The cause of death is listed as "homicide by undetermined means", so I suppose then the SAO will have every right to ask Dr G how she came to that conclusion and she will have a very concise and common-sense answer, probably something involving, oh, duct tape found on the mandible connecting to the skull of a 2 year old who couldn't manipulate a roll of industrial strength duct tape well enough to rip off 3 or 4 pieces and then bind herself contrary to every self-preservation biological instinct inside of her, somehow fall into a trash bag and then stumble into a laundry bag, and then manage to drive herself down the block.

The Prosecutors Face Crucial Stumbling Block?

What stumbling block?

"The defense has emphasized the fact that medical examiner Dr. Jan Garavaglia did not find evidence of murder. A defense expert is questioning whether she followed proper protocol in Caylee's autopsy.

"There is nothing that I know that tells you this was a murder," said Anthony defense expert Dr. Warner Spitz."

What defense expert questioned whether she followed the proper protocol? Where can I find this documentation, Wesh? Is it in one of the defense expert reports that Baez has turned over to the prosecution? Oh wait....:waitasec:

Um...hello Wesh.....at this point, there IS nothing that Spitz knows....because HE has avoided providing any written report to the defense and appears to have been avoiding the "dream team" for quite a while now. Unless he somehow provides a written report to the prosecution and sits for a deposition, he will STILL "know nothing"....and so will the court come trial time!

Was the actual question from defense something to the effect, "As you examine the skull now is there any indication how the child died?" I don't see Dr. Spitz considering the duct tape as a part of his examination otherwise his conclusion would be the same as Dr. G. Did we EVER see a report directly from Dr. Spitz?????

As I recall it, it wasnt a response to a question by the defense (since he hasn't been deposed or provided a written report yet) but was instead a response to a question by a show host during a media appearance...

Right. And JB had put that in his report to the State but we have not seen a report from the good doctor stating that he even considered the fact that there was duct tape on the skull. So putting aside that fact, he is stating he sees nothing that would indicate the child was murdered. Maybe he bought into the "duct tape floated by in the water and attached itself" theory. (Would love to see how they think that would fly when her body was triple bagged). Oh wait, that does not work because defense is saying there was no water and she was placed there after KC returned to jail. So how did the duct tape get onto her tiny face again Mr. Baez???

Defense needs to line up their ducks as they've scattered to parts unknown. jmo

How is the defense going to explain any of this as reasonable doubt? I just don't see it. Plus in this telephone interview with Michael Baden on 12/11/2008 just when the remains of Caylee had been found he mentions duct tape and black trash bag.

So imo all this smoke and mirrors of TES volunteers and after the fact aren't going to do anything for their client. None! The only way imo that Baden knew of the duct tape and black trash bag is because the defense knew. :banghead: What a waste of time and money for the State of Florida to have to go through, but as long as she is convicted finally and put away for good I'm good. mo

And wasn't this search of TES a waste of time and money. Defense used both JJ and LB to justify searching all of the TES records when they knew there statements as defense had written them up were false.

Friday's hearing should be interesting. We must listen very closely to what the judge has to say because he often has some very significant gems tucked into his statements. I see defense trying to defend KC the best they can but also making a mockery of the court. Not good to upset the judge. Not good at all. jmo

Thanks, I'm dying to read it. I think if she came right out and admitted to falsifying the document they wouldn't have to wait until the investigation was complete to charge her. I'm thinking it isn't complete because they are investigating bigger fish and she just may get a deal in exchange for testimony against anyone else involved.

I now have a better understanding why it took JB and CM so long to look at those TES documents. They KNEW there wasn't anything in them for the defense. They figured they had all the time in the world to "quickly look them over, as they inserted a certain forged document into the mix." Guess there were too many of the media "watching" that time Mason got pizzed off and threw down the $20 and then stormed out. :loser::loser::loser:
