Not likely -- these issues are civil matters that are notoriously difficult to enforce -- let alone litigate. Nonetheless, there's no evidence Dalton was involved in the death of his son-- I think he was likely a victim of Balboa too.

I'm just so angry about it. If Dalton didn't leave him with her where he didn't belong his little life wouldn't have been snuffed out. I didn't buy what he was selling in his interviews he gave. He etal should not get away with violating a court order. It's so messed up. MOO

Okay - this says trial is next - but I really do not think it is next. I shall wait & see what it says in a few days. Not much info on this county....
 
I've not pulled the docket for Rivera since last July 2022 and don't know why this defendant hasn't settled already! Probably because he's not sitting in jail.

He's only had one court appearance in 2023 and appears his bond release conditions were amended on 10/24/23.

Regarding the above - he did have a pretrial conference on 10/24 which was continued - so I am going to put Rivera on 2/12/24 for that hearing - just in case it does Happen! :)

I might post some ahead of time - since I have plans in Sweden - my sister's 75th birthday celebration!

Monday, February 12th:
*Pretrial Conference Hearing (Maybe) (@ 9am CT) - TX - Samuel Olson (5, would have been 6 on 5/29/21) (it was reported that he was taken by an unknown male from a southwest Houston home in the 8800 block of McAvoy Dr. at about 7:30am on May 27, 2021, but he had been missing for 2 weeks before this, found June 1, 2021 inside a tote bag in the Best Western motel in Jasper). – *Benjamin D. Rivera (27/now 30) arrested (6/22/21), charged (6/23/21) & indicted (6/26/21) with tampering/fabricating evidence in the death of 5-year-old Samuel. $100K bond. Posted bond on 6/23/21 & is out.
Trial was set to begin on 2/12/24 was continued on 6/3/24.

7/19/23 Update: Pretrial hearing reset per defense request on 10/24/23. Trial has been set to begin on 2/12/24 @ 9am.
10/24/23 Update: Order: PTRL Supervision Bond conditions. Pretrial conference hearing was reset by agreement of both parties. Next hearing on 2/12/24. 1/2/24 Update: Trial has been continued on 6/3/24.
*Theresa Raye Balboa (29/now 31) – Plea hearing on 5/17/23 plead guilty to 1st degree murder & sentenced to 52 years in prison. Must serve 26 years before eligible for parole.
*Dylan Ray Walker (27/now 29) – no hearing set as of 9/10/21. Out of custody. Jasper County.

Sad, sad, sad. I can't believe the family and friends of little Samuel Olson are still waiting on justice for his murder.

As for Balboa, that 52 year sentence wasn't justice! It's the same deal a Texas court imposed on Magen Fieramusca where the defendant is eligible for parole after serving 26 years! I'll never understand where a defendant facing the death penalty can suddenly be worthy of parole eligibility.

Also, I'm thinking the charges against the guy who called crimestoppers (Walker) must have been dismissed. Complete silence.

I'm with you @Seattle1 it's like these precious little ones are disposable garbage. It hurts my heart and fills me with rage at how anyone could treat such an innocent child this way, or animals or the elderly. The truly innocent and vulnerable of society. :(

TX - Samuel Olson (5, would have been 6 on 5/29/21) (it was reported that he was taken by an unknown male from a southwest Houston home in the 8800 block of McAvoy Dr. at about 7:30am on May 27, 2021, but he had been missing for 2 weeks before this, found June 1, 2021 inside a tote bag in the Best Western motel in Jasper). – for Dylan Ray Walker (27/now 30) indicted (6/24/21), arrested & charged (6/25/21) with tampering/fabricating physical evidence with intent to impair. $125K bond. Bonded out 6/24/21. Jasper County
6/24/21 Update: The arrest of Dylan Ray Walker, 27, came following an indictment which was handed down on Thursday morning by a Jasper County Grand Jury after hearing evidence in the case submitted by District Attorney Anne Pickle. He is currently being held in the Jasper County Jail in connection with his alleged role in the transport of a dead child's body that was recently found in a Jasper motel room. The indictment charges Walker with tampering/fabricate physical evidence with intent to impair. Specifically, Walker is accused of helping Balboa to transport the body of Samuel. Bond on Walker was set at $125K by District Judge Delinda Gibbs Walker. Walker obtained the motel room for Balboa, transported the victim to the Best Western -- leaving Samuel (hidden inside the tote) in his truck bed for a couple of hours while he was inside the hotel room with Balboa. Walker later contacted CrimeStoppers after he departed from the hotel. Bonded out on 6/24/21.
*Benjamin D. Rivera (27/now 31) – Pretrial hearing on 9/5/24. Trial set to begin on 9/23/24 Harris County
*Theresa Raye Balboa (29/now 32) – Plead guilty to 1st degree murder of Samuel's death as part of a plea deal, avoiding the death penalty. She was sentenced to 52 years in prison. Balboa must serve 26 years before she is eligible for parole.

I'm inclined to believe his charges dropped or he plead down-- using his tip which led to the discovery of TB and Samuel's body for leniency. MOO

ETA: Still no online criminal court records for Jasper County. Public can fill out criminal cover sheet records request and submit to the County Clerk for a fee.

I too thought he probably made a plea deal - after reading the he led police to the motel. I will just put his case in the my finished stuff. Not going to worry about - I was just going thru some oldies yesterday - and wondering! :)
