A Closer Look at the Lawyers Involved

TERRY SHOEMAKER, ATTORNEY FOR HALEIGH`S FATHER, RONALD CUMMINGS (via phone): Yes.

GRACE: How is he responding to being behind bars? Not just because the drug sales but because Misty Croslin won`t talk about the night Haleigh went missing?

SHOEMAKER: Well, he`s very confused right now as to what`s going on with Haleigh`s case. You know, because he is behind bars, as you stated, you know, law enforcement isn`t keeping him up to date on anything that`s going on and he keeps wondering what`s going on? Do they have any new leads? Or has Misty said anything or anybody else?

So that`s the hardest part for him right now is trying to find out what`s going on with his daughter.

GRACE: Well, Terry, my question was more pointed. My question is -- I believe a lot of focus came down on your client, Ronald Cummings. Yes, he did the drug deals. I can see that on video.

But what they want is the truth about where Haleigh is. That`s what they want. Misty now is telling people -- Misty Croslin, she observed her cousin, who is not a suspect or person of interest, in the home the night the child goes missing. What about that?

SHOEMAKER: Well, that`s the first I`ve heard anything about her cousin being in the house that night. The only thing I`d heard previously and the only thing that I believe Ronald has ever heard is that possibly, you know, her brother went over based on some telephone call that supposedly happened when Ronald called the house. So --

GRACE: So you had not heard this, Terry?

SHOEMAKER: No, I have not.

GRACE: OK. Let`s take a look at the ammunition, just some of it -- this is the tip of the iceberg -- that the state has against Misty Croslin and Ronald Cummings.

TERRY SHOEMAKER, ATTORNEY FOR RONALD CUMMINGS: Thank you.

GRACE: Terry a well known attorney in the Jacksonville area. Number one, are there witnesses placing Ronald Cummings at work about 30 minutes before he was supposed to punch in and that he was there until his shift ended, the night shift? Yes, no.

SHOEMAKER: Yes. And it`s not a punch-in, you know, as far as a time clock.

GRACE: Correct.

SHOEMAKER: They actually have to use their fingerprints in order to scan in and check in for work, so...

GRACE: OK. Even better.

SHOEMAKER: ... he definitely was there.

GRACE: What kind of job was it, Terry?

SHOEMAKER: He was hired as a crane operator. However, his job duties would, you know, differ depending on what they had in store for him that night.

GRACE: OK. Terry, you have appeared on our show many times, answered a lot of questions on so many different subjects. Misty Croslin, your client`s wife, was supposed to be home by now. Where is she?

SHOEMAKER: To my understanding, Misty is still down in the Orlando area.

GRACE: Why?

SHOEMAKER: Well, originally, we thought that she was only going to be gone for a couple days. I know that Ronald has been speaking with her regularly. I don`t know the nature, the full nature of all those conversations, but I know that he has been speaking with her. And every time I talk to Ron...

Didn't PDM put in the fingerprint scan machine AFTER Haleigh disappeared?

They actually HAVE to use.......instead of They actually HAD to use...

Yeah.....NOW......duh!!!!!

He is making it appear the system was used...when Ron was there...and that he used it.....

But I believe you are correct....it was installed After Haleigh's disappearance..

Statements from James Werter on the Jane Velez show...aired May 14, 2010

Jim, thank you so much for joining us. I think the big question is, why did you release the audio of the telephone conversation between your client, Tommy, and Grandma Flo, and what is significant to you about those phone calls?

JAMES WERTER, ATTORNEY FOR TOMMY CROSLIN: Well, there are a number of reasons. The No. 1 reason is that, for the past few days, or ever since, there`s been a lot of disinformation, a lot of speculation, a lot of hearsay and reporting as fact. And I`m here to set the record straight, just like I was the last time, Jane.

VELEZ-MITCHELL: Well, set it straight. What exactly is your point with the release of these recordings?

WERTER: If you listen to the tape, you hear him do a tearful -- and I don`t want to use the word -- I`ve heard the word "confession" made. Wrong word. He was setting the record straight that he had to come forth finally and that he was operating for the past year under a veil of fear. Fear for his kids. You listen to the tape, you hear him complain about it. "I don`t want him near my kids." You know, "I was afraid for my kids." Things of that nature. So it lends to his present credibility.

