That's terrific.:) And, this is why there are two sides in every case. A good lawyer should be able to go down any rabbit hole. That's what AT is doing here. The other good lawyer can see it an exercise in futility and waste of precious judicial resources.

I so appreciate hearing the legal thoughts here, from all viewpoints. I have learned a lot about the importance of some of these criminal law "rabbit holes" even though I find some of it very frustrating. I also have a new appreciation of the purpose for dissenting legal opinions from appellate courts. My thanks to you all. :)

I think Judge JJ will hear the entire argument (Defense Motions & State Reply) on Sept 1st, even though he may not announce a decision at that time. I sure do wish we had access to the 24 pages that were sealed.

What is it that the Defense seems to be drilling down to as 'exculpatory evidence'?

I think they are possibly talking about the 3 male unknown DNA samples and/or the alleged statement by the downstair roommate, about seeing a naked man running past.

The FBI will want to know of any investigator breaking the procedures. If she knew of wrongdoing by an FBI investigator it needed to be addressed immediately.
MOO more likely the use of vague conspiratorial innuendo to make friends and influence people has just finally caught up with her.

I figure the witness had no clue about that, when she swore out a legal document (affidavit), in which she claims knowledge of illegal behavior/malfeasance on the part of LE.

FBI is going to be interested in any claims about itself - but obviously, is also the main prosecutorial agency for alleged crimes by LE everywhere in the US (and Puerto Rico). She seems to claim personal knowledge of illegal or unethical behavior by LE, enough that in her own short career, she's observed quite a bit of it (but HOW? is she inside the hierarchy/management of some major databases? So many questions! FBI wants answers).

So. The expert opened a can of worms for herself. How any expert can sign an affidavit where every word is not 1) written by themselves and 2) true, I don't understand. Sure, there can be boilerplate (but, really, who pays much for expert boilerplate - a lawyer who hires such a person isn't seeking real expertise.)

According to this Jan 5 post, someone here was speculating as early as Nov 13, 2022 about a knife sheath possibly being left behind. This Jan 5 post has a link to that earlier post.
First time I saw mention of this was a screen shot of that FB post dated 11/30 and that was after the post you link. So, that's interesting.

Absolutely! And it would be an easy bat-down by Judge Judge to just say it’s already been ruled on by the Id Sc, leave it for another judge to deal with.

As @jepop says, the PCA, which was on January 5th.

However, I was looking through a very early timeline post, and LE mentioned that the weapon was probably some kind of knife, as early as the Nov 15 2022 press conf:


And I don't have a link for this, but: at some point about 4 months ago maybe, I read all the discussion threads from this case (for the first time). People were speculating early on that a sheath must have been left behind, I think because at some relatively early point LE also mentioned the type of knife ("Ka-Bar")--the idea being, how do they know what type of knife if they don't have the weapon? They know because they found a sheath for that type of knife.

Hope this all make sense.

It would make sense that at least some of those people would have seen or heard by then about the 11/30 PR post though

WSU linked to car with "one plate" to BK on November 29th. (pca)

White Elantra Public appeal 12/7/2022 (Meaning they knew prior, more support that they acted in a careful manner)

Now looking for date profile was made. I think they linked him by the car and video prior to the profile and IGG and it was subsequently confirmed by cast cell data, father's dna, and ultimately his direct DNA

I don't think the "They did the family tree and only then made BK fit as the suspect" is going to work. I think they had BK as a suspect within 2 weeks time - they just needed to confirm it. They didn't tell us of course, but they knew.

They had the car
One plate
Re-registration 5 days later traced back to the car
The cell phone linked to the car and BK (via previous traffic stops)
And both linked to the house

Followed by video of him exiting that car at the supermarket.

They just needed corroboration.

Logic dictates the DNA wasn't done yet for the simple fact that they needed this guy off the streets. They wouldn't have played around. They would have picked him up immediately imo. They were already concerned for the welfare of 2 witnesses/surviving victims. Doesn't make sesne they'd wait if they had it.

Not having this is why they had to wait and follow him all the way back to PA. So, I'm interested to see what AT is going to say to bolster this "They picked him to fit the evidence" argument bc so far it seems clear the evidence picked him.

There was also a rumour re the sheath (from that papa Rodger IIRC) before which makes it feel like it has been known far longer. I suspect that was a lucky coincidence!

That's what I recall as well. However, it still puzzles me (as I was watching in real time on FB) that this sheath stuff started before any word from MSM or LE. I believe it's related to Inside/Outside Looking and Pappa Rodger and the various conversations they were in. They must have been really good guessers.

Her memo was 109 pages, 49 pages of which was made up of the Defendant's arguments and the balance made up of various exhibits which include affidavits and other materials.

"109 pages of even Judge Judge getting tired of this" I bet

This is absurd. Why did she get him those 2 new suits and insist he be in them instead of prison orange when there is no jury even present? I don't think it was because she thought he'd never be seen on camera? Talking about violations, what about the gag order breached by the defense investigator to plant youtube stories? That's a bit more important. They have garnered quite the conspiracy theory following because of that.

And, haircuts, and cut/shaved down/tweezed and thinned-out eyebrows. Some have suggested possible hair lightening? Really changing that appearance.

This will be the next 5-month fight: Defense - His mug shot is inadmissible; State - Make an exception. He deliberately changed his appearance over this year to impeach our eyewitness.
