9 Year Old Begs to go Home

The website HOV has been posted here before, on several pages of this thread in fact: the site's author has only posted links to actual documents, I know the article about the 2011 reunion is real since it's in news archives.

I have no idea if the site's author is posting links to actual documents. I saw alleged social media postings that sounded moronic. Something about carrying around a bullet so that if they ever want to commit suicide, all they have to do is visit a pawn shop? And that's nestled to a tidbit about a family reunion. And this is supposed to be taken seriously? Please.
They should be ashamed of themselves but I doubt that's possible.

I'm not trying to detract. Why the need for baseless accusations? The Court ruled AGAINST the foster parents after DCS decided the child shouldn't live with the foster family and also because the GAL said the child did not want to live with the foster family. Frankly, all you have accomplished is to prove DCS and the child were absolutely spot-on about the foster family. Frankly, they are proving themselves to be nuts but that is just my humble opinion.

The juvenile judge who ruled against the foster parents? The same Dickson County judge who was censured at least 3 times for misconduct:

And it doesn't matter. DCFS turned against the foster parents. The child doesn't want to live with the foster parents. Impossible to blame all this on the Judge.

Why do you keep calling them the "foster parents"? They went through the necessary process and legally adopted her. While the adoption may have been overturned on a technicality, they still took the time and effort and spent the money to make Sonya a permanent part of their family. As far as I'm concerned, that makes them qualified to at least be called the "adoptive parents". What happens when bio dad winds up back in prison? Does she go back into the system again? As for DCS and judges, we all know that they've never been wrong before.

I wouldn't take the guardian ad litem's word for anything, she appears to be covering for the states mishandling of the custody case, not the best interests of the child.
Why would a child say she doesn't want to be with a family that loved, provided her a stable home for 6 years? if she said this, she was probably under duress, coerced.

I just want to know what’s going on with the <self edited> bio dad? Is he depressed or something?

Why is it taking him so long to re-offend? He knows what to do. After all, he’s a professional thief, an expert criminal with a long resume. He needs to get up off his lazy butt and RE-OFFEND. Like maybe even before lunch today.

C’mon buddy—do it for your kid. Man up and think about your kid for once, eh? A nice, garden variety armed robbery or 2, something—threaten the judge or a police officer, a nice big drug offense, anything will do, but don’t hurt anyone else, ok? You can do it. We’re counting on you. We believe in you! RE-OFFEND. RE-OFFEND. YES, YOU CAN! JUST DO IT!

Because ANY foster home they could place that child in, at this point, is better than with him. IMO.

Bio dad's lawyer who filed this lawsuit was recently indicted on an extortion charge.

"According to a release, the victim advised she sought legal services from Gasaway in October 2010 to read her father's will. An initial fee was agreed upon by both parties."

At the HOV website, screenshots of 2013 FB posts by the bio grandma, stating that she carried around a 22 calibre bullet in her purse in case she wants to use it to commit suicide in a pawn shop:

I refer to them as former foster parents because that is what that they are now are.

The child is still in the system.

BBM. I think that is hysterical!! LOL!

Yeah I'm not that alarmed by that. In context, it appears she was talking about how she felt when depressed years ago.

There are more important things to worry about.

I hope she was able to get counseling, to overcome feeling depressed.

They are also the former adoptive parents. And as the adoption was COMPLETED after the fostering, IMO, it is more correct, AND more respectful to refer to them as the "former adoptive parents".

And yeah, I know the judge overturned the adoption on a pathetic, ridiculous technicality. I hope he loses sleep every single night for the rest of his life over that-- if he has a conscience at all.

This child will be lucky to live to age 18 in the environment the judge "sentenced" her to. There may be a legal technicality that "permitted" it, but it's dead wrong, IMO. He could have, and IMO, should have thrown up a ton of VALID delay tactics and roadblocks to prevent this, but didn't.

And now, sadly, the fastest and most reliable way to get that child out of this horrible felon's custody is for him to quickly re-offend. I hope the felon takes his profession seriously, and gets on with re-offending as soon as possible. While simultaneously not abusing, neglecting, or otherwise hurting this child.

The whole situation is disgusting. Like something that would happen in a very troubled, third world nation. IMO.

Sounds to me like the judge could have simply ordered a hearing on what is in the best interest of a child before handing her off to the bio dad. Even something so simple was not done.

The media refers to them as former foster parents and I will continue to do so.

No court overturned the adoption. A Tennessee Court of Appeals reversed a lower court decision to terminate the father's parental rights. Legal custody of the child is still with the State of Tennessee. If the father proves unfit, they'll move her but we won't know it because she's a minor child. Trashing her father on the Internet is of no benefit to the child. I think the Judge will address it at the next hearing. I do agree that such behavior is disgusting.

The former foster parents of a 9-year-girl at the center of an interstate custody dispute have filed an appeal of the Dickson County Juvenile Court’s denial of their motion to modify a custody order. Attorneys for David and Kim Hodgin of Dickson filed the appeal in Dickson County Circuit Court Tuesday, but details about it are unavailable because it has been placed under seal.

http://wdkn.com/judge-orders-foster...-custody-ruling-placed-under-seal-for-review/

Duke accused the Hodgin family of orchestrating a social media mob to sway public opinion. She suggested the judge put a restraining order on the family and their supporters to keep them from posting pictures of the girl. She said the public battle has made Sonya unsafe.

The judge didn't address that request.

I don't care if they're called "ex adoptive parents" "foster parents"
Doesn't matter a lick.
If she's "normal" they are her psychological parents and have been ever since she can remember. That matters. That counts. To rip a child away from bonded parents is cruel and inhumane.
There is more to parenting than blood.

I don't understand the legal error.

Father originally had a fifteen years sentence. That mean by law his parental rights were terminated. He got his sentence reduced because he made a deal. He had information about a homicide. Because of that deal, his sentence was reduced to 7.5 years and his parental rights no longer had to be terminated. Parental rights only have to be terminated if the sentence is 10 years or more.

As I best understand it, there is a law in Tennessee that allows a parent to lose parental rights because of "abandonment by incarceration" if the prison sentence is 15 years or more. That was the basis the foster parents used to get his rights terminated. However, he appealed because his sentence had been reduced to under eight years. Therefore, his parental rights could not be legally terminated.

This is a case that never should have taken 8 years to resolve. The person who paid a dear price has been the child, no doubt about it.
