded Marks wiped his phone.

This is just some of what Browne found on Marks’ and Maxwell’s devices.

Here’s a recap over what happened today in trial. We learned about Cedric Marks’ escape in Conroe just a few weeks after Jenna Scott and Michael Swearingin were killed. The Nine-hour Manhunt: Inmate van driver describes Cedric Marks' escape in Conroe

The inmate van driver was just one of the witnesses who touched on the escape. Marks climbed out the back window of the van after Marie Sepulveda ordered food for the prisoners at McDonald's. Over 100 officers responded to search for Marks.

The state plans to rest their case tomorrow. Stay tuned with 6 News, we will have all the updates Friday.

The driver of the van and multiple law enforcement agents took the stand at Marks' trial on Thursday, May 18 to walk the jury through Marks' escape in Conroe.

It all started when inmate truck driver, Marie Sepulveda, and her partner stopped at a McDonald's for breakfast on the way to Bell County from Michigan.

After Marks left the eyes of the two drivers, the next person who would eventually find him was Conroe Police Officer David Peek.

Peek testified he responded to an officer's call around 7:22 a.m. on Feb. 3, 2019 about an escaped prisoner from transport. Over 100 officers covered 10-12 miles to search for Marks.

Peek found Marks nine hours later after a homeowner in Conroe expressed fear about Marks near his home. The house on Windswept Drive was just a few blocks away from the McDonald's. Peek said after lifting a trash can lid up, he found Marks in it.

Digital forensic investigator, Jarod Browne, also shared testimony related to physical extraction reports on Maxwell's and Marks' phones. He collected over six terabytes worth of data using Axiom.

Browne testified the majority of the information on Marks' phone was deleted from Jan. 5 to Jan. 9, 2019. However, Browne was able to recover the data using his special software.

There were multiple website search attempts to find the phone number and address of Bruce Thomas, who was in a relationship with Scott, on the same day.

Browne additionally found searches for Scott's mother one day before the protective hearing between Marks and Scott in 2018.

Prosecutors plan to rest their case Friday. Marks says he will be finished with his witnesses next week on Wednesday. Judge Steve Duskie says the earliest day for a verdict is May 26.

Maxwell admitted in an arrest affidavit she took Swearingin’s car and drove it to Austin to hide it, was in the house with Marks when he reportedly killed Swearingin and Scott, drove with him to Oklahoma and was there when the bodies were buried.
Trial was set to begin on 11/15/21 continued no further dates. Maxwell is accepting a plea deal to serve 20 years for two counts of tampering with evidence with chance of parole for testifying at Marks' trial. And capital murder charge is dismissed.

CEDRIC MARKS TRIAL DAY 25 | The state rested their case first thing this morning. Marks has brought in three witnesses and decided to recall Detective Corey Powell and his alleged accomplice Maya Maxwell.

The first three witnesses included the bar owner of King Bee, a paralegal at Mary Beth Herald and a Texas Team K-9 Handler. Two of Marks’ witnesses say, “I don’t understand why I’m here.”


Cedric Marks Trial Day 24: The State had decided to rest its case bringing forth witnesses. Marks made a motion for the judge to allow a direct verdict which was denied.

Marks has now brought forth three witnesses to testify for the defense. Two witnesses testified they didn’t want to be here.

Marks has now recalled Detective Powell to testify again.

For Powell being back on the witness stand, Marks insinuated Powell didn’t use geofence data in his investigation because it possibly conflicted with phone locations. Powell denied this claim.

Marks pressed into Powell believing he changed historical data from Marks phone records to present in court. Garza objected to this saying the DA office itself ordered these original phone records to prove the evidence is true.

Maya Maxwell is subject to testify again this afternoon.

Maxwell testified again this afternoon countering Marks claims she did not merge details from her past interviews to make a narrative. Maxwell denied killing Jenna Scott when questioned by Marks.

Maxwell also denied being kicked out of her friends home before staying with Marks’. Maxwell said in court again Marks spoke to her friend to then be kicked out.

Marks continually claimed Maxwell is lying to the jury and even asked if she’s ready to take a polygraph test to which the prosecution made an objection.

Before witnesses took the stand, Marks asked the judge for a directed verdict, meaning this case would be thrown out because of insufficient evidence. Judge Steve Duskie denied the motion.

Marks then brought in a bar owner, paralegal and K-9 handler for testimony. Their testimonies lasted no longer than 15 minutes. Some of the witnesses expressed they did not understand why they were testifying and why they were there on Marks' behalf.

