2009.03.25 - Motions Hearing

I agree with your point. I am starting to think that the state doesn't have as good of a case as they say because they keep raising this issues with JB.

I disagree that the state doesn't have a good case. I think the entire point of this motion indicates that the state is so confident of the outcome they are already planning for the inevidable appeal. I do agree with bunnyphoenix1 though that the state should get all this ironed out and "out of their system" now before they reach trial. There shouldn't be any undercurrent of issues for the jury to consider other than the facts at hand in the case.

Well, that was interesting. We still don't know anything that we didn't know before it started, except that the Judge says 'no conflict', the SA is human, and JB can give a great impression of the north end of a south bound goat.

I still want to know who is paying. (sigh)
Don't we all. Likely much of what is being sold (pics) by Casey will end up as cash in JB's pocket. From what I just heard on HLN, it may seem unethical, but it is legal. And, IMO, stinks!

I'm going to nominate that for quote of the week!

If I were a betting man I would say that they are getting a large chunk from Fox News Channe/Geraldo, another large chunk from the wealthy Conn family and another chunk from licensing pics and videos of Caylee.

Maybe this case will make people look to the laws and they will be changed so no one else can do this. We can hope.

I wonder if he was the bald guy sitting behind the SA or the guy in the light colored jacket and blue shirt sitting in front of the A's?

Neither!

  • #406
I bet these are the law students helping JB

I was trying to be 'tactful'. Not very good at it, am I? :D

You took the words right out of my mouth!!

When Strickland said "this is getting old, I'm getting sick of it" do you think he was addressing that at JB or both JB and Ashton?

Paintr......that was a perfect quote! I'm storing that one away for future use.

That one deserves the clapping smiley!

BunnyP,

I don't think that many here have missed the point. You're simply veiwing it from a much different angle than most readers here might be. I think that it just appears to many that it is more the defense than the State that is being over zealous in their mud-slinging.

I don't discount your knowledge on this and appreciate your efforts to educate, it is simply that to non-legal eagles, in this instance I have a hunch that potential jurors find JB's ego and antics to be far more unappealing than the State's.

Any passion that the State displays for Justice for Caylee without the defense's circus antics will work for them with Joe Average, not against them.

There is an inherent love of a good defense by defense lawyers, and an inherent love of the State with the public when a case is so heart-wrenching as this one is.
In other words - I get your point, and bet many others do, too, but thus far, the State is still looking good. JB et al, is not.

I hope you are right. But please remember, you only need 1 juror who thinks the SA MAY be motivated by spite and not the evidence, to get a hung jury. One or two of those hung juries, and she probably walks.

I thought the OJ case was also sad, and the evidence quite compelling, but the jury acquitted. Spector got a hung jury, even though many women testified he'd used a gun with them before. And I could go on and on. I don't
think a conviction for Murder 1 is an open and shut case here, not even close, but that's jmo. That's not to say I don't think Casey is dangerous and most likely a child killer, as I think that is probably the case. But convincing 12 jurors beyond a reasonable doubt may not be as easy as many here assume, though I hope you are all right and I am wrong.

My feeling was that he was directing this comment to JB. I'm sure the Judge is tired of the unprofessional digs at prosecution.

No....I believe that was directed right at JB and his continual snarkiness toward the prosecution.

I think Judge Stan is getting real tired of giving JB law tutorials from the bench.

IMO, it's very smart "lawyering" on the State's part. There will be many issues brought up on appeal if/when Casey is convicted. Fortunately, this issue won't be one of them.

I'm not sure that's necessarily the case....on Appeal, I assume it could be argued that the Judge made an error in his findings of fact today, or applied the wrong law, and if they could establish that, it could still be an Appeal point.

However, it appears to me that the As are doing the selling and paying for her fees, in which case there would be no room for an Appeal in that regard.

That and the State has never really sunk to this level before. And JB instigated this exchange, so I think that the Judge's comment was more directed at JB. What a shame, though, that a judge should have to referee between grown men in a courtroom. One place where one's best behavior is a requirement :)

When Strickland said "this is getting old, I'm getting sick of it" do you think he was addressing that at JB or both JB and Ashton?

I think it was both only because Ashton took the "bait" and both men looked like two bickering school kids pointing fingers at each other before a principals desk rather than two attorneys making a case in a court of law. To a judge like Strickland who seems to pride himself on his "zen" skills, imo the ruckus was disgraceful to the calm control he chooses to maintain in his courtroom.

I think we're both largely on the same page here. I also believe that the proof is in the prosecution - not the pundits. I know you want justice, too, and are just educating so people don't assume it is a slam dunk.

The only point we *might* disagree on, is that I just haven't seen evidence of behaviors by the State in this case to date that satisfies my definition of 'spite', and you may have?

I'm not so sure....after all, he'd just had a hearing based on an allegation made by the SA that JB was possibly acting in conflict, and he dismissed it very quickly. I thought it was directed at both of them, or just the SA, but not sure.

Clear to me....the Ant's are in charge of the money. If Cindy handles her new found company the way she handled her house finances, Baez will be a long time collecting. Conway is there to protect G & C's money. This is now a game of spin the money.

They started a trust fund for Caylee, didn't they, at least at one point, I recall hearing about that. All monies steered to that, I suppose. Maybe Milstead left Lee in charge of his foundation's income and all is well.....poor Caylee..she is forgotten by the family.

I once, read that the house is paid off....true? I think so. Cindy may have put it up for collateral. Jackie Peterson did that...so have many others. Jackie lost it too. The Peterson's lost over a million dollars on the defense. The Anthony's appear to be doing just "fine", don't they?

bolded by me......

Not according to Orange County Property Records. They have 2 liens against the house incurred, I might add, way before this case began.
