They should have gone for the mother of the girl and the daycare provider instead. The mother very possibly lied, as she told media "It was an accident!" Kicking a baby in the head is no accident. She either learned it from you, or you failed to get her proper help. The daycare provider should never have left a little baby alone with anyone.
Well, the ten-year-old girl could be a psychopath; psychopaths can't be "helped." All that you can do is incarcerate the violent ones. Most psychopaths never turn violent; some estimates are that about one person in 30 is clinically a psychopath, and I believe it.

Bumping up this thread - just in case any one has heard anything recent about it!
Not much to be found. Apparently the girl is currently in a juvenile detention center and any future legal proceedings will be sealed.

Regarding the lawsuit the little boy's parents filed:
A lawsuit filed by the parents of an infant who died when a 10-year old girl stomped on his head was thrown out Monday by a federal judge.

The suit claimed they knew the 10-year old girl was dangerous, with a history of behavioral, emotional and anger problems, but that they failed to warn the foster mother or daycare parents.

But in Monday's 18 page ruling, the judge dismissed the suit, saying there were no indications the girl was violent or was an obvious risk to children at the daycare. He also said it was not foreseeable that the foster mother would leave the girl unsupervised, or that the girl would accidentally drop Jaxon, and then kick him out of fear.
Ruling handed down in infant death lawsuit

Summary from a November 2021 article about the father starting a nonprofit organization in the little boy's name:

The father of the little boy started a non-profit organization in J's name, called Win4Jax. Its purpose is to provide child victims of crime in various ways: memorials and monuments, providing sports equipment and sponsoring league fees or other simple gifts. The nonprofit sponsored a fundraiser in January.

The girl was initially charged as an adult with first-degree intentional homicide by someone age 10 or older. She was placed in Winnebago Mental Health Institute in Oshkosh, and was brought back to Chippewa Falls for court hearings.

She was initially determined to not be competent to stand trial. Eventually the case was moved to juvenile court. The dad has attended every court hearing over the past three years.

The daycare provider and mother are the same person. The 10 year old was placed in her foster home.
