Baez was going to call Dr. William Rodriguez but Ashton told the Judge he needed more time to review Dr. R's deposition transcript from Saturday, and time to prepare for cross examination.

Ashton said Dr. R prepared to state opinion which he is not qualified to give: opinion that other people can't distinguish human decomp from other odors. This opinion was not in Dr R's original Report.

Then Baez wanted to call Defense expert Mr. Richard Eiklenbloom - but Ashton said there is nothing in his Report, so Ashton did not do a deposition with him, with no info.

Ashton said Mr. Eiklenbloom showed up at my office yesterday afternoon [Sunday] w/o depo, had no report and I just got a 2 page report and 45 slide PP presentation yesterday [Sunday]

Ashton said he will prepare another Sanctions package against Baez for this deliberate violation of the court order.

Ashton said he will take a deposition of Mr. Eiklenbloom on Tuesday at 5:00pm.

The Judge reviewed his previous Orders regarding expert witnesses, from Dec 10, 2010 and Jan 6, 2011.
Judge granted State request to defer testimony of Dr. Wm Rodriguez.
Judge said he will deal with the Sanctions issue after the trial is over.
Judge said the Florida Bar may get involved when the trial is over.

Judge said if there are repeated violations of his Orders, then exclusion of the witness testimony may be the proper remedy if it continues.

Judge said Wednesday will be a short trial day.

Defense said Dr. Rodriguez was first witness - second witness was Richard Eiklenbloom - third witness was a woman they were trying to get. She never arrived.

Judge told all attorneys to be in court at 8:30am every morning from now on.

Judge said we would go all day on Saturday [not stop at 1:00].

Judge said by stipulation between Defense and State court is in recess until 9:00am tomorrow morning.

Being fitted for expensive suits and so many sleepless nights trying to decide on which pocket square to wear.

Jurors don't know why court is cancelled or the reason for all the delays...

The jury only remembers that while the state put on their CIC, they didn't sit and wait for hours only to be told to return to their hotels. It is my opinion that they are fully aware of who is causing the delays, just from common sense.

If I were on the JURY I would be thinking "so I guess the defense doesn't have much of a defense after the last witnesses were slaughtered on the stand, I am guessing they are struggling to come up with something else,"

Well in fairness, the defense was hoping to pull a fast one with the witness they lined up and when the judge ordered the initial delay, they had to scramble on their next witness which might not have worked out for whatever reason. People do have schedules outside this current trial. This will give JA time to do what he needs to do, and time for the defense to get their ducks in a row on the witnesses they intend to call, not only in scheduling, but to make sure they are properly abiding by the court orders from December and January.

How many ducks, how many rows, how many times. JB knows exactly what he's doing.

He is the ruler of the court and he is allowing Baez to rule his court with his shenanigans. All in the name of this KC getting a fair trial. He should sanction Baez right now. Give him a $5,000 fine or something. Something that hurts so he stops this nonsense. Give him 1 day to pay up.

He can't have witnesses all lined up every day because remember the experts are being paid by the state and they still have to pay them, just for hanging around the courthouse waiting to be called. Judge Perry also has to watch the budget.

I wouldn't say it is HHJP's "fault", but while he is doing everything he can to not punish ICA for her lawyer's disgusting behavior, he is unintentionally giving JB a huge door to continue disregarding the courts rulings. JB is counting on HHJP trying to prevent a mistrial, so he will continue with his antics. I don't know how to say this any better, but do you know what I mean? HHJP is between a rock and a mistrial.

Making demands on the defense like that would be grounds for a mistrial.

Saw Ashleigh on Twitter say something about court reporter in the jury room? Anyone ever heard of something like that before?

I'm just now getting here........got up at 7:45am (west coast) to watch the trial and found the court had been adjourned for the day. I've been trying to find out what happened to cause an adjournment.

The thought that crossed my mind when I saw it being reported that the court reporter when in the jury room is.................is a juror having an issue? Maybe a juror is having a meltdown and asking to be relieved of having to serve on this jury?

Right. Court will be in recess till 9am- meaning he wants witnesses and the jury there starting at 9 o'clock.
But any housekeeping issues must be presented before that time....8:30. He's already told both sides this which is why he was cranky with the state this morning.
