I would love to see Judge Perry's initial reaction while reading the State's response! I love LDB, her motions are such a pleasure to read and include law!
 
I'm with you - the motion did state that he did not contribute much to the conversation, but I would bet the little he did say was in some way incriminating - otherwise why the fuss?

maybe LDB gave us a hint in her response when she used the word "rantings" to describe what R.L. was saying. As much as any inmate/jailhouse snitch lacks credibility, maybe RL's rantings are so obviously out to lunch and without truth or merit, that Baez would rather have the public not hear it. I mean, Baez might not have said anything crazy or illegal, but it COULD make him look crazy/sleazy for even listening to and relying on her, you know?

The article says Baez didn't contribute much to the convo. So what is with all the motions for protection? I was hoping he said something incriminating like offering money or something.

Yeah, I'm kinda bummed too. I think the only reason he wanted it sealed is because she probably prattles on like a raving lunatic and at most lets something slip that would prove she's lying. Oh well. I still want to hear this thing.

I'd have to think that even JB wouldn't be dumb enough do something disbarable on a knowingly recorded line. :loser:

Oh mercy, if the recording announcements weren't enough (twice, that is :innocent: ), on pg. 2 of LDB's motion she states that Robin Lunceford even advises JB that she's not telling him everything because "these phones are recorded".

I think that syndrome about not telling the truth has completely rubbed off on JB from the A-Team. What a wonderful bunch.......not

Well he's apparently dumb enough to knowingly file a written motion that had his own personal "faulty recollections" as its core. This is a far cry from misremembering something when making a verbal statement or answering a question of the judge. This was a written and filed motion. One would hope that in any other law office some small amount of research and fact checking would occur before submitting it to the judge?

I love LDB's response.
Baez lets the cat out of the bag before he knows what the cat looks like. IMO he has a guilty conscious about something/something's.

I love how the SA describes the recordings in enough detail so that it is perfectly obvious that she listened to the tapes. It's like she's saying, "OK, Jose, are you gonna call the cops on me for this 'felony'?" :rolling:

How does he get away with filing outright LIES to the Court???

And LDB did not have any response to JB LYING and saying that he and LDB would be going to the prison to take depositions of the "new witnesses"!!! LDB does say there are NO new witnesses.

I hope Judge P. does not let him slide on these LIES to the Court!

I believe the matter goes deeper than what JB may have said on the recording.
I think it goes to the fact that HE did not disclose that this call(s) even took place. It only became known when LDB got word of the tape recording(s). I believe it was a violation of rules to withhold this information from the State.
Then, he compounds the problem by LYING to the Court in his two motions.
I think he wanted it sealed to give him more time to cover his tracks and make it look like he had a legitimate reason for not disclosing this info to the State. IMO

I was thinking of the LIE about the denial of deals for pics/videos, the jail nonsense, and the shenanigans with Padilla. Now we know he was lying through his teeth about the Lunceford call, as Ms. Burdick states it was obvious he knew it was recorded because there is a message at the beginning of the call saying it's recorded...but lo and behold, he has no recollection of that! With the facebook fiasco and this stuff I hope he can find the time to come up with a defense for Casey...
 
Since LDB said the State is not the party in interest regarding the release of public records, and the State has no position as to the release of the recorded calls .... I believe it will be up to the Lowell prison to file a Motion with Judge P. either asking him to seal the recordings, or telling the Judge that they have no objection to the tapes being released in Discovery, then to the public through Sunshine Laws.

I guess we have to wait to see when this matter is set for Hearing, and wait to see what type of filing the prison makes/or does not make.....

Hopefully the media will argue for the calls to be released. In the past I think the Orlando Sentinel's attorney has argued on behalf of all media interests.

in re: bold - Yes, that is exactly how I understood the 2nd call at 7:01pm when Baez answered it, it was HE who heard it. Then, RL further advises him that she's not revealing everything 'cause "these phones are recorded". However, please keep in mind that JB has no recollection of any of that. :angel:

I'm with you in re. LDB's motion! LOL She might as well have said, "I dare ya to do it, JB!"

eta: I did notice when I read JB's supplemental that he waivered from (para) "absolutely had no knowledge that the call was being recorded" to "personally has no recollection". Made me raise my eyebrows and say "hmmm".
 
all I have to say to the esteemed Mr Baez is this "duuuuuuuuuuuude you are so boinked"


no wonder Mr Baez and Miss Anthony hit it off so well, neither of them would recognise the truth if it rode in on an elephant screaming like a banshee
 
Prediction about Baez's next hissy fit -

He is gonna hit the roof that LDB quoted specific portions of the recorded calls in a document that was filed with the clerk and could be reviewed by the public. Judge Perry ordered her not to release the actual tape to anyone, he didn't restrict her from citing passages to support her motion. :angel:
 
Gee! Every news story I've read over the last few days has just made Mr Baez look soooooo competent and professional. He must be basking in all this published glory.

(did we ever manage to find that little sarcastic smilie?)
