I am thinking SMS had a good idea that the case information would be sealed when he did the interview with Tricia. I remember him saying a judge could determine not to release the information yet.

Very disappointing indeed but totally understand the rationale...multiple additional arrests pending imo.

Another reason for sealing docs might be for protecting witnesses.

I'm surprise about this. I am expecting media to ask for a hearing on releasing some the docs.

Me too! Is it the process of unsealing them via hearing or are they sealed indefinitely? I was under the understanding that there would be redacted documents released or maybe not all documents as they may hinder the case, but to seal ALL documents in their entirety is a surprise. This is Florida for goodness sakes, at the very least we should get one document with all but 3 words blacked out! Lol

I'm lost. What is the difference?

An easy way to think of it is this:
Most CONFIDENTIAL documents are SEALED; but not all SEALED documents are CONFIDENTIAL.

Therefore, when some documents are UNSEALED, there could still be some CONFIDENTIAL documents which remain sealed.

A CONFIDENTIAL document would be, for example, the reports of a court-ordered psychological evaluation on a defendant. Generally, that document would remain CONFIDENTIAL and SEALED.

I wonder if sealing the docs was motivated in part to keep CWW in the dark for a little bit longer. Does anyone know how quickly a defendant in custody starts receiving discovery in FL? I've been reading the Florida Sunshine Manual, found some interesting points. In short, whatever docs CWW has we could have. I think.

"in other words, once the material has been made available to the defendant as part of the discovery process in a criminal proceeding, the material is ordinarily no longer considered to be exempt criminal investigative or criminal intelligence information (all information given or required to be given to defendants is disclosable to the public when released to defendants or their counsel pursuant to the rules of discovery)"

So, we have waited all this time for 3 pages worth of information? Feeling frustrated BUT do respect the process. I will have to place my shades aside.

I wonder if they are sealed because there is stuff that may incriminate someone that hasnt been arrested yet?

But would they have sealed the whole thing or redacted parts? Not sure about how the law is stated. And the search warrent documents? Surely part of those could be released without implicating another? Even if it only the part FOR specific evidence LE was looking for? What do you guys think?

But would we not recieve a redacted copy such as what our Websleuths mods presented to us in the RB case? I'm not challenging you, just asking since I'm a newbie to Websleuths (as of this case) and not familiar with the sunshine laws. Just aware that they are more lenient than other states.

Yes. One example would be if the 911 caller says something that LE is currently (1) concealing from a suspect or (2) waiting to see if the suspect reveals on his own (showing knowledge of crime details he shouldn't have). Or the 911 caller might have said something that is a lead still being followed up by LE.

I purposely copied AZlawyers response to noel leon's question about why the 911 call may not be revealed immediately, per the Sunshine Laws. Although noel inquired specifically about the 911 call, AZ's response would apply to any of the documents (arrest warrants, etc...) that would normally be released in the early stages.

Bottom line - as SMS has reiterated over and over again, this investigation is not complete. I assure you they had to be able to proffer to the Court a very compelling reason for the Judge to fully grant their request and order them to remain sealed.

I've seen many requests for docs to be sealed (especially in FL). More often than not, the judge either denies the request OR he will partially seal some docs and others he will order them to be released but agree to certain redactions.

This is all about keeping some very sensitive information private to protect the investigation. Hard as it is to wait, it makes me wonder exactly what is contained in those docs/calls more than ever. Must be some very intriguing information. When we finally do get them, I bet it will be worth the wait.

SMS has stated more than once that we dont know what they do. I cant wait to find out.

I wonder if we could still get a copy of the Notice of Confidential Information within Court Filing? Unless the order applies retroactively.