Plus, he has been cooperating over the last month with law enforcement, and his story is now corroborating Misty`s current version. Both of these people have been operating out of fear for the past year, year and a half. And it adds a new twist and turn when you`re afraid for your life and you`re afraid for your kids` lives.

From the same show aired May14, 2010

VELEZ-MITCHELL: Why should we believe him now, when he has told several stories. One, we heard him on camera telling his dad, "I`m not going to make up a story just to get out of jail." So in that sound bite he`s essentially saying he didn`t know anything, and he`s also reportedly said that he went to the trailer the night that Misty disappeared, knocked and there was nobody there. So that`s another story.

WERTER: Well, look at the story now. Both of these individuals are being interviewed or have been interviewed by FDLE and Putnam County Sheriff`s Office separately. They have not had time to corroborate or collaborate in the story they are presenting to the sheriff`s office and law enforcement today.

And I am told by law enforcement that they are comfortable with the version that they are getting today. They are -- they do kind of back each other up. And so...

VELEZ-MITCHELL: Well, I guess are you -- are you admitting that Tommy lied previously when he said that he wasn`t going to make up a story and then was at the house and knocked?

WERTER: In the past I told you it was out of a veil of fear. The individual that they point to, and both of them are pointing up north. OK? And again, Misty never pointed at Tommy, and Tommy never pointed at Misty. That`s another fallacy.

"I think that the reason that we were able to get a lesser sentence than the 25 years is because of Haleigh's case," Shoemaker said. "I think deep down the state feels sorry, whether or not they admit it, and realizes what Ronald's been through with Haleigh."

Putnam County sheriff's officials have said the drug investigation was not connected to the Haleigh case.

well all i can say is i dont believe you le because between these two statments someones not being truthful.

this is the biggest pitty rc write up ive ever seen and i dont pitty him put i do pitty this child .not le or the sa or rc or tn this is about a child missing not a pitty party..ill just keep the rest to myself..

IIRC, Terry Shoemaker said Ronald showed up for work 45 minutes early on Monday. Chelsea Croslin exposed this lie when she appeared on Levi Page’s Show October 4th and said Ronald picked HaLeigh up at the bus stop at 3:39 pm which meant he started work later than usual and he did not arrive 45 minutes early. Starting late gave Ron an alibi because when the other employees shift ended Ron was alone in the yard giving him opportunity to leave and come back without being noticed.

What I want to know is this. Does a client have to tell their lawyer the truth or can he lie to them or withhold information from him the way Ron did with LE? Did Ron tell Terry Shoemaker the truth about his work hours or did he lie to his attorney and Terry doesn’t know the truth? Or did Ron tell Terry the truth and he is lying to the public when he appeared on NG and JVM to cover for Ron? TIA

All three, plus two others, are behind bars facing hefty sentences. Ronald’s attorney, Terry Shoemaker, said his client hopes to have the deal before his trial begins on July 19. Cummings faces five counts of drug trafficking.

Shoemaker said he has been working on the plea deal for more than a month following the release of undercover videos that show the transactions. “Everyone in the world has seen the videos,” he reportedly said. “It’s a great case for the state.” If the deal is accepted, Ronald Cummings will face 15-year minimum and a 30-year maximum per charge, Shoemaker said. The two most serious charges would be dropped and then Cummings would be sentenced on the three remaining lesser charges. Shoemaker would like to do more for his client but he can “only work with the hand dealt.”

This article is dated May 19, 2010....Shoemaker said he has been working on the plea deal for more than a month.....then he says it was following the release of the undercover videos...WHAT?!! The undercover videos were released Feb. 19, 2010...that's 3 months!
http://www.news4jax.com/news/22606713/detail.html

However, if you count back a month from May 19 it puts you at around the time of the dock search April 13-16....Investigators spoke with Ron that week during the dock search....I believe it was on a Wednesday, iirc....when did they call the family in?? IMO, Ron's interview was more of a interrogation because of the evidence that they had and Ron was caught in between a rock and a hard place...and days after that Shoemaker went after a plea deal....kinda like "ok I'll talk but only if it is something in it for me"....and Ron had to offer up information in the Haleigh case in order to get the plea deal...which he did....this has always been about Haleigh...even the drug bust....it was even said that investigators, hearing Ron's version of events were able to formulate their theory as to what happened to Haleigh...

