Shelby1, Thanks for the link. It sounds like both grandma and step mom were in cover up mode during 911 call. :gaah: I hope Judge Ogletree releases the call after trial.

Gibson said Joyce Garrard told her Savannah had been picking up sticks in the yard. Then she was going upstairs to go inside to take shower.

WilliamThornton @billineastala · 39m39 minutes ago

Then she told her Savannah was going up stairs inside the home to take a bowel movement.

WilliamThornton @billineastala · 38m38 minutes ago

Under cross by Richard Rhea, Gibson said she incorrectly marked Savannah's consciousness score on the records 45 minutes after assessment.

WilliamThornton @billineastala · 36m36 minutes ago

I clicked the wrong button she said. Rhea then asked her about the scribe Rene Jones who testified last week Savannah was unresponsive.

WilliamThornton @billineastala · 36m36 minutes ago

If you recall, Jones also testified she incorrectly marked Savannah as alert on records.

WilliamThornton @billineastala · 35m35 minutes ago

Rhea also asked Gibson if she was a defendant in the civil lawsuit filed against GRMC by Svannah's father. She said she was.

So you have two hospital workers testifying that Savannah was unconscious, and that she was twice incorrectly categorized as conscious.

WilliamThornton @billineastala · 35m35 minutes ago

Court about to resume.

WilliamThornton @billineastala · 14m14 minutes ago

Court is in recess until 1:30 p.m.

WilliamThornton @billineastala · 13m13 minutes ago

The State rested after the recess.

WilliamThornton @billineastala · 14m14 minutes ago

Then defense moved for an acquittal, and Judge Ogletree denied the motion.

Defense attorney Sam Bone argued that the state had not proved capital murder because they had not proved intent.

WilliamThornton @billineastala · 13m13 minutes ago

Bone said the idea that Garrard intended to kill her own granddaughter while "teaching her a lesson" is absurd.

WilliamThornton @billineastala · 13m13 minutes ago

"How is she going to teach her a lesson if she kills her?" Bone asked. "You discipline to teach...that's too far a leap to make."

WilliamThornton @billineastala · 12m12 minutes ago

Bone said Ogletree needed to "take death off the table." "The state has not proven its case," he said.

WilliamThornton @billineastala · 12m12 minutes ago

Chief Deputy District Attorney Marcus Reid argued that the state had proven its case, because of circumstances of death and Savannah's age.

WilliamThornton @billineastala · 12m12 minutes ago

He cited a 2013 capital murder decision in an Etowah County child abuse case - saying that the "duration, brutality and relative strength"..

WilliamThornton @billineastala · 12m12 minutes ago

...of the defendant and victim must be taken into account. Joyce Garrard "crossed the line," he said, repeating something he said earlier.

WilliamThornton @billineastala · 11m11 minutes ago

At some point, Reid said, Garrard knew that "continued infliction of injuries and a child victim" would result in permanent harm or death.

WilliamThornton @billineastala · 11m11 minutes ago

"This case is more than sufficient to go to the jury," Reid said. Ogletree denied the motion, and then dismissed court until the afternoon.

WilliamThornton @billineastala · 10m10 minutes ago

I'll have a story up in a moment on these developments.

Well, the state rests. Of course, I can only go off of the tweets, but their case seems very concise.

I agree, Shelby1. JG is an adult and should have known better than to run a little girl for over 3 hours. I look forward to hearing the defense's case this afternoon.

OT Thanks for joining us tlcya! Great 'seeing' you!

State rests in Joyce Garrard case; acquittal motion denied http://s.al.com/8Ebs3MV via @aldotcom

WilliamThornton @billineastala · 41m41 minutes ago

There was no mention when court started of the reason for the two days of recess.

WilliamThornton @billineastala · 41m41 minutes ago

All the attorneys for both prosecution and defense were in court this morning.

WilliamThornton @billineastala · 41m41 minutes ago

Judge Ogletree told the jury he was "under the weather" this morning and he spoke with a husky voice.

WilliamThornton @billineastala · 41m41 minutes ago

The state rested at 9:45 a.m. after calling its 16th witness. There had been some talk they would finish on Wednesday, but there were...

