A juror absence on Monday meant no deliberations took place on Monday. Trial judge Mr Justice James Goss told the remaining 11 jurors that enquiries had been made, and he was satisfied there were 'good reasons' that juror was not available, but that there was a good expectation that juror would be back on Tuesday.

He said he appreciated the juror deliberations were "at a critical stage" and this was an "exceptional circumstance which had arisen".

He added: "Sometimes these things happen, and it has happened."

He apologised to the jurors for the inconvenience.

The trial is expected to resume on Tuesday at 10.30am.

The judge sounds like a broken record at this point.

It kind of sounds like this is a different juror, who had an unusual inexplicable situation---and it was not the usual suspect this time.
 
does anyone know exactly how many days have been lost to juror absences in this trial?
I was arguing with someone on twitter saying it wasn’t normal how many absences there’s been and they were saying it was a very long trial and was completely normal.
Okay 9 months… I haven’t took one sick day in the past 9 month. Neither has any of my close colleagues. It really isn’t “normal” in my opinion. Anyone else ??

There would've been two absences for me. One where I had Covid, and one where I had a migraine and could only see rainbow zigzags (triggered by a flickering ad on Websleuths funnily enough). Multiply that by 12 jury members and we're looking at 24 absences.

It’s more than 2 absences from me if we count the times I’ve had to take off because of my child.

Yes, it was a very strange business indeed. In fact when you look at all the resus patterns, they are all odd. Obviously the sudden onset and lack of natural disease process is a big red flag in itself but the babies had varying responses to the the alleged AE's. Some responded to resus, some didn't.
I wonder if moving the baby had a baring on the situation. If the bubble was not being optimally mobilised by resus attempts.
I honestly think that some of these babies died on resus because the AE moved into an obstructive position, causing the babies to flat line. With baby C in my totally non medical experience, I think that the problem here and in all of the cases actually, was that Drs were working with the unknown. The reason why some responded and some didn't is because heart massage, ventilation and Neopuff made some babies worse and some babies better.
Please forgive the 'poor taste' of this next analogy. But I think of it as like one of those hand held 'water hoop' games you used to get in the 80's. You pump the button and the pressure causes the little hoops to go up and land on the targets. But if you want to optimise your game you have to tilt the device to make sure they land in the right place.
All the pumping in the world can't help you unless a) you can see where the hoops are b) you move the device and observe the progress and impact of your work.
 
If they agree to Guilty on any of the murders, it will be hard to reject the idea that she intended to kill in the attempted murder cases.IMO
I think that the vast majority required crash cart resuscitations. Those are never 100% successful. So she had to know that, even if the emergency team took over, there was a reasonable chance of death. JMO

And there were so many where there were numerous attacks. How could one just let that go, with no charges, when some of the babies never fully recovered from the damages?
This is something we've been over before and a "reasonable chance" of death doesn't cut it as far as attempted murder goes. The defandant has to specifically intend death occur to be convicted.

Running a risk of death, even a very likely one, is not good enough to show intent on its own.

I'm still surprised that they didn't charge simple assault in a lot, or all, of the AM allegations. It can still carry a life sentence, I think.
