5/15/2012--Sentencing

  • #421
I don't think there's any more to the story. I think McClintic's version is pretty close to the truth (the first version). We know who (MTR and TLM), what they did (let's not go into that again), when it happened (April 8, 2009), where (Woodstock, Guelph, Mount Forest), why (MR's disturbed sexual deviancy), and how they abducted her (promise of seeing a puppy)...what else is there?

The only thing I'm mildly curious about is how MTR got to be this way, and what his family life and childhood was like. But only mildly--at this point, who cares? My curiosity stems from idly wondering how this ghoul (I still like that word for him) came to be the way he is.

Monsters like TLM and MR just didn't happen, their kind of evil was developed.

Just another coincidence ... May 15 was the first day the LE talked to MR ...

Another coincidence I noticed; MR was declared guilty on all 3 counts, 3 years and 33 days and about 3 hours after the crimes happened.

This is my 3rd post.

his request to speak to Tara privately reminds me of when Joran vandersloot spoke with Beth (Natalee Holloway's mother) ... Beth wanted answers too ... really she wanted to know where her daughter was so she could bring her home and bury her

Joran promised answers and gave nothing ... he just wanted to manipulate her some more

What did he say to her? This is totally what I think MR would do.

See link..

I think she is amazingly strong. And the rest of family including Rodney.

I had tears reading through some of the full texts for the victim impact statements.
MR is such a 🤬🤬🤬 and I hope the hours in his cell feel like months.

Thanks again everyone for the tweets, links to evidence etc.
I hope we all hear in a year or so that any appeal has been dismissed.

Peace and justice for Tori.

He didn't want to speak with her ... she went to the prison in Peru and managed to get in to see him with the assistance of a Dutch reporter. He filed a complaint about it.

Ultimately, he told her to write him a letter.

And this was after he promised answers? Just curious--don't want to go off-topic more than this, so this is my last question about it.

I hope we have legal experts explain the sentence. I don't get the 25 + 10 + 10 but he's eligible for parole in 22 years. :waitasec:

I am certainly no legal expert and I don't know if anyone has responded yet but all this means is this 🤬🤬🤬 will spend 25 years behind bars, in segregation before he has the chance to go before a parole panel who will look at his file and see he was convicted of three very heinous crimes. The longest being murder. They will then consider the other charges against him and decide whether he is worthy of being released back into society. With the other charges against him, he probably has a very slim chance IMHO of getting parole. Say if he was only accused of murder, he might be lucky to get paroled after 25 years, but taking into account of the other two charges in his file, and being declared as a dangerous offender (has that been solidified yet?), MR will remain in prison until his dying day. MOO

OR at least until someone finds a way of fixing his little red wagon. Bubba is always hoping good things are comming his way and looking for a little bit of love. Sorry just had to add that as MR is so deserving in my eyes and MOO. Hope MR is in there long enough to take in some serious suffering mentally and emotionally. Again MOO.

there is no way to gage truth with Rafferty. Tara IMO should not put herself or her family through it. Ignore him. Do not give him the satisfaction or the last word. Just leave him be and let him rot in jail Tara. He can only hurt you more; not help you with answers. MOO

Pfft we know he's not going to divulge where LE can find the remaining evidence such as the backseat and Tori's belongings, as he is still proclaiming his innocence. Yep it seems the monster wants to control all his women victims. Sickening piece of work isn't he?! I can see him now wanting to talk to reporters professing his innocence and how TLM turned his mind crazy with all her drugs and her music. She brainwashed him; that'll be his pathetic story.:floorlaugh: Tell it to someone who gives a ***** Mr. Monster, child abductor, pedophile, murdering b@s!@rD. GRRR! MOO

Actually the date given for first eligible parole is twenty two years from now. Three years served going to trial. Twenty two remaining on a minimum twenty five years. The kidnapping and rape are served at the same time as the murder charge.

I don't like the possibility he could be released even if everyone thinks his parole will be denied. You never know what will be happening twenty two years from now.

And I really don't like that he has HOPE that he will see the outside again. I want that door to shut behind him with the thudding sound of forever etched in his mind. He doesn't deserve hope. Tori didn't have any.

Don't worry ImpatientRH, MR is such a COWARD he will be begging them to keep him locked up, IF someone doesn't get to him first inside. IF he's released and free to walk, he won't get too far from the prison before someone tracks his sorry azz down. I would imagine there are people on the inside of these prisons who will make his life a living hell; here's hoping. MOO

Concurrent means all three sentences are served at the same time. So on one hand it appears that he isn't really punished for the rape and kidnapping, but they were the aggravating factors that got him twenty five to life for the murder.

He has already been in jail for three years, that is time served towards the twenty five making him eligible for parole in twenty two years.

The additional time and charges will account for a lot in 23 years when he files for parole. He won't be getting paroled in 23 years and I pray I am still around to hear the results of that application :denied::denied::denied: :moo:

Yeah me too, hope I'm around and I will not forget Tori!

I wanted to share a couple of articles not directly about MTR but about David Shearing/Ennis. For him, it's now 30 years later - he's had 2 parole hearings (2008 & 2012) and it still behind bars so I have faith MTR will never get out either. I can barely remember Shearing's horrible crime as I was quite young but I do remember always being afraid of going camping afterwards...

All three sentences will run concurrently (at the exact same time). He is eligible for parole after serving 25 years of his life sentence. They add the time served (3 years already in prison, from the day he was arrested) as being time served which is why he is eligible for parole in 22 years.

If the sentences had run consecutively he would have served 10 years for kidnapping, then 10 years for assault, then life for first degree murder and wouldn't have been eligible for parole for 45 years (minus the 3 years he has already served while awaiting his trial, so technically he would have been eligible for parole in 42 years had the sentence been consecutively). HTH

b) Multiple Sentence

Where multiple sentences merge, eligibility dates are determined (re-calculated) on the basis of the new single sentence.

However, Bill C-45 introduced two important rules regarding the imposition of additional sentences. First, an offender who receives a new consecutive sentence will have that sentence merged with the current sentence. Before becoming eligible for parole, the offender must serve, from the date of imposition of the new sentence, the remaining parole ineligibility period on the existing sentence plus a period equal to the parole ineligibility period of the new sentence.

Second, although under Canadian law, any sentences imposed in addition to a life or indeterminate sentence must be concurrent rather than consecutive, the principle of adding parole ineligibility periods now also applies where a lifer receives an additional definite sentence. This ensures that receipt of a new sentence has a direct impact on the offender’s parole ineligibility period. However, the parole ineligibility periods may only be added to a maximum of 15 years from the date of the last sentence imposed.

Detailed information and illustrations of the various combinations of consecutive and concurrent sentences and their impact on parole eligibility are provided in Sentence Calculation: a Handbook for Judges and Lawyers.

Any reports Smyth was present today? If not perhaps he will be for the transfer to KP. Gosh that would be the best!!!!

Yes Detective Smyth was present today to hear the sentencing of MR.

Wowzers! I would love it if Detective Smyth got the honour of escorting MR to Millhaven. I'm sure Smyth wouldn't mind sitting in the back of the pattywagon with his buddy MR and having a nice little heart to heart. He could fill MR in on what awaits him at Club Med and reaffirm MR what a lying sack of ***** he is and how he won't be zipping around town anymore in his crushed upbaby no more drugs, free money, stringing innocent women along with his lies and fulfilling evil perverted sick mind. MOO

From Christie Blatchford's article.
Then came the requisite attempt to identify with Daryn. "I have lost a child before," he said gravely, an apparent reference to a son of a girlfriend who tragically died as a youngster. The woman was actually pregnant when Rafferty met her, and he pimped her out (to the tune of $16,000) shortly after the baby died.

We have heard rumours MR had a six year old son at the time of his arrest, recently he claimed to have had a seven year old daughter and now according to CB the lame, lying "I have lost a child before" sympathy tactic is probably all BS on MR's part. All BS he told people to make himself seem more worthy somehow. IMHO it makes him look less than a man. If he did have any children which he fathered, he certainly wasn't man enough or decent enough to act like a real father. MR's whole life consisted of lies and using people. There was never anything to resemble a heart in this ugly shell of what resembled a human. MOO

Wills' Kingston cell empty, ready for Rafferty

By Tom Godfrey ,Toronto Sun

http://www.torontosun.com/2012/05/15/wills-kingston-cell-empty-ready-for-rafferty

It is too bad that Wills' is being moved, ...I think Rafferty would have enjoyed his company....

Richard Wills disgusts Paul Bernardo and Russell Williams, forcing transfer from Kingston Pen WOW can you imagine this, how do you disgust the scum of the earth.....Im kind of upset that they are moving this Wills guy, but I want to thank him for making life in prison so miserable for RW and PB, I just wish MR was in on this

During his trial, Wills frequently interrupted court proceedings by loudly passing gas and belching, among other things. At one point the trial had to be stopped when he reached into his pants and pulled out feces.

http://ca.news.yahoo.com/blogs/dail...ernado-russel-williams-forcing-202608330.html

ewww reading that article...this Wills guy is a sicko.....imagine him being bad enough to disgust RW and PB.....I kind of wish he was staying, they could have put bunk beds in his cell and made Rafferty join him.....

I did read an article earlier about Wills, it stated that he was next door neighbours with PB....looks like Smyth was right....he would be in beside PB making googley eyes at each other!!!