Afterwards, Marks recalled former Temple detective, Corey Powell. He accused Powell of tampering with evidence, specifically changing location data on historical reports from Marks' phone.

"My testimony won't change," Maxwell said.

Marks brought up whether or not Maxwell put tape over Scott's mouth because he claimed Scott was making fun of her. Maxwell sternly says no.

"I never touched Jenna," Maxwell said.

Marks asked if Maxwell put a bag over Scott's head to kill her. In frustration, Maxwell shook her head and said no again.

Maxwell then told the jury firmly, "I saw Cedric kill and then bury them."

The last witness to take the stand was Richard Hicks, a current school teacher. However in 2019, Hicks was working hand-in-hand with Marks at Title Boxing Club in Killeen.

Hicks testified in the protection order hearing between Marks and Scott back in 2018. Hicks recalled an event where Scott came inside of the Title Boxing building. Hicks says as Marks and Scott exited the building, he saw a physical exchange between the two.

Marks still has plenty more witnesses lined up for the next week of trial and plans to recall his former girlfriend, Rebecca Adney. Duskie says the earliest day for a verdict is May 26.

MAY 22, 2023 - DAY TWENTY-SIX

Cedric Marks Trial Day 25: Rebecca Adney was the first witness to speak this morning. Adney testified to being with Powell in the second search of her home. Adney still stands on her previous testimony to say she notice more items were missing after police initially came.

Adney told the prosecution she has had communication with Marks since she last spoke in court. Adney also told the prosecution she has been telling the truth this entire trial.

Dianeye Nodarse is the next witness Marks called to testify. Nodarse testified she went to Adney’s home on January 3-4 2019 & found no boxes left on her porch to pick up. Nodarse said she contacted Adney about this seeing a light on in her home but saw no one present.

Marks youngest son, Logan started his testimony this morning online from Tennessee. Logan testified seeing Jenna Scott threaten and hit Marks. Logan says he has not seen Marks threaten or hit Scott.

Marks made a point to ask Logan several times if he would lie in his testimony to protect him. Logan said no, saying he chose to tell the truth in his testimony.

In cross examination, Logan said he doesn’t remember telling authorities Marks broke into Jenna’s home to ask her to drop charges. Garza gave Logan and Adrian these statements to look over break.

Marks said his sons never made these statements and someone typed them out for Garza to introduce fulfilling the prosecutions narrative.

After the break, the judge allowed Logan’s statement to be admitted into court. Logan continued his testimony to remember Marks threatening to cut Michael’s head off.

Logan said he doesn’t remember much leading up to Marks trip to Texas besides him going with Maxwell to see his lawyer. Logan doesn’t remember when Marks and Maxwell came back to Michigan and doesn’t remember his communication with Marks in this period.

Logan said he didn’t like Jenna and confirmed he only heard Marks threaten Michael once.

Marks other son Adrian spoke next on the witness stand. Adrian testified he doesn’t remember Marks threatening Michael over the phone. In cross examination Adrian said he does at some point remember Jenna Scott saying Marks hurt her.

Marks’ rebuttal witnesses were people who are close to him.

Marks virtually called is 17-year-old son to the stand, Logan, who he shares with Ginell McDonough.

The prosecution brought up Logan’s statement to police once Marks was arrested in 2019.

He said he remembers hearing Marks threaten Swearingin on the phone of cutting his head off.

“Because he (Swearingin) kept calling him (Marks), and he didn’t want him to call him,” said Logan.

In the statement, Logan also mentioned Marks’ 2018 burglary charge from breaking into Scott’s house. He said Marks told him that he was going to Texas to convince Scott to drop other charges, but he doesn’t remember saying this in the statement.

Marks also virtually called his other son, Adrien, who he shares with April Pease, a missing woman Marks is charged with murdering.

The prosecution asked Adrien details about Pease that Marks told him and if he knows why she’s missing. “I don’t know where my biological mother is. He would tell me she would do drugs and went missing,” said Adrien. Marks said it’s “disgusting” the prosecution would ask these questions.

Adrien said that he never heard the threat Marks made toward Swearingin and only somewhat knew of him.

“Not really, all I knew is that he was with Jenna. I believe you told me that,” said Adrien.

However, both sons did verify Marks going to Texas with Maxwell in January of 2019, rebuking Marks’ previous claims of never leaving Michigan.

Marks recalled on and off girlfriend, Rebecca Adney. Allegedly, the victims were killed in her house in Killeen while she was out of town.

