I would love to see Judge Perry's initial reaction while reading the State's response! I love LDB, her motions are such a pleasure to read and include law!
I'm with you - the motion did state that he did not contribute much to the conversation, but I would bet the little he did say was in some way incriminating - otherwise why the fuss?

The article says Baez didn't contribute much to the convo. So what is with all the motions for protection? I was hoping he said something incriminating like offering money or something.
Oh mercy, if the recording announcements weren't enough (twice, that is :innocent: ), on pg. 2 of LDB's motion she states that Robin Lunceford even advises JB that she's not telling him everything because "these phones are recorded".

Yeah, I'm kinda bummed too. I think the only reason he wanted it sealed is because she probably prattles on like a raving lunatic and at most lets something slip that would prove she's lying. Oh well. I still want to hear this thing.
I'd have to think that even JB wouldn't be dumb enough do something disbarable on a knowingly recorded line. :loser:

and on 6/1/2010 10:58 p.m. to 6/2/2010 12:17 a.m., Baez (and Michelle Medina) visited Casey in the jail. What day was it that Casey had her fall in the elevator?
Well he's apparently dumb enough to knowingly file a written motion that had his own personal "faulty recollections" as its core. This is a far cry from misremembering something when making a verbal statement or answering a question of the judge. This was a written and filed motion. One would hope that in any other law office some small amount of research and fact checking would occur before submitting it to the judge?

Since LDB said the State is not the party in interest regarding the release of public records, and the State has no position as to the release of the recorded calls .... I believe it will be up to the Lowell prison to file a Motion with Judge P. either asking him to seal the recordings, or telling the Judge that they have no objection to the tapes being released in Discovery, then to the public through Sunshine Laws.
I guess we have to wait to see when this matter is set for Hearing, and wait to see what type of filing the prison makes/or does not make.....
I was thinking of the LIE about the denial of deals for pics/videos, the jail nonsense, and the shenanigans with Padilla. Now we know he was lying through his teeth about the Lunceford call, as Ms. Burdick states it was obvious he knew it was recorded because there is a message at the beginning of the call saying it's recorded...but lo and behold, he has no recollection of that! With the facebook fiasco and this stuff I hope he can find the time to come up with a defense for Casey...

I love how the SA describes the recordings in enough detail so that it is perfectly obvious that she listened to the tapes. It's like she's saying, "OK, Jose, are you gonna call the cops on me for this 'felony'?" :rolling:
