OH Glorious day!!! Yes yes yes! Judge Perry is my hero, I'm so happy he has the sense that these are so important to this trial... The jury HAS to know these things!

IIRC Linda DB said they had no interest in using it... there are lots of mockery type videos on Youtube, I can't imagine why he took offence to this one?

I think the Jib Jab video was thrown in for the same reason that I make sure I include a few easy-doable items on really intense to-do lists. It's a mind game with myself . . . it makes me feel like I've accomplished things when I'm able to cross them off my list. Maybe JB needed to feel more accomplished so he included a no-brainer or two in that would most definately get "crossed off" his list. KWIM?

When the A's picked up the car at the tow yard it stank. GA was afraid to open the trunk because he was scared it might be his dead daughter or grandaughter in the trunk. He found a garbage bag instead. The guy from the towing yard tossed the garbage bag into a dumpster and said something like there's the cause of the smell.

The smell didn't leave with the garbage bag however. The next day LE picked up the garbage from the dumpster to process it. Meanwhile CA and GA had gone on the media several times blaming the smell on the garbage bag, or more specifically invisi pizza they alleged was in there.

Now comes the defense (see how much law I'm learning haha) stating that because LE allowed the garbage to dry out rather than to let it rot, it's impossible for them to illustrate that the terrible smell was pizza and not a dead body to a jury so they want all mention of the smell tossed. That's their spoilation motion and the defense missed the deadline for submitting it by more than 6 weeks.

It seems to me the defense would have a much better chance arguing that the bag was in a dumpster before being retrieved by LE. They didn't go there though.

Here is a link to the start of the discussion RE the jib jab video which was released in a doc dump in December, although WHY it was released is still up in the air. No one seemed to have any intention of using it in trial.

The defense filed a motion to have it tossed.

The jib jab video..In the meantime I found this post below but I still don't get why Baez would bother to file a motion to exclude it or why it was included in discovery in the first place..It all seems so silly for such a serious case..Now my Q is did Baez give a reason for wanting it 'out'? TIA!

If I understood correctly, investigators retrieved the video from Joy Wray's computer.... so they had to release it or risk the defense accusing them of holding back information which may be exculpatory. (Not that the defense would have on this particular thing.) It's part of the Sunshine Law.

TY SNAZ! For clearing that up. I knew that there was a valid reason for the discovery and I understand the Sunshine Law, but I wasn't sure WHERE the video was originally concocted.

The only crazy thing I can come up with is that maybe the defense thought if the video was somehow part of the trail it would become infamous and Joy Wray might actually make money and become famous because of it. And the defense just can't have anyone else making money off of this case if they aren't making money off of it, especially not a whackadoodle like Joy Wray.

I know it's a stretch, but I seriously can't think of another reason they didn't want this in unless it's a vanity thing with JB and he didn't like the parody of him in the video.
