According to the lawsuit, after the incident, Six Flags replaced a "limit switch," an indicator that shows the safety bar is in place, in the car Esparza was riding in. Amusement park staff "found the switch to be defective."

If this is true, how can they say "no mechanical failure"? Maybe they consider it an "electronic failure." It's outrageous, and I hope a judge/jury sees it for what it is.

I am speechless after reading the above article. What a horrific tragedy! IMHO this should not have to go through the courts -- it should just be settled out of court and the family should be given bucket-loads of money.

According to the article, Six Flags "has denied liability in the case and said it did not design or manufacture the ride." IMHO - It was their employees who were involved, and one (the ride operator) actually admitted in deposition that, according to the article, "she believed the restraint bar was not properly in place but that she let the ride proceed anyway — a violation of the company's "If-In-Doubt" policy."

Another shocking tidbit from the article -- the employees were teenagers and the teenage ride attendant was sent out to look for the body after the accident. This same attendant is, I believe, the one that initially supposedly secured her lap restraint (the one the operator believed was not properly secured but let the ride proceed anyway). Unbelievable. Makes me never want to ride a roller coaster again!
