"If the grand jury agrees that there is sufficient reason to charge the suspect with a crime, it returns an indictment carrying the words true bill." http://legal-dictionary.thefreedictionary.com/Grand+jury

"A capias is a warrant or order for arrest of a person, typically issued by the judge or magistrate in a case. A capias may be issued in different forms. A capias is commonly issued for a failure to appear in court. A capias may be based upon an affidavit alleging personal knowledge of the offense." http://definitions.uslegal.com/c/capias/

So he's been indicted (on all charges) and it's entirely possible the statutory burglary charge was thrown in there based on an affidavit from someone in his 'lil circle who knew exactly what he did.

Yay, it's official!

So he gets to stay in there to. Perfect. :jail:

Happy birthday Wes (tomorrow), here... LE got you this pretty indictment. I'm sure it's a perfect fit. Just your color, too.

Seems WH has waived his right to a jury trial, as the 7/8/15 court date is listed as a bench trial.

Also, I believe that this case has been WIDELY publicized and scrutinized, so it would be very hard to find an impartial 12 people on this.

Here is an interesting excerpt I read today;

"In many cases, especially when the crime is publicly scorned (i.e. DUI, domestic violence, animal cruelty, sex offenses) yet a bona-fide defense exists, one should consider waiving a jury trial. The case is then tried to only the judge. This can make it easier to focus the case on evidence and argument that matters most toward a not guilty verdict, rather than spending a lot of time and effort persuading twelve jurors to put aside their biases.

A bench trial may also be a prudent choice when a defendant’s appearance suggests membership in a gang, i.e. numerous tattoos, and gang activity is an issue. Likewise, when the defendant looks like a heavy drug user and sales or possession is an issue, a bench trial may be better than a jury trial. A judge may also be less emotionally swayed by certain evidence than would a jury.

A bench trial is also faster and the judge often returns a “finding” (the functional equivalent of a verdict) much quicker than in a jury trial. A quicker trial also means the trial is less expensive for the defendant if he has private counsel."

NORFOLK, Va. (WAVY) — The adoptive father of the late Anjelica “AJ” Hadsell was indicted Wednesday for charges related to his interference of the investigation into her disappearance.

At a grand jury hearing in Norfolk General District Court, indictments against Wesley Hadsell were returned for possession of ammunition by a convicted felon and four counts of obstructing justice. A direct indictment was also handed down for statutory burglary.

So his trial has been postponed until October now?

This could be the state buying more time to acquire additional evidence.

Or it could be the defense attorneys doing.

I think the fact the WH was again denied bond is very telling in this case.

Whether he's guilty of the death of AJ or not, while he was walking free he was nothing but a thorn in the side of LE. I think they know if he were out on the streets he'd be doing the same kind of "investigating" he was doing while AJ was missing. On a side note though, I think if he remains locked up, and he's NOT actually guilty of killing AJ (or at the very least leaving her at that house or having a hand in doing it) those who ARE responsible (and yes, I believe it's more than one involved) will eventually tip their hand. It's a false sense of security in a way, because the general public already thinks he's guilty.

I do think though that eventually, someone's conscience is going to leave them undone and they'll talk. I think SEVERAL people know what really happened and who was involved in covering it up.

Of course, this is MOO and all the general disclaimers.

His file on the court shows bond not set. He wasn't denied yet, his hearing must've been delayed.
