Man says his brother admitted slitting West High student's throat


ALT LAKE CITY — Cody French asked his brother, "Did you do it?"

His brother, Shaun Patrick French, replied “Yes,” and “that he slit her throat,” Cody French testified from the witness stand Monday.

The testimony came during a preliminary hearing for Shaun French, 25, accused of murdering 15-year-old Baleigh Bagshaw in her Salt Lake home on May 7, 2018, shortly after arriving home from her classes at West High School.

Late last week, prosecutors also filed two additional charges of witness tampering, a second-degree felony, after French allegedly told his brother and mother during phones calls from the Salt Lake County Jail to “run and not testify,” the charges state.

French, with a shaved head, beard, glasses and a yellow jumpsuit, sat quietly next to his attorneys on Monday, occasionally writing things on a piece of paper for them to read.

Tuesday, August 13th:
*Preliminary Hearing (for 2 days) – (@ 8:30am MT) – UT – Baleigh Bagshaw (15) (May 7, 2018, Salt Lake City) – *Shaun French (24) booked (5/23/18) on aggravated murder (1st degree felony) & aggravated burglary (1st degree felony), obstruction of justice (2nd degree felony) & also charged (5/8/17) with 3 counts of unlawful sexual activity with a minor (2nd degree felony) for Feb, 2017 crime. Which has been sealed. Held on $500K bond.
*Charged (8/12/19) with 2 counts of witness tampering (2nd degree felony).
Was on the run after BB’s murder; a $500K arrest warrant was issued; was arrested in Otero County on 5/9/18. 5/23/18 extradited back to Utah following his confession.
11/27/18: 3 day hearing scheduled to start 3/11/19 to 3/13/19. 3/13/19: vacated.
8/12/19 Update: Preliminary hearing held. Prosecutors also filed 2 additional charges of witness tampering, a second-degree felony, after French allegedly told his brother & mother during phones calls from the Salt Lake County Jail to “run and not testify,” the charges state. French’s defense asked the judge to postpone the preliminary hearing because they had anticipated the new charges would be filed as a separate case and they did not feel fully prepared to cross-examine witnesses. Third District Judge Royal Hansen denied the motion, noting that for the purposes of the preliminary hearing it would be OK to proceed. He also pointed to the state’s contention that it has been 15 months since Baleigh’s death and the case had not progressed much. French's defense team said if the case is bound over for trial, they will file a motion asking that the witness tampering charges not be included, as well as the charge of sexual exploitation of a minor. Preliminary hearing continues to 8/13.

Utahn ordered to stand trial in West High student's slaying


SALT LAKE CITY — A judge has ordered a Utah man to stand trial in the death of a 15-year-old girl investigators say he had harassed online after their relationship ended.

Third District Judge Royal Hansen ruled Tuesday there is enough evidence for Shaun Patrick French, 26, to be tried on a charge of aggravated murder in the 2018 death of West High School student Baleigh Bagshaw. Prosecutors have not yet indicated whether they will seek the death penalty.

French’s attorney Nick Falcone said the main priority for his defense team is taking the death penalty off the table. French’s lawyers plan to argue in court papers that his calls from jail ended with him urging his brother to hire an attorney – behavior Falcone said doesn’t fit charges of witness tampering.

Thanks very much Niner. DP case will be long slow process I would think. Very hard for Baleighs family and friends. Such a shame,hope the state can bring justice for Baliegh. MOO

Judge denies gag order in Utah death penalty case

SALT LAKE CITY — A judge in Salt Lake City has declined to bar lawyers from speaking publicly about the potential death penalty case for a Utah man charged with killing a teenage girl.

Defense attorneys for Shaun Patrick French sought a gag order on both the state and the defense, a potential move prosecutors called a “sweeping prior restraint” on their free speech.

But Parker imposed a lesser restriction. He said he would order attorneys on both sides to observe the standard in their professional code of conduct, which forbids them from giving reporters information that’s not already public and would likely lead to prejudice.