IMO, the information that LE got out of Ron for this plea deal, was information that they knew he had all along.....here's a statememt made from LE, on the day the search ended:

April 16, 2010

Hardy said he's confident in calling this a homicide investigation based on information obtained by investigators over the past few weeks, and he said some "people are starting to cooperate" and talk, though he did not say who he was referring to.
http://www.news4jax.com/news/23174697/detail.html

IMO, this is in reference to Ron too...and if he was "starting to cooperate and talk"...that tells me that Ron had not been cooperating or talking prior to the dock search...

You gave me something to think about, Lone...it does make you wonder...it could've been Ron who gave Shoemaker hell about releasing this information, especially if Ron's protecting Teresa in any way.

I find it hard to believe that Ron mentioned Joe's name in the 911 call...only because right after that, Ron never mentions Jo...actually it seemed that Ron was trying to keep the focus off of JO..."there was no fight with no cousin over no gun".

JMO of course

Clearly, we know that ron is lying about JO...but which part? Was there a fight or wasn't there a fight? As usual rc is speaking out of both sides of his mouth. After all this time he now says there was a fight and a gun has been turned in. Well isn't that conveinent? What a piece of work! Fill in the blanks on why he changed his story...anyone?

If tommy and JO were looking for anything in ron's house, it would have been drugs. Maybe the word gun should be changed to "DRUGS".

Attorneys usually take their clients' word. They do not investigate except if it is a huge trial and they have money to spend. Now if it were a trial, the attorney may set up polygraph to see how their client will do if police ask the accused for one.

Remember oj, If the client confesses to their attorney, the attorney is obligated to tell the SA. So attorneys really don't want to know. Johnny Cochran and the rest will go to their grave with the secret and they willl always insist he is innocent; to do otherwise, puts them in legal jeopardy. They take their clien'ts word and go to trial accordingly.

Kimball and Snider

BRB and i will get the link :)

they seem to not have a website any longer, i will keep looking... i can attach links to media reports that show the name, if that helps any

http://www.gainesville.com/article/20090716/ARTICLES/907169927

this article is when DCF cleared Ron of the abuse allegations.

sorry here is an article when Ron hire the attorney above.

http://www.clickorlando.com/news/18967351/detail.html

Just passing along this new info: Kimbal and Snider are no longer law partners, I guess, as Kimbal now has a new office location near WalMart on Moody road...no mention of Snider on his tv add now, either.

He said something to the effect that he had three friends, Mowrey, Shoemaker and Beardsley (Beardsley handled his divorce and Mowrey is the third guy in the firm.)

Edit: here it is: http://www.staugustine.com/stories/092009/news_092009_040.shtml

Don't know if this was ever addressed or not...
Brandon Beardsley, whom RC thought was representing him in his child custody case, didn't show up on the emergency hearing for placement of RC jr. after RC's drug arrest.

A break may have come from Croslin, who said she was with Haleigh and the kindergartner’s brother the night of the disappearance. Her attorney said she may have provided helpful information that led to other leads.

“This latest search was based on information from someone else,” said attorney Robert Fields. He said Croslin may have “shed some light” on who was responsible.

“Somebody else has possibly been implicated in this,” he said. “You need to look away from Misty.”

http://jacksonville.com/news/crime/2010-04-13/story/authorities-conducting-haleigh-cummings-search

So Robert Fields is telling us that Misty may have shed some light on who is responsible....LE said there's a surprise person of interest.....maybe Misty did begin to implicate the Cummings...and with that information...LE approached Ron...who in turn, began working on a plea deal.....to add his version of events....a version that was needed to help with building a case against someone....that's why it is my belief that Ron nor Misty may be directly responsible for what happened to Haleigh...but clearly they both has or had important/valuable information to add against the person who is directly responsible....with that being said....whoever is responsible for Haleigh's death....they were worth being protected by both Misty and Ron....I think this is where the surprise POI will come into play....JMO of course
