2010.12.21 Stream of Motions - General Discussion

. . . and if they had filed none it would have invited an excuse for Casey to file that her representation was incompetent.

Either way it seems like the defense has the advantage, which is the way it was designed, I guess, in that they do not have to prove innocence but only lack of guilt.

They only have to prove reasonable doubt. :banghead:

Yes, that's something I'm confused about. Wasn't it confirmed that Joy W was the person who put that on the web? Wasn't it on her computer that was taken into evidence? Doesn't the state have to release discovery to the defense, regardless if it is going to be used in trial as evidence or not? Doesn't the SunShine law require that all discovery that is transferred from SA to defense be available to the public?

JibJab was not a jab from SA at all. Jose is trying to blame the state for creating this crapola when they were only doing its due diligence in complying with the SunShine laws.

Will HHJP see through all this stuff?

Without a doubt!

Here is my thought. IF Joy were to be called to the stand or her comments about water levels, lack of buzzards, or her "relationship" with the Anthony's introduced...the Jib jab video (if she was in fact the creator) would refute any credibility.

JB has whined one too many times about the State not releasing discovery to him and hiding things.

Me thinks his whining just bit him in the arse.

Thank you, thank you, thank you!!!

The tattoo motion asks that the SAO be required to offer proof in writing as to how the tattoo is relevant to the case.

Betcha this is Baez's way of finding out what the SA is going to present at trial because he is too dumb to figure it out himself. FPS, I'm no lawyer and I can give it one helluva good guess.

---------------
I feel I should thank him also for giving everyone a refresher course in what is known. We should change our strategy on making suggestions.:floorlaugh:

PS.cant be clearer on that last one, know what I mean?:seeya:

The image attached as Exhibit A is so blurry I can't even tell what it is. BUT as far as the angle...from looking at it it's as if Spiderman had crawled out over the defense table, suspended himself by his web, and taken it from directly above.

JB has been whining about cameras from day 1. For someone with such an issue with photos, he's certainly not "camera shy". If this photo was snapped from behind...I can't help but be curious if it was right AFTER one of his chair spins to face the "gallery" and that "someone" knew to "get ready"?

As far as people hearing them (prior to anyone else being admitted)...discuss hours and comment that he must not know the mic was on........DID he NOT see the media camera that was already set up? And why would he wait to discuss hours until the DAY OF the hearing??

I said that day, that I suspected the "pre-hearing discussion" was intended to be heard. Call me a "nut" but anything is possible.

Thanks Sleuther ... I was wondering if I was the only one who was suspicious of that picture ... it's the first time I've seen it, and it sort of looked to me like something Baez came up with to support his motion ...
I really think the issue Baez really has with the cameras is that they are focused on the defense table most of the time ... and whose fault is that? Certainly not the court's or the prosecution's ... they are not the ones that created this media circus IMO

  • #565
I don't understand why they waited this long. I know the turnover rate is unbelievable on this "team" but shouldn't Baez have done this a long time ago? 5 months to trial seems to be cutting it close.

IMO "they" are PO'd at someone and did this on purpose.Picture HHJP sitting on New Years Eve and day reading it all.He probably has it all memorized already~ hes a smart man. Tough Darts J..:croc:

When you position yourself in front of cameras after hearings....you can't whine about media interest.

When you oppose a gag order, you can't have a do over.

When you make grandiose courtroom claims of cameras zooming in on your table, you should at least cover your arse by attempting to place a shield (like a briefcase) between the camera and your "crayola notes".

When you interrupt Rachel Fugate mid sentence to complain about the camera zooming in, you should pause to remember common courtesy and manners. It would help your cause to wait....otherwise you look like a bully.

When you whine you sound weak.

When you beat a dead horse it won't make him move. You just make a mess.

Free advice.......next time I send a bill and NOT to the JAC.

Well, for goodness sakes, I haven't seen the picture and I thought I had checked out all of the the motions. I must have missed an attachment or something but obviously not too much because I know if there had been a note that was passed that could have been read I would have seen it quoted, bolded and repeated time after time on this forum and many, many others!

Jose is paranoid about his interaction with Casey in court and well he should be; he's already been extremely inappropriate enough already with all the laughing and hugging!

Baez is paranoid, period. He is so busy looking backward for someone who might be following him that he can't look forward to avoid stepping in a pile of poo.

Just found Musikman's post about the discovery released 12/17

156 - Joy Wray - JibJab video, pictures, arrest reports, Best Buy audio, video from TV

So it's Joy Wray who's responsible for the video showing up in discovery ... along with pictures, etc.
And it's the state's responsibility to turn over everything taken into evidence whether they will use it or not ...

OK, so I'm speculating here but maybe Joy Wray took that picture ... I mean she does prefer that angle ... you know, the hanging from trees angle ... LOL

They filed it to Judge Strickland!!!

As one of our esteemed members would say,

ANJ......just noticed your siggy. Thought you would appreciate this Anais Nin quote...I think it fits the defense to a big fat T!!!

I agree...there was something so overly dramatic about his reaction to the camera.

The East Coast would like to wish everyone a HAPPY NEW YEAR!!!

With every motion filed, they preserve her right to appeal. Just saying...

Now I get it! I realize JB isn't the sharpest tool (LOL!) in the shed, but I couldn't fathom what was to be gained from wasting taxpayer dollars this way.

  • #576
It may be wise for the OC Courthouse to install seat belts on JB's defense chair, oil the swivel mechanism that allows it to spin, and to make sure to rotate and balance the wheels on the bottom.

With as many opportunities Jeff A. will have to speak to the motions, JB's chair spinning / rolling routine is going to put some mileage on that puppy.

A thought......Wouldn't it just be easier for him to put a rear view mirror on the defense table???

As far as Judge Perry's chair.......I hope Santa got him a new one with heavy duty shocks. The bench is going to be rocking.

:great: Too funny!!!!!!! But, I do see a problem with that solution - KC and JB will be fighting over viewing rights - as I think they both like looking at themselves.
Wait - if KC hasn't seen herself in a mirror lately - we could get the penalty phase before the trial even starts! Someone build a defense table rear view mirror! LOL

  • #577
Just wondering if Judge Perry will even allow these motions to be heard on Monday, wasn't the hearing supposed to be about the SA requesting sanctions? Does the Honorable Judge Perry have to hear them on Monday, just because the Defense filed them? TIA

Yes, the video was available on Youtube way before it's release during the discovery process. The State had a right to investigate Joy Wray as she was claiming all kinds of crazy-ness in this case. They confiscated her computer... remember when she went to Best Buy? Best Buy called the police? I seen this video a long time ago!

I can't believe the defense even filed this motion?

PERFECT -- we can all pitch in to have it engraved on the rear view mirror!!!!!!!

Hi there NJ! Do we know which if any of these are too late to be filed?

watch what I jokingly refer to as Mrs. Linda Drane-Burdick mopping the floor with the defense silly motions. First, friend, sit your drink down!

I love Mrs. Drane Burdick at this six minute mark, I think she sums up the entire case...
"It is a farce!"
"The defense efforts do not even come close to the legal requirements necessary for the court to even entertain the motions,
their motions are replete with errors from top to bottom, it is insufficient as a matter of law,
there has not even been a good faith effort, clearly, according to case law,
and the court should not even entertain the motion."
