Former Austin police officer VonTrey Clark pleaded not guilty to capital murder in his first public court appearance since he was arrested and charged in the death of Samantha Dean and her their unborn child.

The judge also issued a gag order in the case as requested by Clark’s defense attorney Bristol Myers. The prosecution had no objections to preventing witnesses or lawyers from making any public statements to the media as Clark’s case moves toward trial.

Austin police Chief Art Acevedo... issued a “post-indictment suspension” against Clark and ordered him to remain off the force until the resolution of his criminal case.

Acevedo had already fired Clark for an array of policy violations, but Clark filed an appeal. Officials said Acevedo took the additional action in case an arbitrator reinstated Clark to the force before the case was resolved.

A summons notice filed in Bastrop County court this week from District Court Judge Reva Towslee Corbett shows Kevin Leo Watson will be arraigned Jan. 20.

New arraignment date set for Samantha Dean murder suspect

A newly-filed bench warrant shows one of the two men charged in the murder of Samantha Dean is due to appear in court March 23 for an arraignment hearing.

Watson has been locked up on unrelated drug charges since April 29, 2015. Harris County jail records show Watson was charged with capital murder in September in the death of Dean and her unborn baby Madeline.

VonTrey Clark will be back in court July 27 to face the capital murder charges against him. Clark was expected to make a court appearance Wednesday morning, but it has been rescheduled.

The last time Clark was in court was in March. His attorney’s are trying to throw out the Grand Jury indictment. They are arguing parts of witness testimony wasn’t recorded.

Watson is expected back in court May 25 for his pre-trial hearing.

November 9, 2016:

Bastrop, TEXAS (KXAN) – There is still no trial date set nearly a year after a former Austin police officer pleaded not guilty in the murder of his one-time girlfriend, Samantha Dean.

No further details of the case have emerged after Judge Campbell sealed all records last October, including the grand jury’s indictments. He also imposed a gag order on anyone associated with the case from speaking publicly.

Attorneys told Judge Carson Campbell this was the beginning of the end of the discovery phase which began close to a year ago. At the time, prosecutors said they expected to call 100 witnesses whenever a trial date is set.

A district judge on Wednesday silenced attorneys, defendants and witnesses in the capital murder case against Kevin Watson, one of two men accused of killing Samantha Dean in Bastrop County last year.

Judge Reva Towslee Corbett, who sat in for Judge Carson Campbell at a pretrial hearing, issued a gag order preventing parties involved in the proceedings from publicly speaking about Watson’s case.

Former Austin police officer VonTrey Clark, who investigators say hired Watson to kill Dean, had a gag order issued on his capital murder case in November after pleading not guilty.

On the morning of Feb. 4, 2015, the body of 29-year-old Samantha Elizabeth Dean was found lying near a dumpster outside a vacant office building a few miles west of Bastrop. Tall with curly brown hair, the crime victims counselor had been shot three times in the head. She was seven months pregnant at the time of her death, her unborn child another victim in the gruesome crime.

Within the year, two men were arrested in connection with her murder: VonTrey Clark, a former Austin police officer and the supposed father of Dean’s child, who had fled to Indonesia and was captured by federal agents; and Kevin Watson, a longtime associate of Clark’s and the alleged hit man in the crime, according to court documents.

In February, Clark may stand trial, after Bastrop County commissioners included $200,000 in the upcoming fiscal year budget for his proceedings.
 
According to court records, earlier this month, both prosecutors and defense lawyers in the capital murder case met about evidence that needs to be tested in the case. That evidence includes DNA testing on floor mats believed to be from Dean’s car, along with testing on underwear found during the investigation.

It’s the first and only action filed in the case so far in 2017.

The Bastrop County Commissioners Court budgeted $200,000 in the next fiscal year for Clark’s case. So far this year, the county has spent more than $100,000 on the case.

A Bastrop County judge has set a March 19 date for opening statements in the trial of a former Austin police officer charged with murder in the death of his pregnant girlfriend.

Jury selection in the case against VonTrey Clark will start about five weeks earlier on Feb. 6, according to an order signed late last week by District Judge Carson Campbell.

The state will seek the death penalty for former Austin police officer VonTrey Clark, who is charged with capital murder in the 2015 shooting death of crime victims counselor Samantha Dean, court documents show.

Clark’s defense attorneys on Tuesday filed a motion for continuance, asking the Bastrop County court to delay the trial at least 11 months due to the extensive amount of discovery in the case and because the state would be seeking the death penalty.

Clark was scheduled to go to trial March 19. He will now be tried beginning Feb. 5, 2019, Campbell said.
