2010.12.21 Stream of Motions - General Discussion

Okay, so I'm taking my lunch at 12:30pm central time today. Do we think this hearing might go over an hour? Probably...

Unless the Judge says to Baez. "go home and review your law books then get back with me" NO MOO

Since today is my birthday, I am considering this hearing my BEST gift. I sooooo want to see that smile wiped from JB's face.

I don't know how they could possibly throw anything out that happened in the 31 day prior to reporting Caylee missing. I'm very curious to see what will happen.

The language in the motions continually turns around the media and the defense's preoccupation with what is being said online. I don't think that the will work out for them. It doesn't really seem like a legal argument, although I do see the improvement in the motions since Ann F. has joined.

I hope the SA points out the statistics of households that actually have Internet access or even a computer! That could definitely leave a few people on the jury who have never logged on.

Or, you know, just point out the fact that the defense had a chance for a gag order and fought successfully against it. I mean seriously, how they can even use this as an argument when THEY didn't want the gag order in the first place is just beyond me!

It's like a celebrity bashing the paparazzi, and then putting themselves out there for pictures at every chance they get, even setting up times and/or putting themselves in controversial situations in which they know they'll get pictures taken of them. But oh, look, the paparazzi won't leave me alone! You can't argue against the press, Baez, when you wanted them talking about your case in the first place and you even use one station to leak out info! You can't have it both ways, Baez! (We should so make a t-shirt of that statement and wear it to court, seriously!)

For those who have access to TruTV and can't stream it live... they WILL be carrying the hearing today.

I DVR their limited coverage (ends 3 PM EST) and use it as a back-up.

InSession usually starts their coverage of a hearing at 1 PM (EST)

So far, Jean Casarez has only mentioned the original six filings. No mention of State's motions or the later filings... yet.

I have a confession...I haven't followed this case much at all. I barely know who is who in the case aside from the A's. I just started following like 2 days ago and I got to tell you, there is no place to start my quest in reading. There are more post here then I think the court papers on this case. (laugh)

I'm here now, and please excuse me every now in then if I pose a question or comment.

True TV will have it today live or I have to watch it via the web?

Hi, Lera -- here is a good place to begin reading more on the case. Just look at the sidebar on the left. Everything is organized really well, IMO: http://www.wftv.com/news/26349357/detail.html

Are ZB and JF Zahra Baker and Jonathan Foster? I don't think Zahra's hearing is going to be televised. Is Jonathan's, do you know? Both start in thirty minutes (unless ZB is eastern time, I can't remember)...dang, I had no idea so much was going on today!

ZB is the baker case, bond hearing to lower it her bond. Maybe DA will lay the other charges on her if her bond is lowered today. Following several webpages and tweets for update. No camera's that I know of today for that.

JF if camera's are aloud in 2clickhouston will air it during their news coverage.

We don't actually know how many motions will be heard today, right? CM filed a notice of hearing that listed all the motions, but that doesn't mean Judge Perry will hear every one of them, correct?

I am wondering if HHJP will choose to just hear the 6 original motions and the one from the State asking for sanctions and set another date for the rest of the motions.

HJP will rule on one motion then state, be here at 2 am with your night cap and slippers on to hear the rest. LMAO

I wonder! HHJP has been "threatening" the Defense with working evenings for a while - maybe he will just choose today to give them a taste of it. I'm hunkered down and ready for it if that's his choice.

I agree with you.

I am thinking back on all of the motions that he has ruled on or warnings he has given. I believe he will make both sides adhere to the very letter of what he had proposed of working evenings and weekends, to teach both sides a lesson to play nice. Not really a problem for the State, since they have presented themselves as above board and professional all of the way through. Hmmm, me thinks Judge Perry will be fair, severe, and quick to point out who (if anyone) is not up to snuff ethically and err on the side of Justice.

GOOD MORNING, PEEPS!!!

:seeya: :seeya: :seeya:

So excited about watching hearing with all of you today!

:great: :rocker: :great:

SO BEHIND on this case and have been speculating as to what intent of defense actually is....

So thinking outside the box for a moment...

I can't help but wonder if this flurry of motions attempting to have a lot of this evidence thrown out (and not even the most damaging evidence imo!) is more than just attempting to preserve right to appeal? :waitasec:

I wonder if perhaps this is the defense last attempt to try to convince KC that she NEEDS to consider negotiating a plea? Could Baez tactic be to have KC present firsthand to hear HHJP DENY disallowing so much evidence? Is Baez going to shake his head and tell KC, "Sorry....it is all coming in....all will be revealed..."?

LDB motion also has me :waitasec::waitasec:

While I think it is long overdue, WHY NOW?

Taking into consideration the flurry of motions by the defense and ADDING in the timing of this SA motion, I cannot help but wonder if it is even remotely POSSIBLE that SA and the defense are both willing to negotiate a possible plea, but KC is the only hold out?

Did SA file its motion NOW in an attempt to keep any and all future negotiation details confidential and out of the realm of the public and media?

Gonna be an interesting hearing!!!

:woohoo:

Kinda/sorta OT here ... which of the media links does NOT require that annoying refresh button???
I have to multitask this afternoon but can listen and then view it every now and then.

Thanks all.
