2009.10.16 Motions Hearing

It was very interesting attending the hearing today. It's easy enough to identify all the players from seeing them on TV but it's just different in person.

My favorite part was when LDB said she wasn't arguing against allowing the autopsy pictures being disseminated for the family but only for the child. Hooray that Caylee has someone looking out for her. It's only sad that it is strangers who are caring about her and not her family. CA wasn't happy at all about that comment. She leaned forward as if to stand, her face was red and I could hear her say "Excuse me!" Someone, I assume GA, grabbed her arm and stopped her from interrupting.

Another thing I thought was great was the beat down LDB gave to JB about why his Motion to Dismiss was inadequate, insufficient and full of procedural errors... also that the attached affidavit was sworn to in the presence of a notary named JB. I think even the judge suppressed a giggle at that one. The judge took the motion to strike into consideration and the local TV channel just now broke in and said he had denied the Motion to Dismiss the child abuse charges.

The very best thing of all about being there in person was that I got to meet some other sleuthers and a blogger from another site. So very neat to meet others who have the same interests. I also got to meet KB and she was kind enough to take a minute to talk to me in the front of the courthouse as all the media was waiting for the attorneys to come out after the hearing. I told her I thought she was awesome and that I love watching her reports.

FIRST, It was completely inappropriate for Casey Anthony to laugh at anything when she is in the court room on murder charges! I don't care if there was a cirus clown in the court room, inappropriate!
SECOND, when the prosecutor was talking about Casey Anthony, Casey would look at her several times and in my opinion, the way Casey looked at her..well her eyes looked like she could just kill the prosecutor! One of the first times I saw the devil or killer in her through her eyes.
THIRD, I think its hilarous that Casey Anthony tries to act professional by taking notes and she thinks shes in the loop with everything.

“Is there gonna be a bombshell on February 1st,” WFTV reporter Kathi Belich asked Casey’s attorney, Jose Baez.

Judge says while the defense needs to be a strong advocate, Todd M.'s posturing might have gotten the defense in trouble. Judge agrees with Linda B. that Feb. 1 is not an unreasonable deadline to name the defense witnesses that are going to be called to support Todd M.'s theory and the spoliation of evidence.

AGREED! When Casey was doing her "pretend" note taking, all I could see her writing was "MRS. CASEY BAEZ" with little hearts and fluttering around it. The only thing that worries Casey is her appearance. Tee hee hee Jose! He probably was rubbing her knee. I do love this Judge though. He is fair, but not a fool.

I think the PHOTOGRAPHS were the major focus of the hearing.
WHEN THE PROSECUTOR SAID NOT TO SHOW THE PHOTOS TO THE EXPERTS THROUGH DISCS NOT FOR PROTECTION OF FAMILY BUT FOR CAYLEE...."deceased child" CASEY TOOK A BIG GULP AND ATTORNEY LYONS LOOKED AT CASEY AND YOU CAN SEE IT GAVE CASEY ANXIETY!
After the hearing, you see Attorney Lyons talking to Cindy saying they will have a phone conference later on to discuss. Interesting.
Attorney Lyons talking about the "simple" motion and not a necessary to reply to the Judge's question/comment was I think rude, unprofessional, and mocking the Judge.
So, Now that the Judge is going to grant the release of the defense putting the photos on disc and personal give them to the experts with all the restricts...who wants to start putting bets that the photos will be leaked??? ANYONE?

Why do they get til 2/1/10 to hand over evidence? If defense asks SA for theirs, they have, what is it, 15 days? I don't understand why they get so much time. Although, it could just be more my anger that it'll be so long til we get to see JB's "bombshell" evidence.

I'll bet the experts aren't pleased with JB right about now. Wonder if any of em" will email JB.....well maybe just a quick phone call and forget the techy stuff....with a message like......

I agree I think that 2/1/10 is a long time for us to wait for this released evidence but I also think that they should have like maybe up to a month but not so many months to release the evidence that they Judge wants. If they are "innocent" they should try to wrap this up and get everything to the Judge to prove it. I think JB is LYING like always about bombshell evidence, they don't have anything imo.

Okay, if JB can "personally deliver" the CD's, why couldn't he fly in his expert to simply view the disc without making a copy, so that the CD images are contained and controlled in one location? I wish JS had not granted this; it completely overturns the original decision.

Just because the photos have not been leaked - yet - doesn't mean they wouldn't be.

And, SS will kick JB's azz up between his ears, if those photos get out.

I really agree with you, that was the BEST part of the hearing. FINALLY........SOMEONE LOOKING OUT FOR CAYLEE IN ALL OF THIS!
Take a BIG gulp Casey...bc the Death Penalty is around the corner and the needle is almost in your skin.

I agree..I hope he just made them rethink helping the defense by undermining their character. JB sure likes to bad mouth people...especially "helpful" people. Exactly, good point!....if they can go in person to deliver the photos..why can't you go in person to show the pictures through the server???? Anyone think of that? Everyone KNOWS these photos are now going to be released somehow.

I think defense is using a couple of strategies among others.

1. I don't think Baez had any intent of using the server for the photos. It's just another passive-aggressive ploy to stretch out the time the case comes to trial. I think the "mistakes" in noticing the appropriate authorities/parties fall into that category as well.

2. It's all about image and change of venue and tainting the jury pool. To ensure that the latter two happen, the defense team tries to appear as if they are protecting leaking of autopsy photos- very noble. If the photos do leak, it builds for them (they think) a better case to discredit the state prosecutors and experts by inciting suspicion and paranoia regarding the state's intent.
