2010.12.21 Tim Miller and the Map Motion

So the defense is fighting to prevent Tim from "speculating" that KC was about to mark a map? Ummm? OK sure. Why not?

Nothing in their motion however in any way prevents or mitigates his eyewitness testimony to the encounter between himself, GA and KC where she was asked to mark a map, and refrained from doing so. I am pretty sure that barring obvious and blatant inconsistencies in testimony 9such as the witness was not in fact physically present) most courts tend to lean towards letting the jury determine whether a witness is lying or telling the truth on their own, and generally refrain from making this determination for them from the bench.

So I really am confused at to what JB is attempting to go after with this motion? I mean anything that he seems concerned with could have easily been taken care of during the witnesses testimony at trial by objecting to any "speculation". Nothing in his motion is going to block the actual witnesses testimony? The witness had contact with and observed an encounter with the defendent, in which the specific subject matter was her missing 2 year old daughter. That ain't gonna go away as "speculation".

I couldn't agree more. This defines the word VILE. It's insult to injury in the extreme. Not only was his successful organization almost bankrupted by Anthony family lies and stonewalling (vicariously harming how many kids?), but they trash him in public and now "through her counsel" Casey is too.

I know people are entitled to a defense. However is this what they had in mind when devising our legal system? Is there anyone on this planet who doubts what Tim Miller said? The Anthonys did nothing to search for Caylee - sorry, but Myspace "searches" and driving a sign around (while seeing your mistress?) doesn't count. Didn't George corroborate Tim Miller's account?

Publically, he didn't. Did he speak of it at the Grand Jury hearing? You have to ask yourself why George Anthony made his way over to Tim Miller's hotel that same night.

Well worth a listen to Lori Cree's interview. Very enlightening and she sounds credible. Lori claims Mark Nejame was also at the Anthony home, the day of the alledged map incident. Don't know how, but I totally missed this first time round. She also states Cindy kicked George out of the house that night and that Mark Nejame ended up over at the Holiday Inn too. :waitasec:

Given the day's events,we can only speculate about the conversation between these three men that evening. Did George spill his guts? I doubt we will ever know because Nejame will forever imo honour the client/attorney privelege.

So, if this motion does not pass the smell test, we can be assured JB/CM will try to call Tim a liar on the stand as well-I totally DARE the defense to do that in front of a jury-Given Tim's sole reason for founding TES to begin with, I would consider that kind of fumble an early Xmas present for next year.

The claim LP made to JVM:
PADILLA: Casey was never in the room when there was a map being tossed around on a table. Tracy was with her. I asked Tracy again today, did Casey leave the room to go look at a map? She says absolutely not. It never took place like that. She never left the room. I was with her in that room the whole time that that map thing was being discussed.

So...I ponder: is the Padilla gang behind encouraging Baez on this motion of trying to make Tim look like a liar? If so, then this is going to get laughable... the cowboy and his group's credibility are nil-to-none in my book.
