A Bothell man accused of fatally beating, stabbing and drowning his estranged wife in 2013 has decided to let a judge decide his fate.
Jury selection for Alan Smith’s first-degree murder trial had been scheduled to begin this week. On Monday morning, his lawyer told Snohomish County Superior Court Judge Linda Krese that Smith instead wants a bench trial. That means only the judge will weigh the evidence and reach a verdict in the case.
Deputy prosecutor Craig Matheson said he still plans to present the same case, and he expects the trial will last roughly three weeks. Witnesses are scheduled to begin testifying Thursday.
