Here's one reason:


Arraignment

Arraignment is a court proceeding where the defendant is formally charged with a crime. It is a short hearing lasting no more than just a few minutes. At the arraignment hearing, Attorney Fogt will acknowledge the charges (the Indictment), enter a plea of "Not Guilty" or "Respectfully Stand Mute" and address bond if needed.

The reason why attorneys will "Respectfully Stand Mute," when entering a plea for his client is to preserve the ability to plead "Not Guilty by Reason of Insanity" and/or to preserve the right to determine whether or not his client is competent to stand trial. This action has NO detrimental effect on a client's case whatsoever. It is typically done out of abundance of caution.

Idaho doesn't have NGRI, so it must be something else. So far, Kohberger has told the Court he understands and is competent to stand trial.

I remember reading on here recently the defendant has a certain time limit to enter his plea, does not have to be at the arraignment, even though future hearings and trial date etc can be set at arraignment hearing. MOO. Could that be it?
IMO, because the prosecution has 60 days within which to advise if they'll seek the death penalty, it will give BK a chance to plead Guilty with a view to (hopefully) avoiding the DP.

A defendant can change their plea at any time, is that correct?

Made it into the courtroom. It’s pretty small. Kohberger is not in here yet, Prosecutor Bill Thompson just walked in.

The victims families are arriving into the courtroom. Kaylee’s sister Alivea has her baby with her.

I count about 25 people here sitting in the family section. A lot of people I have not seen before. Many are already emotional. Family is on one side, media on the other. About 50 people total.

Totally quiet in here waiting all you hear is reporters typing and Alivea’s baby making soft cooing noises:

I don’t see any of Bryan Kohberger’s family here. But there is also an overflow room I can’t see.

Kohberger just came in.

Kohberger is wearing an orange jail jumpsuit, seems to be wearing a bullet proof vest underneath.

Judge is reading Kohberger his rights and charges. Kohberger is looking straight ahead and nodding a bit to show he understand what the judge is saying.

Kohberger just said “yes I do” when judge asked if he understands anything he says can be used against him.

Judge is now going over the inducement with Kohberger

The judge is reading each victims name as he goes over the murder charges. Madison Mogen Kaylee Goncalves Xana Kernodle Ethan Chapin

Judge tells Kohberger the maximum penalty is life in prison or death.

Kohberger says “yes” that he understands the charges and penalties.

Kohberger is “standing silent” so the judge is entering not guilty pleas.

The prosecution now has 60 days to seek the death penalty.

Kohberger’s attorney is asking the judge to set the trial for October. She says it will take at least 4 weeks, maybe 6.

Bryan Kohberger trial date set for October 2nd at 8:30am.

Court adjourned

IMO the defense will immediately begin the process of delaying the trial.

Seen it a million times.
Will the venue stay in the North or move to Boise as the Vallow/Daybell trials did? Lewiston or Coer d'Alene in the North.
I believe one of the murdered student's family is from the Coer d'Alene area.

Or is this BK's decision to thumb his nose at the process and his attorney, Anne Taylor, had no choice but to go along with it?

IMO 100% strategic on Anne Taylor's part. I would stand mute if BK were my client especially IF the evidence is as it has been purported to be. IMO, the defense focus at this point would be to do whatever it takes to save his life. This gives them time to learn if the prosecution will seek the death penalty and change their plea accordingly to the best strategic decision.

He could change his plea to "Guilty" at any time, yes. Or "No contest."

That's exactly it.

IMO.

But if he pled ‘Not Guilty,’ wouldn’t he have an equal chance to change it to ‘Guilty?’ It seems to me that ‘standing silent’ is likely to be done for emotional reasons.
