Medical examiner calls defense attorney's claim 'irresponsible'​

Waukesha County Medical Examiner Linda Biedrzycki testified Wednesday she concluded Hernan died by homicide from being poisoned with eyedrops after requesting four toxicology reports and finding no indication the woman was suicidal.

During opening arguments Tuesday, defense attorney Pablo Galaviz said there was no record of anyone dying from tetrahydrozoline before. He suggested the substance was not fatal to ingest and that Hernan drank it regularly with vodka.

“Not only don’t I agree with that, I think it’s an irresponsible statement,” Biedrzycki said, explaining that other instances of tetrahydrozoline poisoning have occurred because people didn't understand how harmful it is.

The things I've learned from hearing the testimony has been shocking. How did the accused find out that consuming Visine was fatal before emptying bottles of Visine into the victim's water?

I've been nauseated since yesterday when CTV showed an image of the victim in her recliner.

I'm ready for the FBI handwriting report.

I watch Law & Crime channel and either L&C blocked it out or I missed it as I did not watch a full day of trial from yesterday. The photos I saw did not show the victim at all. I saw a lot of photos though. I remember in the Pike County trial (GW4) a crime photo was shown, and it's unfathomable how those get by but they do. You can't unsee those pics.

Medical Examiner's (ME) thoughts: So unusual

The ME testified there was not any ethanol, alcohol or alprazolam in the system at the time of LH’s death.
Cause of death: Tetrahydrozoline poisoning, the main ingredient in eye drops, in the victim’s blood

Manner of death homicide - Somebody else administered Tetrahydrozoline to her!

Defendant changed her story several times.

Didn’t the defendant confess, saying she was helping to assist LH to end her life?

Defense failed at trying to discredit the ME. This doctor is most impressive and the defense failed miserably. It appears the defense is reaching and has nothing which is typical in most cases when the client has already admitted guilt.


Surprised to see the state allowed their witness to be crossed (some of the line of questioning) in such a way… I had to leave (trial ;)) due to defense’s actions (badgering is too harsh of a word to use) a waste of my time. I understand you need to defend your client; however, get to the point and don’t appear to bait the witness.

Thursday's testimony centered on Lynn Hernan's health​

Much of the testimony Thursday was related to Hernan's pre-existing health conditions.

Hernan’s death was initially believed to be an overdose, until an autopsy showed she died from ingesting tetrahydrozoline, the main ingredient in eyedrops. The Waukesha County Medical Examiner’s Office concluded she had so much in her blood, it was impossible it came from applying it to her eyes.

The defense contends Hernan ingested lethal amounts of tetrahydrozoline on her own to ease her health problems.

They both had “a crazy passion for shoes!"

LH sounded like a really generous and caring person. KP and LH were good friends. We’ve all known people like LH who don't have any kids of their own and are kind and giving to their friends’ children.

LH’s friend never felt LH was giving up, even though she wasn’t feeling well at times.

LH utilized no electronics … no cellular phone, computer, etc. She used a landline for phone calls.

KP’s son was named as a beneficiary in LH’s will.

KP surprised to learn that LH had debt at the time of her death. LH did not use credit cards, she used cash. LH’s spending habits did not change after she (LH) received an inheritance.

Interesting tidbit: At the end of Prosecutions’ redirect, the defendant appeared concerned about something, raised her hand as she is attempting to make a point about something, and the defense placed their hand over her hand to stop her from making the hand gesture. Clearly the defendant wanted to get something across and appeared to be frustrated about something. This happened right before the lunch break, at the end of KP's testimony.

  • The State calls SC, former boyfriend of the defendant to the stand
  • Recess (lunch break)
 
Police interview (3.6.2019) was interesting what stood out for me:
Both JK & JF first sat down with hands folded in front of bodies (protection). JK started relaxing a bit as she began to speak to LE officer. After a while JK began to relax even more and appeared to enjoy being so helpful.


JK: I took care of her, took her to her doctor appts, etc. I wasn’t there with her (meaning when she died)
JF: (JK’s mom) Was this all in her (LH) head, the doctors could never find another for five years.
JK: Explained she was like her daughter and she was the caretaker. She was not paid for being a caregiver- LH would offer her money for the care here and there - she wasn’t sure if LH on Medicare or SSD. She has POA and not sure if she had financial POA, thought JF had financial POA. JK unemployed at the time.
JF explained that LH was going to leave everything to her, but she added Anthony, because she assumed JF would die.
JF: LH was very paranoid.
