The prosecution has filed a motion to exclude previous written testimony from a defense expert.
Dr. Werner Spitz autopsied Sarah Widmer and testified at the two previous trials that the cause of her death could not be determined.
The defense said that Spitz is now recovering from an illness, and cannot testify in person, so his previous written testimony should be allowed. However, the prosecution said that the defense simply does not have the money to pay Dr. Sptiz and so they're trying to get his testimony admitted improperly.

ORLANDO, Fla. -- When Casey Anthony's murder trial begins in May, both sides in the case will try to paint a different picture as to how exactly Anthony's daughter died.

Caylee Anthony's body was found dumped in the woods off of Suburban Drive in December 2008.

Prosecutors claim Caylee was murdered, but an expert for Anthony's defense team paints a very different picture, which could leave room for reasonable doubt.

Veteran attorney and prosecutor Jeff Deen told WESH 2 News the jury could believe either side, based on the evidence that is presented in court. If jurors find both opinions credible, it's a window for reasonable doubt, Deen said. Deen is not connected with the case.

In a newly filed deposition, Garavaglia agreed that there is no scientific evidence, but argued that it is well within her right to consider the circumstances of the duct tape near Caylee's mouth and the fact that the body was dumped.

"She's saying the child didn’t kill herself. That isn't how normal people die and how normal people are handled once they're dead," Deen said.

I don't see how this can be disputed, at least Dr. G took into account the facts of this case, which got it rolling from looking for a live Caylee but very soon, it appears to the police, Caylee was deceased.

Dr. G knew:
1. Caylee was last in the custody of ICA.
2. ICA never alerted authorities to an allegedly missing child or a child who was not returned by her babysitter, named ZFG.
3.CA was the grandparent and it was she who alerted authoritied and forced ICA to speak with the 911 dispatcher.
4. ICA didn't give any credible information into the whereabouts of her child.
5. ICA is arrested for child neglect/lying to LE
6. Body farm results, human decomp event too place in pontiac along with hair from Caylee or ICA with the death band.
7. Small remains of a child found at Suburban, with duct tape over her orifices, triple bagged with evidence leading back to the home on Hopespring Dr.
7. Positively ID'd as missing toddler, Caylee Anthony.

Now, did Dr. Spitz have all the information about this case, how it got started and how it ended???
Did he take into consideration that the last person to see Caylee alive was her mother and it was her mother who had sole custody of her.
Did he know that ICA evaded her parents for 31 days?
Did he know that ICA never alerted authorities to an allegedly missing child?
Did he know that it was CA who called authorities after 31 days?
Did he know that anything ICA told LE in reference to who/what/where/how anything told was all incredible information, lies???

What did Dr. Spitz know/do to arrive at the conclusion he did?

How can he say that this toddler, Caylee did this to herself???

There is no "scientific" evidence that Caylee died at the hands of another.

Did the good doctor forget which side of the fence he was representing? The above sentence from his report, could mean that Caylee did indeed die by the hands of the one who sits accused of the crime...there is no scientific evidence that caylee died at the hands of another! So, if there is no other hand then it would have to be ICA!

I don't see this as a 'win' for ICA, as a matter of fact I see this as fitting in with the prosecution of her first degree murder with aggravating circumstances...I do believe the good doctor didn't do anything for the defense...again...JMHO

Well, isn't it odd that the world can't find a medical examiner that Dr. Spitz thinks did their job properly. He must be the only competent one. By the way, the jury found the defendant guilty in this case. I guess they didn't believe the good doctor.

Neither did jurors believe his opinions in the Kathleen Peterson case (Death on a staircase) or the more recent Ryan Widmer case. In the Peterson case, he claimed the seven lacerations to the victim's head were caused by falling down stairs. In the Widmer case he agreed she died of drowning but claimed her head and neck injuries were caused by paramedics performing CPR. Henry C Lee was also hired for the Peterson (writer/millionaire) defense team. Lee's antics with ketchup and white cardboard were imo insulting not only to the victim but to the jury's intelligence. After the Peterson and Specter cases, I concluded that these two so called forensic experts were firmly in the mould of rent a docs and that professional integrity is just another commodity.

I would love to know how Much Spitz got out of the ABC fund.

What he wrote could not really be considered an Autopsy report, more like a summary of a fairly brief examination. There are no details that one would ordinarily expect. IMO JB just showed him Dr G's report, and said 'See if you can find ANYTHING in there that we can attack in Court' and that's what he did.

And this is where live testimony will make the trial interesting...to date, we can all speculate on the written word until our heads spin....

Thank you. . . Admittedly I'm not a regular reader of autopsy reports but it didn't look very official to me considering that the "report" began with the words, "Dear Mr. Baez."

If my taxes helped pay for this I would sure like a refund.

SAys he ~ He reserves the right to amend his report should additional pertinent information become available. What exact information would he need to determine that the death was caused by someone other than Caylee. Nothing to indicate cause of death.
We are to believe that because of his many years observing deceased bodies he is the master. The times they are a-changing, doc...you fail to "see" what a skilled dedicated ME such as Dr. G. sees.

JWG- Any interest in being a witness for the state? Your rebuttal to Spitz' was impeccable. I think the state could use you. I know they have Dr. G & of course she's the ultimate unbiased witness, but you could certainly dispute Spitz' claims easily- well done! :rocker:
