5/15/2012--Sentencing

Shutting Down the Kingston Penitentiary Aired April 2012. In this clip they speak of making some inmates bunk together in other prisons because of the shortage of space. Let's hope MR gets put in with RW. I'm sure they could cozy up together quite nicely. :floorlaugh:

So who would you choose to double bunk with Rafferty? :woohoo:

There's also the faint hope clause in 15 years ...

"At the 15-year mark, the so-called “faint hope” clause kicks in, allowing the prisoner to seek permission to make a parole application. But most killers are turned down, and in this instance, the notoriety and extraordinary viciousness of the circumstances all but ensure that Mr. Rafferty will not be freed at that point – if ever. However, he likely cannot be ruled a “dangerous offender,” which spells an indefinite sentence, because that requires prosecutors to show a pattern to the criminality. And aside from a brush with the law when he was a juvenile, Mr. Rafferty had until Friday never been convicted of anything."

That's a very scary thought!!! I looked into the faint hope clause and if the crime was committed before Dec 2011 the perp can apply for this. I don't think he has a faint hope of getting it though.

The perfect one would have been the guy that they just moved out to BC....but anyone who can deliver a good dose of Karma for the next 22 years would suit me fine!

I don't know for sure, but I would think that if there were a discussion going on about the DP it might be in the private forums.

why does that need to be privat? The petition is online and public. Rodney and family goes with their opinion public. Why do we have to keep it privat? Just curious to know....:silenced:

My guess would be to keep heated arguments out of the public forums. It is a touchy subject. Some are absolutely for it, some are absolutely against. The discussion could be quite... colourful.

MR will not be able to take advantage of the "faint hope clause". It was abolished December 2, 2011. TLM will be eligible though, unfortunately. Doesn't mean she will get it though. HTH

OTTAWA - The "faint-hope clause" that allows serial offenders to apply for early parole officially dies Friday.

The federal government passed bills to change the law during the last Parliament under a minority Conservative government and those come into effect Dec. 2.

I wish it would snow here. I hate the summer!

I agree that MR is a misogynist. And a pedophile. And a psychopath. I would be willing to bet that he has molested previously and would have killed again if he hadn't been caught. I'm quite sure TLM would have continued on stabbing and physically assaulting people too. Actually, I guess she still is, she's just doing it in jail.

I wonder how MR is liking his new home?

When is MR going to Kingston, or is he there? PB and RW are probably preparing a welcoming party for him. I wonder what they will talk about. Will they ask him about his crime? Moo.

hard to believe that their is not already a minimum sentence....

yesterday I read about how the old amber alert worked. What nonsense that was. Thank God they changed that. Sometimes I really believe that people that make the laws are totally dumb or very slow thinkers (just trying to say it nice) ;-)

From briefly researching various law sites, it looks like the sentence is 5-7 years when a weapon is involved and 4 if not. What should be the minimum sentence for kidnapping a child?

Recall this case:

"After 18 years of relentlessly searching the globe, Joe Chisholm can finally stop looking for his lost daughter.

The girl went missing as an infant, allegedly abducted by Chisholm's ex-partner after an ugly custody battle. The mother and daughter weren't heard from again."

"The woman accused of abducting her infant daughter and hiding with her in British Columbia for 18 years will remain in police custody after a brief court appearance in a Toronto courtroom on Monday."

http://www.cbc.ca/news/canada/toronto/story/2011/12/05/abduction-obyrne-chisholm-court.html

Under the current system, this child's mother faces 4 years in prison. How should the law change to include all forms of child abduction/kidnapping?

I would like to see RW bunk with MR. I wonder if MR is privy to ordering items on line? He liked purchasing gifts for his "friends". Maybe he could order a purple ballgown and purple lingerie which RW would be very grateful for. I bet RW misses him mass collection he once owned. For some reason though, I cannot see RW play the feminine role between these two, so maybe they won't work out as cellmates. MR would be more fitting; femme fatale. :floorlaugh: :moo:

Per: The Mop and Pail, Rafferty is eligible to apply ... most likely because the crime and arrest predated the change in law.

We elect those that make laws. It's up to us to elect the right people, always easier said than done tho.

MR is in Millhaven for approximately six weeks for assessments and breaking in before they send him off to Kingston Pen. I'm sure the other inmates are anxiously waiting MR's arrival to his new home. The other inmates are privy to news reports via television, radio and newspapers. They know who the latest 🤬🤬🤬🤬🤬🤬🤬 is who occupy their neighbourhood. :moo:

I think we can trust that the inmates will give him a fitting welcome ... I'm sure that it will be a day that Rafferty remembers for the rest of his life. He'll be hiding in his cell forever.

Haha I will pass on that . Speaking of her who in their right mind married a murderer?

I can't post it because I read it on a blog, but according to the blog, KH married her lawyer's brother!
