The case is likely to speed to a resolution soon, with the remaining key issue — where to hold the trial — set for a hearing Monday afternoon before Chief Judge Jake Reger in Lewis County Circuit Court.

Defense attorneys Tom and Zach Dyer have asked the court to move the trial to another region in West Virginia, saying they don’t believe Lunsford Conaway can receive a fair trial in Lewis County.


Jury selection is still on for Feb. 12th, with trial set to start the next day on the 13th.

The defense called a private investigator to the stand to prove that a change of venue was necessary. *The private investigator discussed media coverage on Facebook by multiple outlets in the area and said nearly every comment about the case was very negative. *The state countered that argument by stating that most of those comments were not from Lewis County residents.

WESTON, W.Va. — Lena Lunsford-Conaway will at least have to sit through a jury selection, a Lewis County judge determined Monday.

Circuit Court Judge Jacob Reger refused to grant the defense’s motion for a venue change in the case of Lunsford’s missing daughter, Aliayah, who is presumed dead.

Dyer (Defense attorney) said jury selection will begin in February.
“(Reger) will reconsider the motion to change venue at that time after we begin the efforts to pick a jury in Lewis County,” he said. “In a case of this magnitude, it could take a couple days to seat a jury, and this trial may take three, four or five weeks. That would be typical. We’re going to need to be very careful in selecting this jury to make sure we get an impartial group, so it could take some time.”

Lunsford-Conaway will return to court Jan. 31 for a pre-trial motions hearing. The trial is scheduled to begin Feb. 13.

CLARKSBURG — The defense has filed a motion seeking a postponement of the trial of Lena Lunsford Conaway, who’s accused in the alleged 2011 homicide of 3-year-old daughter Aliayah Lunsford.

In the motion filed Tuesday afternoon, attorneys Tom and Zach Dyer advised the court “that it has only recently been determined that additional preparation for the upcoming trial will be required for which there does not remain adequate time to conclude prior to the first day of trial as scheduled.”

The motion asks for a postponement of at least 30 days .....

The next hearing in the case is set at 10 a.m. Jan. 31 before Chief Judge Jake Reger in Lewis County Circuit Court. That hearing is set aside to take up motions by both sides.

LEWIS COUNTY, W.Va. (WDTV) -- A woman accused in the death of her then three-year-old daughter appeared in court Tuesday for a motion hearing.

Lena Lunsford-Conaway appeared via camera for a hearing regarding specific evidence in the case.The hearing was closed to the public and media.

Any idea if this trial will be live streamed at all? I am not super familiar with the details but would like to try to watch some anyway, if possible.
 
AmyPond, I just tweeted one of our local reporters who has covered this story extensively and she did not know if the trial will be live- streamed. She said it would be up to the judge to decide. Hopefully it will be! #JusticeForAliayah

WESTON, W.Va. — No decisions were made in a pre-trial motions hearing for Lena Lunsford-Conaway Thursday.

Defense attorney Tom Dyer and Lewis County Prosecuting Attorney Christine Flannigan opted to handle the matters without the prosecution.

CLARKSBURG — Jury selection remains on schedule to be held Thursday for a 35-year-old former Lewis County resident accused in the alleged 2011 homicide of 3-year-old daughter Aliayah Lunsford.

Almost 100 jurors are expected for the selection process in the case of Lena Lunsford Conaway, who since has divorced, remarried and moved to Florida.

The trial is scheduled to begin next Monday. More than 50 witnesses could be called, with the trial possibly lasting three or more weeks.