WilliamThornton @billineastala · 40m40 minutes ago

...several rulings on Wednesday and motions outside the jury, as you'll recall.

During the Gibson testimony, Richard Rhea made sure to get the witness to mention Rena Jones, the medical scribe from last week.

WilliamThornton @billineastala · 41m41 minutes ago

"Oh yes, I remember," he said. Jones was the one who also testified that she accidentally marked Savannah as being conscious.

WilliamThornton @billineastala · 40m40 minutes ago

Gibson also said it's "not a common practice" to go back and correct initial medical records when care is being administered.

WilliamThornton @billineastala · 39m39 minutes ago

She said care is administered first, then the paperwork follows. But she did not know error had been made until she saw the record later.

WilliamThornton @billineastala · 39m39 minutes ago

When Rhea asked if she discovered this because of the criminal case or the civil case, she said the civil case. Savannah's father sued...

WilliamThornton @billineastala · 39m39 minutes ago

...the hospital last year, claiming she received improper treatment.

WilliamThornton @billineastala · 39m39 minutes ago

Gibson also testified that she found the errors in the record.

WilliamThornton @billineastala · 38m38 minutes ago

After a brief break, the state rested. Then Ogletree told the jury, "Alright, we're going to take a break." He drew a laugh....

WilliamThornton @billineastala · 38m38 minutes ago

...since everyone had just sat down again.

Gibson said Savannah was not awake, "not responsive," when she was brought into the emergency room. She said Garrard gave two different explanations for what had happened to Savannah.

The first was that Savannah had been picking up sticks in the yard and went upstairs to take a shower, when she presumably fell. Next she told the nurse that Savannah had been inside the house and was going upstairs to take a bowel movement.

OMG! I don't like where my mind is going with this so this post may seem graphic to some.

From a prior news story (I'll try and find it and add link) Savannah was found by EMS lying in the yard, wearing panties and shirt and cold and soaking wet. Savannah was seen on all fours vomiting in the yard and JG pouring water into her.

Putting 2 + 2 together here so this is JMO. I've wondered why Savannah was only wearing underwear and t-shirt when EMS arrived. I think Savannah's body was already shutting down and going thru the natural process a human body goes thru including vomiting and defacating. IMO, Savannah vomited in the yard and JG took her inside where she pooped herself and JG put her in the shower to clean her up and hopefully wake her up and put clean underwear on her. But it was too late. Thus the two conflicting stories. What was it the mother of that woman in FL said about her daughters lies about her missing/dead little girl Caylee? There's a little bit of truth in all of her lies ...... or something like that. That is the pattern I believe I am seeing in this case. No way was Savannah in any shape to shower herself.

OT I'm not really a DP proponent but support it in heinous crimes and the wishes of the victims family. The felon gets numerous costly appeals and, not to mention, extra attention. (JA) If the accused ever makes it to the death chamber, they are given 'one last meal' in some states. What is the point of 'the fancy last meal' when those charged with processing the execution just give the inmate an enema and clothe them in a diaper under their stripes a few hours later to avoid a mess during the death process? Just give them regular prison food like all the other felons. SMH
ALL MOO

WM, that was EXACTLY my first thought, too, when I read about the bowel movement. That poor little girl.

  • #375
I believe this is the bio grandmother and the step mother. Has anyone heard from her father, is he in court??

I would also like to know if Savannah's father is there. There have been reports of JG's family being in court but nothing specific. I'd also like to know about the the results of the civil lawsuit against GRMC.

  • #377
Yeah, I'm dying to know about the father dynamic. Are he and his wife still together? Does he come to court? Which side does he sit on? Does he visit his mom in jail? What is the status of the civil suit?

Too bad she wasn't Jodi Arias's grandmother!

Too bad she wasn't Jodi Arias's grandmother!

Haha! Thanks for the chuckle Linask! Yep, JA prolly wouldn't be around to waste everyone's time be cause JG would have killed her long ago for LYING!

Too bad she wasn't Jodi Arias's grandmother!

Really? You wish for a 9 yr old to be killed? Come on.. Bad form.

She is a hateful woman and the fact that she would do this to a child means she is a bully who likes to dominate. May she be in jail and dominated a long time there.
