When I heard reference to the checks being over $300, I started to wonder if KC had thought if EACH check was under $300, she wouldn't be facing very big risk. Rut roh, KC, this is only the beginning of how you've made a frushtrating mistake in judgment. And, payback for the other 'mistake' will literally be he77.
 
And nobody even made eye contact with him let alone a tee hee. It was completely ignored.

As it should have, he is such a d-bag sometimes, has to push it to the point of sounding like an idiot. Then he completely ruined the judge's demeanor (he got agitated at that point). It's an annoying personality trait and flies in the face of the professionalism that everyone else in the courtroom is trying to maintain.
 
I personally agree with you, 1000%....but mostly it's because I loathe KC and her sins.

But the other part of my brain is bugging me, reminding me that it is true that many first time offenders barely get a slap on the wrist these days. If it's been paid back and if it's the first offense, most people do not serve or even get any jail time for uttering a bad check. Part of my job is bringing charges on bad checks to the criminal courts, and most victims, including our company, don't care or want them to get jail time as long as they pay us back. It's the fact that they avoid me that makes me have to take it to the courts.

I knew JS was going to rule in this vein, because he has mentioned several times in other hearings that he recognizes that KC has no criminal record to date.
However, and I am not sure this can be submitted to the court, but if I were the state...I would have mentioned the fact that, in sworn statements, CA, LA and SP have all said KC stole checks from them as well. This means, she does have a history there. Just not a criminal history.

ETA-I think JB could have stated what he stated way more concisely and without the pity party-He could have simply pointed out that most people do not receive 5 years on their first offense (and the state knows this) and that KC has made her debt whole. Then, he could have shut up and let JS do what he was already gonna do.

ITA. You said that well. I have to say, after he made that argument I was left seeing what he was saying was true(?) I mean, I did think that most first time bad check writing would not get five years? But, they did say that if that was all there was against her she would have gone home after today-probation(do I have that correct). Still, why was she given more than what others would typically have?

Really JB, is this kindergarten class? Do we have to hear this whining about how Casey Anthony is not the popular girl at school? Blame it on the Public not really liking liars or murderers.

AZlawyer I truly enjoy reading your posts. You bring much insight into the inner workings of our legal system.

Regarding your quoted post, are we getting our hopes up for nothing? I was hoping that Jeff Ashton mentioning the "latent print evidence" meant there was more discovery to come. I'm totally confused now. lol

I didn't get to watch the hearing, and there were conflicting reports of who said "latent" and in what context--but I posted in the "fingerprints and gloves" thread that there could be one possible loophole in the FBI reports that say "no latent prints." The short version is that there are numerous methods of finding latent prints, and the "no latent prints" reports may mean "nothing found this time around"--i.e., nothing found using black powder. But maybe later they tried another method (like vacuum metal deposition) and did find something?

BBM-I think it may be because of the number of offenses and the charges being elevated to felonies rather than misdemeanors....
In Virginia, while bad checks under a certain amount are misdemeanors, it becomes a felony when three of those otherwise misdemeanor offenses occur against the same vendor/victim withoin a certain time period.
In other words, if I write two bad checks to Jayla's Grocery, I am charged with two misdemeanors-But if I write a third bad check to them within 6 months (maybe a year, would have to check law, but no matter), they become felony counts.
 
The defense already has everything from Tennessee that the Prosecutor has- what JB wants in addition was not clear, but it is something that the Lab is unable/unwilling to produce. Judge Strickland told JB that the Prosecution doesn't have it, so JB will have to take it up with the Lab's Attorneys and arrange a hearing. SA did not address this further.
JB needs to make up his mind- ironic that his first complaint of the day was that Casey was not being treated the same way all other criminals would be in the same circumstances, regarding the fraud charges- but it is obvious that when it comes to getting ready for the Murder Trial, naming a date, he want more special considerations so he can be 'thorough'-- I wonder how many criminals are allowed a year and a half and no sign of readiness for trial?

Ha - I can think of one or two people the A's don't want to see put "under the microscope".
Hint: One of them already claims to be "under a microscope".

I think he is having a hard time with AL being the lead attorney. I noticed in court how AL had her arm around KC. Maybe JB feels he is losing his magic over KC...poor baby.
That's what I was thinking. It used to be JB that KC looked up to and chuckled with in court. Now AL is playing a mothering role ,with her hand patting and concerned looks. AL has probably shot down a few of JB's ideas,as well. Honeymoon's over.
 
Casey's UNPOPULAR therefore she is in a corrupt justice system?

I don't know about anybody else but six hundred and something dollars is A LOT of money to me and I'm sure it was to Amy too. JB made it sound as if Casey pick a penny up off the ground after it fell out of Amy's pocket. What a slap in the face of anyone who has been stolen from.

KC did better for herself than JB did-At least she did not make excuses.

I wanna swing KC around by her ponytail, don't get me wrong, but I do believe KC has always been regretful (or as close as she can get) about what she did to AH. She doesn't regret stealing the money, she regrets messing with someone that could have stayed pleasantly on the perifery, someone who was not invested enough in KC for her to hurt like she did-KC prefers to save her nastiness for those that she has more than a superficial relationship with, not nice passers-by like AH.

She expressed this to her mom in the jail visit, and I noted this was the only time she straight up owned up. Her ire is for Caylee, CA, and GA and LA and JG, RM and even AD-AH was not supposed to be part of the hate and KC wants to clear that out of her concience ASAP.
 
Did anyone else catch another " Casey tussle" over the microphone? There is whispering going on, I presume Casey to Baez, then the grab by Baez to remove the mic out of her reach, troubled looks by all parties then Lyons places her hand/arm very close to Casey to stop her from doing it again. I can't make out the whispering maybe someone else can.

Did anyone else notice during KC's "crying jag", (while she was seated), that there was a point at which she was blowing her nose and both hands sorta covered her face, and she then appeared to laugh a couple of times, as she tried to hide the laughter?
 
I am soooo sorry! I 'm sure it's no consolation,but that person will get the ultimate justice in eternety :furious:

But it is consolation and thank you. He will get justice just as Caylee will.
