2009.03.25 - Motions Hearing

  • #341
I think that was one of the reasons the judge ruled KC HAD to be present for hearings--so that she couldn't claim later that she didn't know what he was doing (or NOT doing) in court.

yes, but there's still a lot of motions and a whole trial to go. Having her in court for these shuts down the "I didn't see him in action" avenue of her appealing on ineffective counsel, but there are others she could take if something were to go wrong in the future, if I'm not mistaken. I'm not a legal eagle, so if I'm wrong, someone please correct.

So now at the "aftershow" I can see KC and Jose snickering about getting under SA's skin.
Makes me want to throw up.

And her daughter is dead. What would be left in the world to snicker at if your child was dead?

My take on it is that if the SA felt they needed to hold a hearing to make sure KC couldn't have grounds for an appeal down the road they are feeling pretty confident they are going to win the case! Anyone else feel this way too?

Maybe we should have a poll--LOL!

If I knew how to make one I'd do it! :waitasec: Anyone here want the honors?

Is this really a possibility?

I'm not 100% sure, hoping a legal expert will weigh in here. Could she appeal on ineffective counsel? I didn't think her being present at each hearing terminated that right.

Correct. And I bet it will happen.

By my count JB got in 3 pot-shots as to the State's ethics. That was the final shot across the bow.

He brought up the gag order allegation twice earlier. You have to recall that KC specifically aimed her pot shot at Ashton on the affidavit, too.

It is getting old, but Ashton shouldn't be showing that it is working.[/QUOTE]

ITA with the bolded part.

Also, Ashton should expect some back...after all, today's hearing was based on his suspicion/allegation that JB was acting unethically/in conflict of his client's interests, and the Judge disagreed. If you throw stones, you should expect some back, imo.

I fear that if the SAs don't tone things down a bit, it may backfire on them with the jury. I think they have the best chance of conviction if they appear fair and honest and not motivated by anything but wanting justice for Caylee.

Oh Cwap!! I don't want her to get a second chance after she's convicted.

The purpose of the hearing was to diffuse conflict of interest concerns. We still have to take into consideration that lead counsel for the defense has never tried a case in court. He has had cases settle prior to trial-but never tried a case in court right?

bolded by me.

respectfully snipped..

Baez tried a murder case in May 2008. Charge was Murder 2 and lesser. Defendent, Nilton Diaz was found guilty of Manslaughter.

I also found it interesting that Diaz was convicted of killing a 2 year old...

I wonder if those comments at the end made it into the record.

I don't see any reason for them not to. Ashton was on the record when he was talking about it not being necessary for them to be reminded about leaks. The Baez made his snide remark, Ashton replied and ONLY THEN did the Judge say, "We're done."

So I don't see how they couldn't be on the record.....jmo

To hang her head in shame, KC would have to have feelings for another person. She would have to care that Caylee is dead and so far we haven't seen that.

When JB said he's seeing more & more proof every day of her "innocence" everyone in that courtroom (but the A's) should've broke out in LAUGHTER! That's how HYSTERICAL the comment was!

So i thought he had proof from day 1?? didn't he say that we don't know the whole story... in August? oh yeah, he also said Caylee was alive...

I've seen NO evidence that the state wants ANYTHING less than justice for Caylee.

When JB made the comment about the SA worrying too much about what happens "after" the trial, I snickered, too. SA is already confident they have a conviction...it resonates off them. They are in CYA or CMA mode now, as they should be. I feel their frustration with the defense!

I wonder how many of us here at WS wanted to wipe the smirks off of KC & JB? JMHO

I'm in your camp, but the mods asked us to move any comments about appearance or clothing over to the thread that deals with that subject matter.
