Even if George did molest Casey (I do not believe he did)... fine. Adding all these wild stories of George covering up an accident and basically framing Casey for 1st degree murder, imo, ruined any chance of a jury buying anything the defense says in her behalf. And we haven't even gotten to the Roy Kronk finding, hiding, then planting Caylee's remains.

Ok. I do not think that it is appropriate the ICA be allowed to talk TO anyone in that court room unless they are directly Asking her a question or addressing her. She should NOT be walking out of that court room muttering away to folks as she is leaving. Nor should she be allowed to have any expression on her face what so ever! Her courtroom behavior irritates me more than anything else!

I missed that...my WFTV feed was cut off.

CM calling for a mistrial. At least this answers me question of why the defense offered this accident/ drowning/ cover/up/ abuse scenario.
Wonder what he has up his sleeve for RK?

In jury trials, offers of proof may be made outside the hearing of the jury. A party may request a motion in limine (Latin: "at the threshold") made before the start of a trial requesting that the judge rule that certain evidence may, or may not, be introduced to the jury in a trial. In some cases this may be made at the bench (with the court reporter taking down every word spoken by the parties and the judge) or the jury may be excused. It is common for the jury to be excused and for a party to be allowed to continue questioning a witness outside the hearing of the jury until the judge can determine if the evidence sought is relevant and not otherwise excludable.

Before this trial began, HHJP watrned JB about trial by ambush. Doesn't this sexual abuse and drowning claim fall exactly under trial by ambush.

Can anyone explain what that was all about with Lazarro?? Why were they all questioning him with no jury and what will happen with his testimony?

I don't understand either...did Jose's proffer fail? or does HHJP have to decide something?

As far as I know, that whole proffering was to find out WHAT TL was going to say so that when they DO question him in front of the jury they will ALLL know what he will say.



Offer of Proof: The manner in which one side or the other gives the judge a preview of the evidence it intends to present in order to obtain a ruling on the admissibility before the party attempts to present the evidence in front of the jury

Since it was so good for the prosecution, do they get to bring it in later?

Sorry I came in very late and missed what TL said. Did he say he was ever told of the sexual abuse? Because I don't remember reading that in his depos's. Remember the night sweats etc...but not that ICA ever told him about sexual abuse.

An unsuccessful attempt by Lee to feel ICA's "chest" and hitting only by GA.
JB kept trying to get Tony L to change the GA "abuse" to sexual, but Tony corrected him to say I mean hitting or nothing. Not either hitting or sexual.

And yup, DT failed.

Why on earth can they take testimony without a jury present? I am so lost.

he will be back tomorrow...the SA said that they will release him until tomorrow morning

I don't think the A's are working with the defense... the shot of Cindy and George at the end (posted on the trial thread) shows them as I have never seen them before: like they have been hit hard and are hurting, badly.

That was my impression as well.

After hearing how GA and CA reacted to Tony's statements just now really gets to me. I'm not a religious person by any means, but I honestly prayed hard for the two of them last night. Lee as well, but mostly GA and CA.

They've been dealing with the worst imaginable h#ll for the past 3+ years and they just continue to be emotionally battered and beaten by their own child. It would devastate me to hear my own child's lies about me abusing him. I just feel so bad for them...

Why wasn't the jury listening to Tony's testimony about the "alleged" sexual abuse? I am confused??

The defense or the state, not sure who because I was not here yet, want to get into a line of questioning that the other side objects to (possibly as hearsay). So, the judge cleared the jury out and see what that line of questioning would look like, before deciding if the jury can hear it.

It sounds like the defense wanted to get in testimony that casey accused LA and GA of sex abuse. Since casey is not testifying right now, it would be hearsay and inadmissible unless it was an "admission" or something that, to put in layman's terms, makes her look bad or basically can be used as evidence against her. There are other hearsay exceptions as well.

Interesting that the judge did the questioning... I think TL is being as honest as he can.

The judge did questioning then because he was trying to decide if the testimony the defense? was seeking would be admissible or inadmissible. The jury was not there.

I think there should be a shot girl at the exit of the court house where all of ICA's former friends exit...I'm sure they could all use a shot or two. :dance:

According to the DT George impeached himself over the duck tape on the gas can testimony (gasp)... oh no... oh my God... he must be guilty of sex abuse and drowning and covering up the accident if he is lying about this! (sarcasm fully intended)

I'm sorry but JB's tactics are ridiculous- even to me and it takes a lot to make me think something is ridiculous!

A reporter tweeted that that thing with Tony was to see if he had perjured himself? Is that correct?

And now it's been proven he did not perjure himself?

OMG ow did I forget... :floorlaugh: I LAUGHED SO HARD AT THE MERE THOUGHT OF THIS AND SPIT MY ICED TEA OUT ON MY MONITOR...

Can you imagine the jury actually bying this? No way, I say no way no how will they buy it at all. I believe that every day the DT buries itself a little bit more.
