Austin Barratt evidentiary hearing

Aug 23, 2019

The trial for two suspects in David Grunwald’s murder has been split up, just two days before it was expected to begin in Fairbanks. Austin Barrett and Bradley Renfro were supposed to go to trial together. Co-defendants Erick Almandinger and Dominic Johnson have already been convicted of beating and killing 16-year-old Grunwald in November 2016.

ANCHORAGE, Alaska (KTUU) - In a hearing conducted over Zoom and livestreamed on YouTube Friday, Austin Barrett became the first of four convicted killers to be sentenced for his role in the kidnapping, beating and murder of Palmer teenager David Grunwald.

The hearing came a week after the four-year anniversary of the brutal crime was committed on Nov. 13, 2016.

Appearing in a yellow prison jumpsuit and a black face mask, Barrett, now 23, sat at a distance from his defense attorney in a space typically reserved for a jury.

Prosecutors, parents Ben and Edie Grunwald, and Judge Gregory Heath were also present in the courtroom, and some of David Grunwald’s extended family members appeared remotely via Zoom.

[..]

Barrett, the last suspect headed to trial, took a plea agreement earlier this year after his attorney successfully argued state prosecutors should not be allowed to use statements Barrett made to investigators against him at trial.

Friday, Kalytiak said Barrett could be considered lucky. Prosecutors were confident about taking the other cases to trial and prepared to fight just as hard in Barrett’s case, but were not as sure they would prevail.

A nearly 2-hour interview between Barrett and Alaska State Troopers recorded on Dec. 7, 2016 — a day before the case was presented to a grand jury — was played in court months ago, as Howard argued it should be suppressed.

During the interview, Barrett is heard asking investigators, “Hypothetically speaking, if I was going to let you guys know anything, am I gonna go to jail for life, even though I didn’t do it?”

Barrett, emotional at times, also told them he was concerned about what the world will think of him and said he didn’t want his name to be in the news.

“I just don’t want to look like a bad person,” he said, later adding, “I just don’t want my name involved. I want to be able to get a job and be a normal person.”

Howard successfully argued that troopers violated Barrett’s right to remain silent and that the interview was obtained illegally.

Without Barrett’s own statements and considering the fact that he did not have a cell phone with him at the time of the murder, Kalytiak said taking the case to trial would be a gamble, something both parties decided to avoid.

Barrett pleaded guilty to a charge of second-degree murder and agreed to a 45-year sentence followed by 10 years of probation.

ETA: IMO, it appears that AB, who was present in the room when Frank Woodford was killed by a shot to the chest, six months before David's murder, also provided information to LE about the shooter of Woodford.

Confirming AB testified before the GJ for Frankie Woodford's murder in exchange for leniency with this case:

Barrett was also involved in a murder six months earlier. He was in the room with a friend later convicted of killing 16-year-old runaway Frankie Woodford. Barrett agreed to testify before the grand jury in that case in exchange for leniency in this one.

State prosecutors say they can’t prove who pulled the trigger. The gun used belonged to Barrett.

PALMER — Erick Almandinger, the first of four teens charged in the 2016 murder of 16-year-old David Grunwald, was sentenced Monday to serve 99 years in prison for the brutal crime with no clear motive.

[..]

Almandinger was the only one in the group who actually knew Grunwald. Both attended Colony High School together.

[..]

Prosecutors could not prove who fired the fatal shot. But they argued that Almandinger, who supplied the gun used in the beating and later lied to investigators, could have stopped the others.

[..]

Almandinger, who cried at times as he spoke, said he wasn’t asking for leniency. He said he didn’t claim the “excuses” -- expert testimony about brain development in young people -- that came up in his defense. He said he killed David Grunwald.

[..]

Prosecutor Melissa Howard said Almandinger has repeatedly violated jail rules, including being caught with a homemade knife and fighting with another inmate. In 2019, he assaulted a correctional officer, Howard said.

Retired Palmer Superior Court Judge Gregory Heath, who has presided over all the Grunwald hearings, referenced the “especially devastating” and baffling nature of the crime in handing down the sentence, saying it wasn’t an impulsive shooting or gang fight or drug deal gone bad, though it may have been some kind of gang initiation.

“Mr. Almandinger was the only one that really knew David. He knew him as a friend as he stated. Why he would turn on a friend is beyond me,” Heath said. “I really don’t understand it. He had done nothing wrong. For whatever reason, he chose to turn on him.”

[..]

Barrett said he fired the fatal shot in a jailhouse phone call with his grandmother that was played in the courtroom on Monday.

