Lawyer: APD officer 'had nothing to do with' Dean's death

Attorney Bristol Myers said in his statement:
"Officer Clark had nothing to do with the death of Samantha Dean. If investigators believed so, they would have searched his home and his vehicles and obtained a DNA sample from him. None of that has happened, and at this point I don't think investigators have any hard evidence pointing to any single suspect."
"There is no Internal Affairs complaint pending on Officer Clark. I've been told by officials outside of APD that the investigation does include other officers and that placing Officer Clark on restricted duty was 'premature.'"

Interesting in that according to the article posted by annmc2 above, VC used a text message method using a victim's phone to catch a suspect.
 
Those text messages must have been sent right around the time of the murder as LE set up security right after the murder was discovered. If they were sent before the murder, premeditation is there. Those texts are a smoke screen to cover the real reason for the murder of Samantha.

NEW TODAY: The attorney for an Austin police officer on leave because of his connections to Samantha Dean confirmed investigators recently asked his client for a voluntary DNA test. The officer declined.

Clark's lawyer, Bristol Myers, released the following statement:
"The better question to ask is why investigators can't get a warrant. The answer is because they have no evidence linking Officer Clark to any crime. Unfounded suspicion by stumped detectives is probably the worst reason for a lawyer to advise a client to give up his 4th Amendment protection against unreasonable search and seizure."

Ok already has a "wife", doesn't want to give DNA.... things that make you go hummm...

Let's say the baby is his but he didn't do the murder. His DNA anywhere in the car or even on her clothing could be explained by the fact that he did have a physical relationship with her. If he tells the truth, whatever they find will have a legal explanation, screwing around is not illegal.

Now consider if he continues to deny the relationship and refuse to give DNA. Eventually, APD will get his DNA off of a discarded item or something he is touching or eating on survellience video. They will find his DNA in her car, prove the baby to be his and prove him to have lied about the whole thing. Not good for him! Why lie if he didn't kill her? How will he explain his DNA being on any of her stuff...car, clothes, wherever else they might have done the deed. Sure does explain the missing car seats, IMO.

APD will solve this, Vontrey is just buying time. In my opinion only.
 
I don't understand why this guy is on leave. They did not even work for the same employer, did they? Maybe I missed something. Now if that was his baby and they were still together at the time of her death, I could see him requesting some vacation/P TO for himself. But put on leave?

Maybe they know things we don't.

The murderer must be someone familiar with LE internal operations to specifically send threatening messages to these two individuals. Aren't text messages traceable? If I receive a text, it always shows me the number. Duh, this person sending the messages doesn't sound too smart. IMO.

Since the officer on leave lawyered up, has the common law wife lawyered up too? Can LE question her about VC's whereabouts on the night of the murder, in addition to other issues that could help LE put a few pieces together. I agree, if VC is innocent, why does he not want to answer any questions. Could it be he hired someone to kill her and assisted in the movement of her body? A seven month pregnant lady would be a bit of a challenge to move by one person.

I am sure the police know more than they ever tell the public. But if they know that much more about Officer Clark, why don't they have a search warrant for his DNA?

I guess they just don't have the evidence yet. If the killer was LE, they know how to work a crime scene. They say the crime scene was stagged, she wasn't killed at the spot where she was found. These texts are more of that staging IMO. Who else would want to kill a woman seven months pregnant who was loved by everyone?
 
It a "who done it" and an arrest may not be soon, so says LE. Samantha had contact with many people.....

Pickering said he thinks forensic clues and ongoing interviews with dozens of people who knew and worked with Dean could help lead them to the killer.

Well that does not sound good. Whomever killed her did a good job hiding their tracks I guess.

An Austin police officer with ties to Samantha Dean is now under an official internal affairs investigation concerning what officials said was alleged conduct in the days after the crime victims counselor's death.

KVUE News and the Austin American-Statesman confirmed for the first time Thursday that in the days after Samantha Dean's murder, the department kept undercover surveillance on VonTrey Clark because of his connections to Dean. It's what those officers witnessed -- Officer Clark allegedly driving recklessly -- that has led to this new investigation.
