"She partied the whole time. They`ve got to show that she was not out looking for that child. She was just taking care of herself, beautiful life. That`s what the tattoo said. That`s what she was trying to live.

MITCHELL: Exactly. You sound like you could be one of the prosecutors on this case. Leonard Padilla, if the defense is not successful and all this stuff does come in before the jury, what`s plan b, do you think, for the defense? What can they do to counteract this?

PADILLA: Well, the thing about it is once the judge rules that it`s coming in I think Jose`s going to take a step back, talk to his client, and say look, we`d better cut a deal because if this evidence comes in you`re going to be convicted and then there`s going to be the penalty part of the trial and you could end up dead. So we`d better step back and take -- Jose Baez is not an idiot. I spent a lot of time talking to him --


PADILLA: He`s not a dummy. He knows exactly where he`s at, but like any good attorney he`s going to push it right to the wall. I think when he sees this stuff coming in he`s going to sit back and say hey, fellas, what do we do now?What`s plan B? Plan B is let`s see if we can get her off alive and that`s where it`s going to end up at. She`s going to have to --

MITCHELL: Stacey, you`re a Florida prosecutor. Do you buy Leonard`s theory, that there`s going to be some kind of deal?

HONOWITZ: I don`t know, but I can tell you, you know, when Jose does see -- it`s almost like a David and Goliath. If all this evidence comes in, there`s only a certain amount of things you can do as a defense attorney to keep your client from getting convicted.

And now it does become a matter of saving her life. The death penalty`s on the table. I think that`s what you shoot for at the end of the day, saving your client`s life."

I believe George was emptying the bucket as it were here. I believe he was telling the truth here. Jayla thanks so much for finding this treasure trove.George admits a lot, A LOT here.

I do think the judge will deny the defense request.

When is this matter on the docket to be heard, if we know?

I thought it was interesting that HHJP said that the tattoo and "Diary of Days" Myspace post might be relevant to Casey's state of mind "when it was determined that [Caylee] had died." I don't think the SA made this point in the briefs (apologies to them if I just skimmed over it), but I have always felt that the tattoo, especially, was inconsistent with Casey believing that Caylee was alive. Casey admitted to Lee that the tattoo was "Caylee-related," so it seems to me that the tattoo is consistent only with the following states of mind: (1) Caylee is dead and I am happy that I will now have a beautiful life, or (2) Caylee is dead and I am mourning for her and want to memorialize her beautiful life. What it is NOT consistent with is: (3) Caylee is on vacation with the nanny so I am getting a permanent tattoo to remind me of her few weeks of theme park fun :waitasec: or (4) Caylee has been kidnapped and I am scared out of my mind that something might have happened to her.

Ditto - 3 & 4 are too much of a stretch even for the Defense Team to bring up. What other logical explanation would a jury accept? To commemorate her liaison with Tony?

Indeed! It was like the "how to" and reminded me of our law exams so it's a great example. It's nice to know that what we are doing now in using the fact and doing an analysis with the law has a future use besides passing the bar.

BTW I just got a 75.2 on my Evidence Midterm - Not good enough! Class average was 72 but I shoot for the 80/85 range.

Ziggy if you actually retained all the knowledge that earned you your 75.2% then you're way ahead of the person who crammed for a 90% and then forgets it. You just need to focus on that 24.3% for next time.

I don't know who I have the most respect for- Judge Perry or Frank George. I just know that with the 2 of them + Jeff Ashton and the lovely Linda D Burdick all of us hoping for justice for Caylee are in good hands.

Todays orders just formalized what HHJP decided in the courtroom, that KC was there for. As much as I truly wish someone on the defense team would go visit her and have a long long talk about reality, at this late stage I just don't see it happening. At least not from JB or CM.
