Whoever, with intent that another person engage in conduct constituting a felony that has as an element the use, attempted use, or threatened use of physical force against property or against the person of another in violation of the laws of the United States....

No. It has to be in violation of the laws of the U.S. The "laws of the U.S." are federal laws. U.S.C. stands for "U. S. Code", which is a compilation of the statutes which constitute federal law.

This is a state crime, so Oregon's state law pertains to it, not federal law.
I think I get it. You mean the proposed murder would need to be connected with interstate criminal activity or something like that?

Yes, that is a good example. Not every federal criminal statute has to do with crimes that are committed across state lines, though.

Are you talking about whatever may have been seized ? The police would still have to inventory the items.
Yes. It seems like by now the inventory would be complete and the return would be filed or whatever they do.

Or murder of a government employee/official. Or on government property. Or use of government services (threats through the mail for example). etc.

If they really do have her computer, it seems to me they would have needed a search warrant for that and the truck that was supposedly searched.

Why hasn't the press been able to get a hold of the returns on any search warrants? Or, did TH or KH relinquish them when asked? Just curious.

If LE has consent to search, they don't need a warrant.

However hes not the last known person to have access to Kyron or see him that day. That was Terri Horman.
And didn't her cellular phone pings come from Sauvie Island? This was mentioned again on NG tonight.

Excuse me I may be showing my age, but what is automatic attendance system?

I believe that attendance is entered into a computer program, and all students marked as absent who's parents haven't notified the school get an automated call tonotify them that said student is absent.

Police have never confirmed that. That was third-hand hearsay from sources not connected to the case.

Do we know if Kaine was working from home around noon like he previously stated?

If the school had tried to call earlier the morning of June 4, to report that Kyron was not at school... would it had made a difference?

Thank you...Is that school run by a bunch of morons?
WHY? WHY NOT HAVE that system in place like most schools do? It is for the safety of the children.
Gosh I would have thought it is their absolute responsibility to do that.

I hope they're checking Kaine's computer and emails also.It seems to me it would have been the first thing they did was check all computers in the home.

Both Kaine and Terri acted disconnected at the first pressers, only Desiree and Tony behaved as frightened parents of a missing child.

Personally I just think ( understandably IMO) that Kaine was totally shocked and probably unable to even think straight. His little son who he had raised was missing and not only was he having to cope with THAT he had the growing rumours to listen that his wife ( the woman he presumably loved) was being looked at in connection with it. I am sure he also had growing suspicions or at the very least questions he had been asking himself plus maybe the knowledge that he had brought her into Kyrons life. If you look at a photo of him now and a year ago its n ot even barely recognizable as the same man.

The question I continue to have about the whole cell phone thing is how does anyone prove that it was Terri who had the phone that was supposedly pinging on Sauvie Island? I frequently grab my husband's phone and he takes mine ~ we tend to grab whichever phone is nearby when we walk out the door ~ so I can't automatically assume that even if the cell phone records show a person in a specific location, that means it's the owner of that particular phone who was there.

Personally I dont think the school can be blamed. There appears to be a dispute about what was said to the teacher but i believe that that the teacher thought Kyrons appointment was on the Friday and so she wouldnt be expecting him to be in class. I know Terris friend claimed she misheard cos she was hard of hearing in one ear and new but...I just think thats another lie.

In all honesty from everything being said about these pair..i can imagine both would want to make sure they had there own phones.

But really..all LE have to do is check the timings of the pings..and see if Kaine was at work at that time and if there was witnesses.

That is true, however, she hasn't claimed her phone was used by someone else to my acknowledge.

I don't think the school handled Kyron's absence well. However, when the truth comes out I believe it will reveal that the school was advised that Kyron had a doctor appointment that day, so the school understandably had no reason to notify anyone.

I don't know if anyone can prove anything unless there's video. However, I'm guessing that at some point on the evening of June 4, someone in LE asked TH and KH for their cell phones and asked if they'd had them with them all day long. Well before any record from the phones were researched, I'd guess that LE established who had which phone...I'd certainly HOPE they would.

FWIW, my husband and I never switch phones. My coworkers have my phone number programmed into their phones, and his have his programmed into theirs. I'm in communications and need to be on hand for the (rare, thankfully) times that something happens that needs the attention of the president of the school I work for. My husband is a software engineer who works on complicated, time-sensitive systems and his availability needs to be reliable when something real time is wrong with their software. Our coworkers are just as diligent with their phones. I would have a hard time believing that KH would be casual about his phone given that he probably needs it for communications with his coworkers.

It's rather late on the east coast..LOL I forgot to add no way will my hubby be allowed to use my cellular phone. LOL

Hoping that Kyron is home soon. That is the reason we are here. For the cutest and sweetest little boy that I adore his bright smile...come home soon.

Goodnight...
