The Judge thought what the Defense filed on Dec 15th, the 300 pages, was not in compliance with his Order.

Bad timing on JB's part to file a motion today saying they need more money for investigations If Judge Perry sees any of the coverage on the searchers saying they did not search the exact area and it was flooded and realizes how much time and money the defense wasted on this fishing expedition, he will not look kindly on a motion for even more money for even more fishing expeditions.

Shouldn't Jose have filed discovery about his experts ?? ... or about the DNA testing ?? did I miss it ?? I know they threw a lot into their motion for reconsideration about their experts, but tell me that doesn't satisfy the court order for him to FILE it with the court ... :maddening:

Well, Horace, it's like this. When you get to be our age, CM and me, thwarting is the only pleasure you get from life. And my guess is he really was not lying but having a senior moment. Some of us live in a different reality than most. Not me, of course. Oh no, not me, never would happen. My daughter has permission to put me in a rowboat and push me out to sea. lol jmo

They say these things to try and poison the potential jury pool... or just to make us, sweet and innocent "bloggers" mad.

I think they want us to believe that these witnesses told them one thing, and then told the State something entirely different. Making them untrustworthy and unreliable to a jury.

It's quite desperate and almost sad... which I am getting great pleasure from watching unfold. :innocent:

Why name them unless the Defense was boxing clever and trying to twist their testimony and these folks just want to set the record straight ... to be honest.

The defense already has a track record for making misstatements about what people have said compared to what that person actually stated. Plus if you put 10 TES volunteers on the stand who all state the same thing you would have to believe what they are saying as the truth. My guess is these searchers were never given depos by the defense so it's their word against the PI. Don't you have to swear someone in in order to impeach their testimony?? jmo

Yep, hence the request for more investigative dollars ?? They still haven't found the "right" searchers yet ... Of course as long as the judge says OK to more money, the more things to "investigate" the defense will come up with ...
I'm thinkin Judge Perry is going to be ending the flow of unnecessary dollars for "investigating" ... I think it's time for that fine-toothed comb ...