Monday, she revealed that she was with detectives as they searched the whole house, which debunks Marks’ claims of police removing the items she noticed were missing once she returned home.

Marks’ ex-wife, Kristina Marks, took the stand.

She said she and Marks talked New Year’s Eve of 2019 about how depressed he was. This is the night before he allegedly drove down to Texas with Maxwell.

The prosecution will come with more evidence Tuesday.

The prosecution is also working on a adding a proposed charge, but didn’t say what yet.

*Maya Renee Maxwell – Pretrial hearing on 7/7/23. Accepting a plea deal to serve 20 years for two counts of tampering with evidence with chance of parole.
*Ginell Marie McDonough – 1/31/20: Plead guilty. Sentencing on 11/19/20 where charges were dismissed, testified against Marks.
 
MAY 23, 2023 - DAY TWENTY-SEVEN

CEDRIC MARKS TRIAL DAY 27 | A verdict should be in tomorrow! Marks rested his case yesterday, so now the prosecution is rebutting. Prosecution brought in Bruce Thomas as a witness who had previous intimate experiences with Jenna Scott. They were friends since 2010.

The state admitted a series of messages that Marks sent to Thomas over Facebook messenger from Aug. 17, 2018 to Jan. 5, 2019.

Marks first created a group chat with Thomas and Michael Swearingin after the protective hearing. The lengthy message bashed the two for supporting Scott and additionally used profane language.

Marks continuously threatened and stalked Thomas. Here’s some of what Marks said after the protective hearing: “I passed by your place the other day.” “I love Jenna still, I pray that both of us can meet again one day as different people. I feel she is my soulmate.”

Prosecutors asked Thomas about Scott’s demeanor after the protective order hearing was denied. Thomas said, “She was distraught. The system failed her.”

On Jan. 5, 2019, Marks messaged Thomas again and asked about Scott’s disappearance. Marks asked why Thomas never told him to stop the messages. Thomas says he never blocked Marks because he figured he would have to use this evidence later.

The state brought in Kevin Bibbs next. He is a program analyst for the Bell County District Attorney’s Office. He confirmed previous historical evidence admitted by the state was not modified or altered. Bibbs used a special software to find this.


Cedric Marks Trial Day 26: The prosecution brought forth Amanda Holtzclaw as their first rebuttal witness. Amanda spoke on Marks breaking the protective order against Jenna Scott not following the judges order.

Bruce Thomas is now on the witness stand. He’s a friend of Jenna Scott who had past intimate experiences with her. Thomas presented a string of messages Marks sent to him from the first protective order hearing on August 17, 2018 to January 5, 2019.

In the messages, Marks threatened and stalked Bruce in multiple ways. Marks objected to the texts saying he didn’t send them. The judge admitted these messages into evidence.

*Trial continues (Day 28) (@ 9am CT) - TX – Michael Lee Swearingin (32) & Jenna Kay Scott (28) (Jan. 4, 2019, Temple; found in Clearview, OK on Jan. 12, 2019) – *Cedric Joseph Marks (44/now 48) (ex bf of Scott’s) arrested (1/8/19) in Kent County, Mich. for a burglary warrant, waived extradition to Texas. *Charged (2/4/19), indicted (4/3/19) & arraigned (5/10/19) with capital murder of multiple persons & tampering with evidence. $2,016,500 Bond. DA will seek DP. Bond reduction denied (3/30/21). Will be representing himself.
*Charged (2/4/19), indicted (4/3/19) & arraigned (4/10/19) with interfering w/emergency call, false report to police officer violating protective order, burglary habitation intend.
*Charged & indicted (3/13/19) & arraigned (4/26/19) with 1st degree felony burglary (on 8/21/18 at Scott’s home). $16,500 bond on charges of interference with an emergency call, making a false police report & violation of a protection order, bond for the burglary charge is $250K & the murder of multiple persons is carrying a bond of $1.5 million & $250K. Plead not guilty to all charges.
Trial was set to begin on 2/20/23 with jury selection. From 3/27/23 to 4/4/23 with a total of 69 potential jurors selected. Final individual voir dire happened on 4/13/23. Judge Steven J. Duskie presiding. Representing himself (pro se).
Trial began on 4/17/23 & State rested their case on 5/19/23. Defense started case on 5/19/23 & rested on 5/23/23.. Earliest day for verdict per Judge is 5/26/23.

Trial continues on Wednesday, 5/24/23. Closing arguments should begin today.
