London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

Now that the trial is proceeding with no jury and the verdict is up to the judge alone, the press can reveal more details about some aspects of the trial, including why the judge dismissed the jury (both sides, Crown prosecutors and defense counsel agreed to the decision)...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

In a surprising move, the judge decided to dismiss the jury and continue as a “judge-alone trial.” From cbc.com: Trial to continue with judge alone Mark Gollom The proceedings will continue with what’s known as a judge-alone trial. This means Justice Maria Carroccia will determine the guilt...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

Both sides (prosecution and defense) have finished questioning the complainant, "E.M." The trial has moved on to other witnesses, starting with Tyler Steenbergen, a teammate who was in the room part of the time when the sexual encounters took place but he did not participate and he was not...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

The more that I read about this trial, the more I feel that there is reasonable doubt about the Crown's case against the defendants. The complainant is not a great witness for the Crown. It would be interesting to hear the defendants' side of the story but it seems doubtful that they will...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

The CBC has done a thorough job of reporting on the trial. It provides live updates during days when the trial is going on and at least one article after the finish of each day's proceedings. Here is an article about Friday's proceedings...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

It's not hard to believe that the players were not charged after the initial police investigation of the incident in 2018. Police frequently investigate possible sexual assaults, present their findings to a prosecutor and the prosecutor decides that there is not enough evidence to get a...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

Monday's court session was mostly a repeat of the Crown's opening statement from the first trial (which was declared a mistrial though we don't know why). https://www.sportsnet.ca/nhl/article/jury-shown-surveillance-video-in-2018-hockey-sexual-assault-trial/

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

I guess what happened is that the mistrial was declared early enough in the day that there was still a large pool (200) of potential jurors on site who had not yet been assigned to another case or excused. A decision was made to allow the judge in the hockey trial to draw new jurors from that...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

Now that a mistrial has been declared and the original jury was dismissed, how does the court proceed so quickly (the same day) with the process of selecting a new jury? Are there dozens of potential jurors who were just standing by? The process seems much quicker than what would happen in the...

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

I'm not surprised at this news, because the delay of 1.5 days to discuss a legal matter with no jury present indicated that there was some serious legal problem with the trial.

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

The prosecution ("the Crown") made its opening statement in the trial Wednesday morning. After the lunch break, the judge adjourned the trial for the day to discuss a procedural matter with the attorneys. https://www.tsn.ca/crown-says-london-hockey-trial-a-case-about-consent-1.2293760

London, Ontario-Canada: Five former players from Canada's junior national teame on trial for sexual assault

One of the key questions in the trial is whether the complainant consented to the sexual encounters. According to her, she consented to some but not all of the sex. However, because the players were conscious that there might be a problem with proving that they had the woman's consent to engage...

True but the people who know him will not necessarily be aware of the case. I have mentioned the case to a couple friends who follow A lot of news sources (online and TV) and they never heard of the case. Most people are not true crime buffs.
