Back here ready for the trial to start tomorrow. I hope there aren’t any delays which must be really hard for Lindsay’s family and that there is a conclusion this time. Thinking about Lindsay and her family and friends.
 
Monday, August 3rd:
*Re-Trial set to begin (@ 10:30am UK) – UK – Lindsay Birbeck (47) (from Huncoat; last seen ~ 2:30pm on Aug. 12, 2019 & walking towards Accrington on Burnley Road @ 4:06pm on CCTV; found Aug. 24, 2019 in the area of Accrington Cemetery on Burnley Road) - *16/now 17 year old arrested (8/27/19) on suspicion of murder & charged (8/31/19) with murder. Plead not guilty. Remanded to custody.
First Trial began on 2/25/20 with jury selection. Trial started on 2/26 with opening statements. Trial expected to last to 3/13 at the Preston Crown Court. Mrs. Justice Amanda Yip will be presiding judge. Jury: 11 women & 1 man. Trial was suspended on 3/10/20 due to COVID-19. The Judge has told the jury that the defendant has a moderate learning disability & suffers with ADHD & autism & finds communication more difficult than other people of similar age.
Re-Trial set to begin on 8/3/20 (should last 2 weeks).
6/1/20 Update: Trial has been cancelled due to COVID-19. Instead a “mention & fix” hearing will be held on 6/15/20. 6/15/20 Update: Defendant appeared via video link. Decided on trial date of 8/3/20 & should last about 2 weeks & will held at the Preston Crown Court. Next pretrial review hearing on 7/21/20.
7/21/20 Update: On Tuesday, Mrs Amanda Justice Yip along with defence and prosecution counsels, told Preston Crown Court how the re-trial into the murder of Lindsay Birbeck would run. The hearing will be split across three courtrooms to safely accommodate all those who will be attending, and allowing the defendant to appear in court via videolink. They will be connected by a live link to a third courtroom, which will seat the jury, judge, prosecution and defence barristers, and be used for witness evidence, to ensure social distancing guidelines are adhered to. Mrs Justice Yip said it would be beneficial for the teenager to be present on the first day of the trial and observe the remainder from HMP Wetherby. She said: “This would then be reviewed and if he wants he can come to court and if he understands everything he can stay at Wetherby. The re-trial, beginning on August 3, is expected to last for two weeks.

Good morning everyone and welcome to Preston Crown Court.

The retrial into the death of Lindsay Birbeck will begin at 10.30am in court 10.

However due to social distancing restrictions the case will use three different courtrooms to accommodate everybody involved.

We will be bringing our live updates to you from an annex courtroom within the building.

Why the defendant cannot be identified
A 17-year-old boy is standing trial charged with the murder of Lindsay Birbeck.

People under the age of 18 are considered more vulnerable than adult defendants and are given anonymity in the form of reporting restrictions.

The press can apply for reporting restrictions to be lifted by making an application to the judge. The judge will then balance the welfare of the child against the public interest in allowing the to be identified and make a ruling.

Why can’t we comment on social media?
Every defendant has the right to a fair trial. This means that people who sit on the jury must judge the case only on the evidence presented to them in court.

Anyone who publishes anything which could unfairly influence a jury can be found in contempt of court. This is a crime punishable with a large fine or a prison sentence.

Not sure about the last comment, refrain from posting anything which 'could unfairly influence a jury' doesn't mean having a blanket ban on commenting on the evidence.
 
Three courtrooms in use

This is the first murder trial to be held at Preston Crown Court since the start of the coronavirus pandemic.

Normally all cases are heard in one single courtroom with the judge, defendant, jury, legal counsel, press, family members and members of the public all in the same room.

However because of social distancing rules this is no longer possible.

This trial will utilise three courtrooms within the building to accommodate everyone.

So where will everybody be?

The Judge, defendant, jury and main legal counsel will be in court 10. This is also where witnesses will be brought in to give evidence.

Junior legal counsel, the defendant’s family and members of the press will be in court 8.

Court 3 will be used as an ‘overspill’ court for other interested parties.