Peterson, the only teen involved in the high-profile Valley murder not actually charged with killing Grunwald, made state and federal plea deals that promise six and three years in prison for a total of nine years flat time.

The deals mark the first courtroom resolution reached in the 2016 murder of the popular 16-year-old near Palmer. The sentences still need judicial approval.

[..]

As part of his state plea agreement, Peterson at Friday's hearing said he agreed with certain grim facts of the case read aloud by Palmer District Attorney Roman Kalytiak as Grunwald's parents and supporters filled half the courtroom.

Peterson concealed the .40-caliber Ruger and 9mm Springfield used to pistol-whip and kill David Grunwald for another teen who told him he'd killed Grunwald and needed to cover up the crime, Kalytiak said, reading from documents.

Then, he continued, Peterson lent that teen — 16-year-old Erick Almandinger — and another two gas cans to torch Grunwald's Bronco.

He told them to "burn that b—-," Kalytiak said.

An investigator later found the semiautomatic pistols and another weapon — all of them loaded — in a black North Face backpack at the Peterson home near Wasilla, he said. Peterson had kept the guns in a shed and shot them.

AK DOC actually did a pretty good job at separating the inmates, given no Federal Prison and only one maximum security prison (Spring Creek, Seward).

And no surprise Almandinger is housed at Spring Creek.

Erick Almandinger Trial..

PALMER — The teenagers accused of killing 16-year-old David Grunwald left a blatant social media trail leading up to the crime on Nov. 13, 2016 — and for days later.

[..]

Evidence in the trial so far depicts a group of loosely supervised teens with easy access to marijuana — Almandinger's father grew it, witnesses say — and a fascination with guns and the Crips gang.

Grunwald, a "good kid" with a steady girlfriend and ambitions to be a pilot, had been to Almandinger's at least twice before to smoke marijuana and play video games, friend David Evans testified last week.

On one visit, Almandinger showed Grunwald the gun that prosecutors say was later used to pistol-whip him before he was shot and killed.

The digital investigation started the day after Grunwald disappeared.

A Samsung Galaxy tablet seized at Almandinger's home yielded Facebook messages between Almandinger and Johnson from the night Grunwald died, Trooper Dustin Jorgensen testified Wednesday.

Johnson tells Almandinger "we're at the camper" at 6:22 p.m., according to messages read into the record by Jorgensen, an investigator with the troopers' technical crimes unit. Almandinger tells Johnson he doesn't want to go outside and tip off his father that the other teens are in the camper.

Grunwald got to Almandinger's at around 6:40 p.m., according to a timeline presented Wednesday.

[..]

[Victim believed to be inside camper around 7 pm].

Around 8:10 that night, according to Facebook messages, Johnson asks Almandinger for his "toolie" — a Ruger .40-caliber pistol — and offers $80 to use it. Almandinger hedges and says they can talk in person later.

Johnson replies he can't talk in person and asks, "do you wanna be let in on something"? He tells him to swear not to tell anyone else.

"I gotta act fast like (right now) fast you feel me," Johnson wrote at 8:16 p.m.

They agree a minute later to talk via Snapchat, a social media platform that automatically deletes messages.

Almandinger later told investigators he brought the gun to Johnson in the camper. Prosecutors say that's the gun that was used to beat Grunwald.

[..]

The teens communicated regularly via social media in the days after Grunwald was killed, Jorgensen testified. A few days later, Almandinger posted a missing poster but also searched the Etsy online shopping site for "unique Crip-related items."

Almandinger told Peterson the investigators "literally have nothing and think they can get me (to) say I did some s—" he didn't do, according to records pulled from Peterson's Facebook account. "F— with a 16 yo genius see what happens (he inserted a smiley emoji) when youre smarter than the (cops)."

The teens deleted numerous other messages, Jorgensen testified.

If the timeline correct where EA's pose of friendly killers including Johnson were all inside the camper as early as around 6:20 pm, the victim arrives around 6:40pm and inside the trailer around 7pm, but EA is messaging Johnson until after 8:16pm when he brings his Ruger .40 to Johnson, was this an attempt by EA to hide the fact his pose was on the property from his dad and grandmother?

Could the murder of DG have been avoided if EA hadn't brought Johnson his "toolie" (Rutger) used to pistol whip DG?

I didn't follow this murder when it happened. It seems so senseless. I read it all today and articles that are still available. I tend to think that EA was attempting to hide the fact that they were in the trailer. If memory serves it was his grandmother who was in the room when he talked about walking David on the trail. Her face fell. Wonder how much trouble he had been in prior. This was a 16 yo with access to guns and lots of pot.
