When authorities searched the car, they found methamphetamine and drug paraphernalia. Day was charged with possession of drugs and drug paraphernalia, as well as two counts of attempted murder and two counts of shooting into an occupied vehicle.
He allegedly shot three times into a vehicle on James Road on October 28, 2001. The vehicle was occupied by Allen and his sixteen-year-old niece at the time. This was six weeks before Allen disappeared. He was scheduled to testify against Day about the shooting, but he vanished before the trial.
