I hate asking this, but a new thread wasn't started after the trial information was released and I'm sooooooooo tired and not wanting to wade through posts!

Is there a page where I should start? And who was the "surprise witness"??? TIA!

I still don't know who it was!!!!

I am looking for a link or source. I think Tn has said that Misty will never tell what happened to Haleigh. Does anyone remember seeing that somewhere? And where? Thanks in Advance.

Hi Nonnie..

Listen to the Levi show 10/4/10..EXCLUSIVE Chelsea Croslin Speaks Out..

At the 31:57 mark...Chelsea describes it...and exactly what TN /GMMS said and did...

Hope that helps...

no contest= most likely way to get the minimum

going to trial with the evidence against her and no viable defense= could be more than the minimum

high sentence for first time offender- statute she was charged with carries a minimum mandatory, there is no lesser sentence, only harsher sentences are at the judge's discretion

she can file an appeal, she will file an appeal, anyone can.... it won't be successful just like Tommy's wasn't

if someone suddenly becomes clear on what happened that night and wants to try to negotiate a new deal with the state they can always ask

But... minimum over what?? That's a bare minimum if you ask me! Maybe that's as a layperson who looks at 25 years equal to 30 years equal to (you get the picture). It's all big time in prison to me! Prison is prison. Minimum to ME is like... uh... 6. So, I do wait for the picture to get clearer on what happened that night to reduce the sentence, hence solving HaLeigh's case. I understand what you are saying, but I can't believe it would take this sentence to get thru to someone to talk. KWIM?

Kimster, it's not been specifically reported who the "surprise witness" was. I have speculated that it was Lisa, who revealed some very sad things about Misty's life, her rape victimology, and Lisa's own horrible transgressions against her baby girl - including blackmailing her for drugs. Don't know if that helps. It was sad, Kimster. Very sad. Check out the links in this thread to MSM for the reporting.

FWIW,

What I've gathered from news reports is that Misty's attorney, Fields himself, was arguing that Misty was targeted for the drug sting because of Haleigh. That was interesting for me to learn - that Misty's statements to the judge may have been parroting Mr. Field's strategy.

Perhaps Mr. Fields needs a new strategy.

Misty has 6th grade education. I think she's doing well if she is taking her attorney's advice and following his lead at her sentencing hearings.

As much as I am concerned Misty is lacking in contrition, I am a little wary of buying into the idea that 18 year old Misty herself is driving the actual defense strategy in the courtroom at her hearing(s).

gibby, I'm hearing ya at the moment. IMO, we must wait for court transcripts, but if we work with the reporting we have so far on what happened in court to day, this was a weak performance by Mr. Fields. :cow:

Maybe Mr. Field's inability to defend Misty properly (if it is that) is his way of insuring she gets an appeal (if in fact she can appeal). As you can see from this statement, I am certainly not a "legal eagle."

I was thinking that Misty was the surprise witness.

Thank you, thank you, thank you... I wanna SAY what I mean but it'll sound bad if I say it, although in the end it's not a bad thing... KWIM? LOL Glad you are getting what I'm saying. :)

I agree... weak performance by Mr. Fields, and in no way was Misty driving the defense strategy in the courtroom today. There were reasons behind that display, IMO.

Thanks Justus. I have never started a new thread b4, so here goes. I am very curious as to why TN can be so sure that Misty will never tell what happened to Haleigh.

I was thinking that Misty was the surprise witness.

Hmmmm...

There's another thought.

I wonder what it was she said that was "surprising"?

Gee, I keep thinking that if she had something to say that "detectives don't want to hear", that was her moment to do so...

To answer another poster's qestion of why some people have now started feeling sorry for Misty or changed their mind about her; I haven't changed my mind about her and feel sorry only that she did not deserve to get more years than Ronald. Now that is just how I feel. Misty had no record prior to the drug arrests, and Ronald's is a mile long. I do feel it is unfair for everyone else to get 15, then the book is thrown at Misty. Whatever Ronald gave up to get his plea deal has certainly not brought Haleigh's case to a conclusion. Adding that to the fact that he would not give his information earlier on, then I honestly feel he is worse than Misty. Again, JMO.

I hope that Misty thinks long and hard tonight and realizes just what and who got her into this big mess. She also needs to come to terms with what she has done. I have no sympathy for any criminal or drug dealer, but in this case Ronald should have to do as many, if not more years, than Misty. This is JMHO.

The drug sting would not have happened if they were not selling drugs. So blaming Haleigh's case for it was stupid. Does she think selling drugs is okay if you are not under suspicion for another crime?

And they were very much in the spotlight so it was not SMART to do what they did. I also think that having her mother testify today was just one more person she could blame for what she is and not accept responsibility for herself or her actions. jmo

The surprise witness report came out a while back when Misty was taking this to trial. Fields was supposedly going to have a surprise witness at her trial...but after that was reported, Misty changed her Not Guilty plea to Nolo. Thus, there was no trial...and the surprise witness was not needed at the sentencing hearing. JMO.

Yes ... Misty and team played into LE's hands and gave them the chance they needed ... to hold them for the duration until they spill.

Time will tell.

Misty will blame the system for a while but as she matures she will come to terms and realize. I think the prosecution wanted Misty to get a harsher sentence to force her to spill on Ron.

She has a stark reality to ponder. She also has the worst case scenario, so can work on that to reduce her sentence based on real cooperation and the truth.

I agree with your post, and it's what I've been trying to say. I guess that means I'm a true Aquarian: I see both sides, understand both sides, and that's how it rolls. I think LE fully expected one of them to squeal by now and it didn't happen so they pull the drug charges, make them sit on long FL law sentences, and wait. They are in no hurry, but I do hope (really hope) that HaLeigh wasn't forgotten and they will still keep her in their hearts and close the case. My hope is really, REALLY, leaving, tho.... :(

Aquarian here too!

Now, I wanna say something and I hope I get it across without sounding accusatory or misinformed. lol Let me start off with I like defense attorneys. My cousin is one, JAG turned public defender. He's a good guy. I like defense attorneys because if there weren't defense attorneys, there would be no prosecuting attorneys. Kind of a yin/yang thing.

Now... bear with me and hopefully I say this right. lol Do you think Fields is an ethical attorney? Did he do right by his client or right by the system? Does that make sense?? I'm not accusing, and I'm trying to ask as I may have had some enlightenment as to what Fields's stance was today. Been thinking and I may have an idea. Do I make sense??
Oh, to me you make all the sense in the WORLD! Misty's 'lawyer' was all she could afford, 'nuff said...

That, my friend, is why I'm questioning her counsel tonight. I can't believe that was their angle at all.
