I haven’t seen anywhere that it was specifically IY’s driveway. Just that it was a residence I think...
You are correct. It looks like the NYDN removed that from the article. I am not sure why news outlets that have access to the actual court documents they cite, would get it so wrong.

Having been discussing this...if you go back & watch the cute little outburst IY had in court, I believe this is the point he’s trying to make in all his broken English. Idk whether that makes him smarter than I thought or makes me an idiot lol
Or both, street smart/ common since idiot. It is amazing how many people get away with a lot of the crime for so long. Boggles my mind.

In consideration of when AF got involved, remember that IY was brought to Auburn by someone driving a red van. I think LE said it belonged to IY's father. Was AF the one who was supposed to pick him up? Was AF already in Auburn? Maybe both were in town for an evening of crime. If IY was not to be picked up by someone, then he would either be staying overnight (at the Clarion?), or finding his own transportation back home (!).

This confuses me too. Especially because I’m response to IY’s outburst the judge says “amended” I believe. Which to me means changed?

I’m no Atty either, and don’t really understand if these have any meaning other than getting cause.
Yazeed was charged with the first count of capital murder on Monday. The second count was served against him Wednesday while he was in court. The two counts are for Blanchard’s death during a kidnapping and for her death occurring inside a motor vehicle.

There are 2 different capital murder affidavits. The first he was served on Monday 12/2. The second he was served in court on Wednesday 12/4. Both of these are separate to his kidnapping affidavit that was served and filed and ruled upon back in November.

Yes. that is exactly what I am saying. There are two versions of the murder/kidnapping affidavit. One on 12/2, the other on 12/4. 12/2 = forced. 12/4 = interacting.

I think you are correct. From this link:

"Yazeed was seen coming into Auburn earlier on Oct. 23 in a red Dodge Caravan registered in his father’s name, Mixon testified. The van was later found in Montgomery."
I think I saw a video of Mixon discussing this in court but I can't find it now.

I’m actually not confused by it. I think it was a wise move on the part of LE and the DA to have the witness to the kidnapping left out/updated/removed/amended/changed on the capital murder affidavit. He wasn’t a witness to the murder and they got their show cause without having his statement. The judge had only authorized the witness to remain unnamed for the first hearing. IY’s attorney was unable to argue the point of revealing this witness again at the second hearing so the witness remains unknown to IY, AF, and DJjr (upcoming hearings) and protected. MOO

Oh yes it’s very telling to me that he never said “I didn’t do it!” Instead he says “ya’ll can’t prove it!” Imo

Strong agree, here. I think it was an intentional move to save "exposing" the witness.

“I felt I just needed to come to the place where they found that sweet Aniah Blanchard’s body a couple of weeks ago,” said Phillips.

Phillips spoke about bringing humanity and love back to the forefront of American society.

“In some respects, I feel that we are like a wild dog in the summertime, running wild in the street in our community,” said Phillips. “There is no fear of anything, no fear of God, no fear of jail, no fear of the policemen, no fear of the death penalty. They have sort of overtaken our community.”

From Macon County Road 2, Phillips spoke for a moment, specifically to the African American population, asking for an end to the violence.

“It saddens me that in Birmingham we lost another 5-year-old to senseless violence,” Phillips asked, referring to the shooting death of Tanarius Moore. “A 5-year-old child and it’s as if there are no marches. Where was the march for Blanchard? Where was the march for the 5-year-old killed because his family members were shooting at each other?”

Phillips said it is time for people to stop standing by and start standing up to demand compassion for all lives.

For a baby’s body, a sweet, innocent child, who was going to the store to get something to eat and we find her body in the woods a few weeks later is diabolical,” Phillips said. There cannot be that much lack of compassion in this world that we accept this as normal behavior in a civilized world. We cannot do it.”

If that’s the case (& it might be I’m still baffled by this), then why reference the witness at all?

I certainly don't know enough about the law, but I think they had to have that information to hold him in Lee County, before the evidence started showing up.

If we have figured out who turned state witness, I am sure the gang on the streets have figured it out, as well. I hope nothing happens to him before this case goes to trial. In that type of environment, he needs watch his back.

I'm leaning this way now, too. When IY was first brought to Lee County, really all they had was the witness. No DNA, no body (no proof that she was even dead), no accomplice, nothing but him being in the same gas station she was in. Now that there's so much more, they probably don't want or need to rely on that witness as heavily, for any number of reasons.

Even so, in order to charge him with the count of capital murder kidnapping, there has to still be evidence of the kidnapping part I would think? Bc kidnapping is one of the things that can make it capital. His second count is for shooting in the vehicle.
