Tuesday, August 1st:
*Plea Hearing (@ 8:30am CT) – TX – Michael Lee Swearingin (32) & Jenna Kay Scott (28) (Jan. 4, 2019, Temple; found in Clearview, OK 1/9/19) – *Maya Renee Maxwell (26/now 29) (Mark’s GF) arrested (1/11/19) & extradited from MI to TX (1/16/19), charged (1/16/19), indicted (4/3/19) & arraigned (4/26/19) with capital murder of multiple persons & 3rd degree tampering or fabricating physical evidence. $750K bond. Bond reduction denied (8/18/20).
Maxwell admitted in an arrest affidavit she took Swearingin’s car and drove it to Austin to hide it, was in the house with Marks when he reportedly killed Swearingin and Scott, drove with him to Oklahoma and was there when the bodies were buried.
Trial was set to begin on 11/15/21 continued no further dates. Maxwell is accepting a plea deal to serve 20 years for two counts of tampering with evidence with chance of parole for testifying at Marks' trial. And capital murder charge is dismissed.

7/7/23 Update: Plea hearing on 7/11/23. 7/11/23 Update: The hearing for Maxwell was set for early this morning, but it is now rescheduled for 8/1/23. According to Maxwell’s defense attorney Kyle Watkins, “the basis of their motion was that Mr. Garza was not in town & he wanted to be here.” The decision of the court was to grant continuance for the plea deal, but the judge emphasized the need to ensure a date was set quickly to avoid further delay. Maxwell has an agreement with the state to plead guilty to tampering two counts of tampering with a corpse, which is punishable by 2 to 20 years in exchange for the dismissal of the capital murder charge & we were set for a plea today” says Watkins. She has already served over 4 years in jail, making her eligible to be considered for parole.
*Cedric Joseph Marks – Trial began on 4/17/23 & ended 6/9/23 with a guilty verdict of all charges & sentenced to death.
*Ginell Marie McDonough – 1/31/20: Plead guilty. Sentencing was on 11/19/20: charges dismissed testified against Marks.

Cedric Marks' alleged accomplice in his 2019 double murder, Maya Maxwell, pleaded guilty to two counts of tampering and fabricating evidence of a human corpse on Tuesday, Aug. 1.

Maxwell had accepted a plea deal back in Oct. 2021. In this deal, Maxwell was asked to testify against Cedric Marks during his trial and in exchange, she would face up to 20 years on the two counts of tampering evidence with a chance of parole.

In court on Tuesday, Maxwell was sentenced to 20 years in the TDCJ institutional division with no right to appeal.

Convicted killer Cedric Marks has started his appeal process in Bell County. The first hearing for a motion for a new trial for Marks was Wednesday, Aug. 9. The judge made no decision on whether Marks will be granted a new trial, but he will have to make a ruling by August 23.

Silent in the courtroom, Marks sat next to his appeal attorney, Gretchen Sween, as she laid out her case of why Marks should be granted a new trial. Her reasons include Marks not having fair trial rights, citing reasons such as being shackled in front of the jury.

Because Marks' case is a death penalty case, by law it automatically has to be reviewed by the Texas Court of Criminal Appeals. Mitchell said that is the state's highest criminal court and a panel of nine judges will review the entire trial to ensure no state or constitutional rights were violated.

Marks' appeal attorney is also raising questions about Marks' competency to represent himself.
