I asked this in the legal thread but am going to ask here too since I know we have members with a background in social work.

If the judge decides that the girls should remain with MS, can he order MS to handover his guns?

Florida is VERY different from my state with regard to gun licensing but here, if the local PD who issued the permit have reason to believe that a person is a danger to himself or others, they can require them to surrender the firearms temporarily, immediately. I'm aware of someone who was publicly displaying signs of being in need of a mental health intervention. The local PD was contacted, they sent a letter telling the person to surrender the guns to police station temporarily, he ignored it. They went to the house, arrested him and permanently removed the guns. A family member who had the proper licensing could claim the guns but he will never legally own another gun.

Obviously, Florida is different when it comes to guns. Probably not as easy for local PD to remove guns based on a concerned citizen's complaint.

I can't believe, what the kids are going through.. I am just watching the evening News NBC2, MS with the kids entering the courtroom and shaking my head..

If those were his dad's guns, they might have been registered in MO?

Seems like such an easy condition, MS should just hand over the guns. Its not a stretch to think that someone potentially facing murder charges in a death penalty state would harm themselves. He should understand why anyone who loves those girls would be fearful, and rightly so. He is a man with little left to lose and has access to multiple firearms.

Missouri doesn't register firearms. Neither does Florida, by the way.
Ok, not arguing, but we have to get permits for handguns. Is that a type of registration? And if he "always carries", it is something concealable, because we do not see him toting a huge shotgun... Lol... Can you imagine that one? He would keep the paparazzi a few more feet away for sure!
Just asking about permit vs registration because I didn't know there was a difference, and I never heard of people re-registering when moving? But what do I know.

Just for concealed carry, though, right?

ETA: Oh, wait, I didn't see your quote about "always carries." Where is that from? But he could open carry without a permit I believe.

I love the mods. But I must say. Things are getting too interesting to have so many threads. These threads are splitting us up. When we all want to be together while bashing mark. Jmo.

Especially at night when some of us are still up. I truly forget which Teresa thread that i posted on as well as comments that were posted by others that I want to bring over or reply to.

Any handgun, but conceal and carry also requires a class.

The NRA says no. Maybe the rules changed since whenever you had to get your permit. ;)
[emoji15] yeah, it might have been a few moons ago...lol.
But I know the conceal carry classes are a recent development. And complaints about sitting around for half a day waiting for paperwork when purchasing. IDK. Since everyone is freaking out about the govt taking arms away, I ought to go check it out...lol

A gun for home and gun range purposes only is easy to get. But to actually carry the gun on your persons are suppose to be harder to get licensed for.

Some states process are very stringent on the conceal carry licenses.

Yep AZ/DEX, I am really out of date, and currently reading MO gun laws are loosey goosey, some of the the most lenient in the country. Looks like they now submit fingerprints for conceal permit.

They will do a dependency hearing…once a petition is filed which it looks like it already was they will go to trial in the event children are removed from marks care, family comes next they want children with family if at all possible. I believe DCF knows the girls have already lost their mother which is traumatizing enough the don't want the girls around for possible arrest of father further traumatizing. IMO MS lawyer is preparing him for arrest.

I have no idea how FL licenses firearms but I would guess MS would have to register them in FL.
You don't need to have a license for a gun here in FL. If it's a concealed weapon, no license is required unless it's a long gun.

Do we know LE didn't remove the guns from the home during the initial investigation? I would think firearms in the home would have been an interest in this case, even though the it appeared she wasn't shot. Just a hopeful thought.

Those sweet children must be scared to death- not particularly of MS- but just in general. He has cut off communication with TS's family and is stuck in the house 24/7 with their dad, who they must know by now is the prime suspect. It must be horrible for them. I just keep thinking an arrest is soon in the making.
