The family and supporters of 5-year-old Hartley Anderson sat quietly in the courtroom Tuesday afternoon as the trial began for the man accused of beating her to death.

The scene was markedly different from raucous earlier court proceedings. Clark County Superior Court Judge Jennifer Snider had warned those in the gallery that any outbursts could lead to a mistrial.

Opening statements in Ryan M. Burge’s murder trial began Tuesday, following 1½ days of jury selection. More than a dozen people filed into the courtroom for the start of trial.

Senior Deputy Prosecutor James Smith asked jurors to picture a little girl with her whole life ahead of her, alone in an apartment with Burge. While in his care, she suffered more than 20 blows to her head and face. Her body was covered in bruises and lacerations — injuries no child should suffer, Smith said.

The defense maintains that Hartley’s injuries were self-inflicted — the product of a violent temper tantrum. Smith argues they were caused by Burge’s reaction to the girl’s tantrum.

Closing arguments heard in death of 5-year-old Vancouver girl

Attorneys delivered their closing arguments in Ryan M. Burge’s murder trial Wednesday in front of a courtroom filled to capacity with 5-year-old Hartley Anderson’s family and supporters, many of whom had sat through more than a week of testimony.

The prosecution argued that voluminous evidence showed that Burge savagely attacked Hartley for throwing a fit while the defense asserted that the girl had a history of self-harm and caused her own fatal injuries.

Senior Deputy Prosecutor James Smith told the jury during closing arguments that Burge’s claim that Hartley killed herself was utterly implausible.

Hartley may have thrown a tantrum shortly before she was severely beaten, but the tantrum did not kill the girl, according to the prosecutor. Instead, there was a back-and-forth between Burge and Hartley, with Burge demanding the girl stop and giving her ultimatums before he physically took out his rage on the 3-foot 3-inch, 45-pound child, Smith said.

Burge slammed Hartley’s head into drywall; she also had 20 points of impact to her head and face, Smith said. Dr. David Adler, of Columbia Neurosurgical Associates, testified that Hartley could not have injured herself to such an extent, according to Smith.

Defense attorney Michele Michalek told the jury to put their emotions aside and think with their heads. She called the state’s case unreasonable.

Man found guilty in death of Vancouver 5-year-old

A Clark County Superior Court jury convicted Ryan M. Burge on Thursday of second-degree murder, finding that he killed 5-year-old Hartley Anderson while babysitting the girl.

Jurors were undecided on a charge of first-degree murder but found Burge was guilty of a lesser included charge of manslaughter. The second-degree murder charge was the second count against Burge. The jury also determined that Burge was guilty of several factors that made his crime particularly egregious, including that Hartley was vulnerable and he betrayed a position of trust.

Burge showed little reaction to the conclusion of his trial. His sentencing was set for March 11.

3/2/20 Update: Motion to continue sentencing hearing for a month-granted. Sentencing now scheduled on 4/10. 4/3/20: Sentencing on 4/10 has been cancelled & rescheduled for 5/15.

"...On top of the 40 year prison sentence, Burge was sentenced to 36 months of anger management and substance abuse treatment.

He will not be able to have contact with Hartley’s family, and no contact with children under the age of 12."
