Gabby Petito’s parents are headed to court again in their lawsuit against police in Moab, Utah, alleging the department could have prevented the young woman's death when they stopped her and her boyfriend, Brian Laundrie, on the couple's cross country road trip in 2001.

On Feb. 25, Joseph Petito and Nicole Schmidt, Gabby's parents, filed a second amended complaint in their $50 million wrongful death lawsuit against the Moab City Police Department, according to the complaint, which was obtained by PEOPLE.

Had Brian chosen Not To Kill her, I wonder where hee life would have gone. She would have outgrown him... learned perhaps to pilot her own campership and leaned into her creative side.

He could have gone back to his mama and drowned in anonymity.

Freeing Gabby to live the life she born for.

This week during a photo session with my son for his senior pictures, my sister-in-law/photographer reminded me that we were in the same area where the last known photo of #GabbyPetito was taken. I hesitated, paused and took in the moment. I had this photo taken out of respect and remembrance of Gabby. Rest in peace Gabby

When Gabby Petito went missing in 2021 it instantly became a national news story. Some labeled the astonishing amount of coverage as another example of “missing white woman syndrome,” the idea that young, attractive, white females get more media attention than other groups.

Gabby's family agrees this is a problem & they're trying to do something about it. At #CrimeCon2024 members of the Petito & Schmidt families will be joined by Darlene Gomez, an attorney who represents family members of the Murdered & Missing Indigenous Women & Relatives community

as well as Vangie Randall Shorty, whose son Zachariah was killed in 2020 on the Navajo Reservation in New Mexico. Zachariah’s case remains unsolved & struggles for attention.

Gabby Petito’s family members see signs of her everywhere.

In an interview with PEOPLE, Gabby’s parents, Nichole Schmidt, 45, and Joe Petito, 45, along with their spouses — Tara Petito, 43, and Jim Schmidt, 42 — share memories of their daughter and how they believe she is still with them and sends them signs.

“She sends us butterflies and rainbows,” Tara says. “We'll see her initials. She'll send me signs, and I start texting them. As I'm texting them to Nichole, Nichole is getting the same signs.”

MOAB, Utah (Court TV) — Right up until his death by suicide, Brian Laundrie tried to deceive law enforcement as they searched for answers in the death of Laundrie’s girlfriend, Gabby Petito, according to investigators.
