DeKalb County prosecutors will seek the death penalty against a woman who they say pushed another woman off a cliff, where her body remained undiscovered for almost two years.

Loretta Kay Carr, 45, of Fort Payne, was charged last year with capital murder-kidnapping in the October 2021 death of Mary Elizabeth Isbell. Her daughter, Jessie Eden Kelly, 22, faces the same charge.

According to court documents, Ninth Judicial Circuit District Attorney Summer Summerford stated the death penalty is warranted by the “aggravating and mitigating circumstances” in the case.

Loretta Carr and her daughter, Jessie Kelly were arrested and charged with Isbell’s death. Carr was charged with capital murder(kidnapping) as the alleged incident happened during an abduction/attempted abduction. In 2024, Carr entered a not guilty plea by reason of mental defect.

Kelly was also charged with capital murder. In May 2024, Kelly was indicted on the capital murder charge and during her arraignment hearing on June 12, she filed for youthful offender status.

Kelly’s next hearing is scheduled for October 17, 2024 at 9 a.m.

Carr’s jury trial was originally set for November 2024 but her defense attorneys say they are still in the discovery process.
  • They are working to bring her back to one of the crime scenes to map out what exactly took place.
  • They told the judge that none of this would be complete by the original trial date.
  • The earliest possible date for her trial could be April 2025.
  • Kelly's next hearing is set for October.

An Alabama attorney explains it in this article. She would be tried without a jury and would receive a lesser sentence, but he says the higher the crime, the less likely it is that a judge would grant it. MOO

“It’s a tool defense attorneys use to try and get their clients the best outcome. It’s a very useful tool. Any client you have under the age of 21, you’re going to apply for youthful offender,” Appell explained. “You don’t have to, but you would be committing legal malpractice if you didn’t.”

One crucial aspect of youthful offender status is that it requires the defendant to waive their right to a trial, putting their fate in the hands of a judge. Appell clarified that while the potential punishment could be up to three years in prison, it is more likely to result in probation. However, he emphasized that a judge must first approve the application before any such outcome can be determined.

She has been fighting for youthful offender status for months and on Tuesday, the district attorney’s office said they are still reviewing her application, adding it could be February before a decision could be made.

Can’t disagree in many respects @RickshawFan ….. but also have to wonder if part of the real problem in this case might originate with the ‘parenting’ here, or lack thereof?

A woman accused of kidnapping and forcing a missing woman off a cliff was denied youthful offender status on Thursday.

Jessie Eden Kelly is charged with capital murder for the death of Mary Isbell. Kelly’s mother, Loretta Carr, is also charged with capital murder in Isbell’s death.

That YOA status should be reserved for people with some kind of redemption quality and I’m not sure it exists in someone who could be so cruel.

A woman charged with capital murder for pushing another woman off a cliff won court approval on Wednesday to wear an electronic stun vest during her upcoming trial.

Loretta Carr asked for the change so she would not have to appear at trial in handcuffs and a jail jumpsuit.

Carr’s trial is currently scheduled to begin in December.
