JB won't be held in contempt for mentioning prior bad acts of Kronk, unless there's an order in place precluding him from doing so.
I really don't think the heart shaped outline on the tape will be admitted into evidence. Not everyone can see it--even the FBI said they had failed to capture the shape in their photos.
OK, so he'll do it on cross. Then why did he bother writing the Motion that will never be heard because he missed the deadline?
ETA: I believe I answered my own question after a bit of thought with a Christmas-crash brain. Baez wrote the Motion so that he could actually call witnesses for verification of Kronk's bad acts, which now he won't be able to. The 2nd part of this though is that according to reports, none of the supposed 'witnesses' would verify, under oath, that Kronk ever committed these bad acts! - which in part, may very well be why Baez allowed the Motion to go by the wayside. (did I get all that right? lol)
But it brings me to part 4 - how will Baez go about bringing up these prior bad acts when if asked the question, "Did you ever bound your ex-wife with duct tape", for example, of course Kronk is going to answer "NO!" I don't see Baez accomplishing anything by bringing this up on cross vs. what he may have been able to do with a granted Motion, you know? Explain, please?
